This email was never replied to and actually on the same chain in which they offered us the 5 year blanket NDA.They have your email that you sent for a regular NDA. Did they send it back and say ok here is a normal NDA? No, then tough.
While I don't disagree with your outrage, I do think it's important to note that the NDA really wasn't all that harsh for REVIEW sites. If you wanted to engage in journalism related to nVidia though...I can't wait to see how similar or different all of the popular YouTube channels data is compared to your numbers.
Not that anything should be different, if someone did get their cherry-picked review samples by sucking on nvidia's titty, and they try Focus more on titles or one-off use cases to show a higher margin of performance, we will get a good picture of who the toxic shills are.
It was interesting to watch how the review Paradigm shifted around the gpp introduction, and how the more popular reviewers either had to dance around the issue or try to play the Nvidia policy blame game or explain themselves when the new NDA hit.
If you sign an NDA that is designed around protecting the company's interests more than honest product reviews and you are mad about someone going and getting a card just like if I were to walk into Best Buy and pick something up, and compare performance to some other product, you need to go fuck yourself.

What I don't get is since when did tech journalism become basically communism? All sites and channels working together, hand in hand, sharing resources for the benefit of each other? This is a business and a pretty competitive one too. Do you really think if the New York Times got the low down on a hot story that nobody else had, they'd share it with the other major papers? You think Walmart worries about "disrespecting" Target when they're able to sell products at a cheaper price? No other businesses in no other field that I know of do this and to think [H] should've sat on this in order to not hurt Linus' or Jay's feelings is just ridiculous.
Giving up your competitive advantage in business so it doesn't hurt the feelings of your competition and to ensure nobody has an edge over the other or profits more than the other, well to quote the great Buford T Justice, that's just pure and simple old fashioned communism.
