After you filled out your claim back in 2016, did you print out your receipt with claim ID number? If you did, I would call up KCC and give them your claim number and have them look up your status. Yes the lady might just give you a generic canned response, but if she sees you're in the system, then you should be good.

I did print my confirmation. Emailed them 7 days ago with my information, got the canned response 2 days later. Followed up the same day stating that this was not satisfactory and that I wanted an update on my individual claim. No response. Sent another email again this morning. No response.

Try giving that 866.381.9100 a call. I believe a few members here had luck actually TALKING to a person, although it wasn't exactly the most helpful info. But at least they "found" them in the system after verifying their claim ID number. That's why I suggested going that route because you said you haven't received anything in the mail. If they can find you in the system, then at least you're there, ya know?

I checked and I still have my claim form receipt. My date guess was close - I submitted mine on September 28th. I'm at work now, but I will be calling KCC later today when I get a chance.

Make sure you guys know we will be filing a class action lawsuit on how our funds are being handled.

So far we get no real answers from anyone.

This company of lawyers makes a lot and they can afford a better experience than this in handling funds. We can at least sue for maybe around $250 extra (each GPU) for damages caused by this horrible time consuming experience.

Some people value time more than this $30 and are now basically conned out of more and more time as we move along.

The contact info on the official NVIDIA law suit website is completely useless as usual, you have to scroll to the bottom and find who is in charge of your funds now.

Tell the first person that answers to transfer you to class action lawsuits.

I actually had a super visor talk to me, telling me too bad and that I need to send the documents again, this time manually.

If you bought from newegg call them and they can send your serial numbers (and a fresh copy of your invoice - "proof of purchase") to you by email.

I sent a polite, but firm email regarding the growing distrust and dislike of the claims disbursement process. I actually received an email from a person, who was not afraid to send me their name; not the normal form letter response basically saying "wait 4 more weeks."

As many people have pointed out before, it is best to use the: Kurtzman Carson Consultants 866.381.9100 contact information if you want to talk to a person and get some more information about your claim specifically.

This individual could not provide a definite endpoint, but their expectation was that the process should complete in 1-3 months.

I appreciated getting a response from a real person, and I hope that when I make time to call the phone number, that someone there will provide more information and be just as personable.

There is one thing that actually made me pretty angry though. On the company website: http://www.bursor.com/ , the second image says that GTX 970 payments have been mailed out. I honestly think this is falsely reporting their efforts as only a percentage of payments have been disbursed.

I tend to get excited about things that most people would find innocuous, but I still may compose another email drawing attention to their own (ironic) false representation.

Thanks for sharing all your stories and providing updates along the way. I wish this whole process would have taught nVidia a lesson, but it appears they simply rose their prices to compensate for this lawsuit.

I am all for $250 per GPU, but how is this going to work out? I mean yeah they've been treating us like crap!

Thanks for the update mwhender. That's good you got a response back but don't expect anything miraculous when calling the 866 number. I've read people haven't had good luck when calling in. Just basic generic responses.

Since I was crypto mining with these, maxing out the GPU completely (in this case the lawsuit was the RAM issue) you could easily see that they indeed cheated us on half a gig of RAM. On a big scale this causes damages and is a lot more noticeable. (I bought 20 which is a whole 10GB of RAM in lost performance! some other friends I know bought up to 50!)

$250 per GPU is very reasonable and more depending on how this ends and if they will ever answer to exactly what happened.

I have been calling daily, sometimes able to talk to a "super visor" with the same info, no real update, questions denied completely, etc.

My research with my lawyer continues and I will be contacting the courts where the funds are located. I let them know all phone calls are being recorded.

So I just got off the phone with KCC. The lady explained to me that the case is still active and once the court approves the settlement then Nvidia will be notified the amount of the settlement payout. Within 14 days from that notification, Nvidia will deposit the required funds into a holding account from which the claims will be paid out from. Sounds like another canned response to me, but she did verify that my claim is in the system, so that's a plus.

All of what you say is well and good but ignores the fact that people have been receiving settlement checks which would be impossible if nVidia had not already contributed to the escrow account from which the funds are going to be disbursed.

I suspect that your summation is more accurate: It's a canned response.

The real issue here is that people are getting deficient claim notices after providing adequate proof, according to the letter of the claim.

This is a very old canned response, who ever you talked to was not updated or didn't care, I'm not sure how these people operate, I mean this is worse than the people at the DMV.

Has anybody heard anything from those who sent their deficient claims form back early? It's been a month or so. I'm wondering what the heck is taking so long?

TehTechnie, please keep us posted. If these guys keep playing games, then I think a class action against them would definitely make them change their tone.

    b. Reimbursement Fund.
2.3 The Administrator shall establish and maintain a non-interest bearing escrow
account (“Reimbursement Fund”), to be funded by NVIDIA as described below.

So they aren't making any interest on the money? Well if they aren't, then looks like they're just trying to steal our money at this point.

TehTechie, any updates on your end? If these guys keep giving the run around I wouldn't mind joining to sue them for $250 per GPU.

    Still nothing for me.
I don't even have my claim number, since they never even sent me a confirmation email and I didn't immediately put the number in a vault when I filed for mine.

Probably more hassle than it's worth at this point.

Still nothing at all here.. no settlement check, no notice of deficient claim form, nothing.

Filed back in October 2016 after receiving the notice and iirc, the online form was auto-populated with all of my information after entering the claim number (970 was purchased from Newegg, so I'm thinking they provided the info). Never received any email confirmation afterwards and could've swore that I saved something as PDF after submitting, but hell if I can find it again.

Contacted info@bursor.com twice so far and received the same semi-canned responses. The first was in early May, after telling them that others were receiving their settlement checks an entire month earlier - they said to wait another month. And after a month later, I contacted them again and was told to wait another 4 weeks.

It honestly pisses me off seeing others here and elsewhere just giving up, since it's only $30.. but these shady #$%!'ers have already taken so much of the settlement while consumer's are getting nothing at all

So I ended up calling the 866 number. Got transferred to class action lawsuits and was on hold for 20 minutes. It was a long hold last time I called as well and so I just hung up. But this time somebody actually came and helped me. I gave her as much info but she was unable to pull up anything regarding this case at all. She even said she doesn't even know what the GTX 970 lawsuit is. Sounds very similar to above experiences if you ask me. The best thing she could do is take down my info and have someone call me back in regards to what the heck is going on over there.

    This is pretty disappointing.

I sent email to info@kccllc.com and got a response in a few minutes from #NA KCC NOVR GTX970Settlement <Admin@GTX970Settlement.com>.

They said mine "was approved and is included in our upcoming distribution (issue date of 07/14/2017)".
I submitted the form and receipt in September 2016.

Few minutes? Wow, that's a first. Did you just include your claim number and that's it? I am also guessing you didn't get a deficient form in June?

EDIT: Nevermind I just noticed you sent info@kccllc.com an e-mail, not the typical info@bursor.com. I think we should all contact KCC from now on instead of Bursor. They're the ones actually sending the money out, not Bursor. Bursor is simply the lawyers and KCC is the company handling the money.

Emailed them earlier today with my claim number, after reading selflove's post. Haven't heard anything back yet.. has only been a few hours, but definitely not "minutes" for me. Then again, maybe they might've gotten a large influx of inquiries today from the dozen of us still following this thread?

EDIT: 3 full days later and still no response back from KCC at all. Also, aren't these guys already in breech of the Settlement Agreement (PDF)..

Yeah I sent them an e-mail yesterday. Still nothing, but that's fine. I'll give it a few days.

Also, I didn't receive a call back from KCC either. I'll give that a few days as well. I'm afraid my results won't end positively though, considering other folk's experiences noted above.

Well that *sounds* promising. The 14th is this Friday, so we'll see if they actually distribute any checks. I will be sending an email info@kccllc.com at some point today to see what they tell me... if I get a response.

    Hi all,

Like many others I've been following this thread for a while, but have just got round to registering and sharing my similar experiences to the majority of others on the thread.

I emailed the info@bursor.com address on the 14th of June, and received the now well-used reply "We estimate that all claimants will receive their claims rewards within the next 4 weeks" a few days later. However, similar to everyone else, this seems to have been a straight up falsehood as I have not received anything and 4 weeks has now elapsed.

Following other recent suggestions on here, I also emailed info@kccllcc.com reiterating the completely unacceptable lack of correspondence and conflicting information I, and many others, have experienced throughout this litigation process. I also re-attached my two Newegg receipts, and the successful claim confirmation I received way back on the 7th of October. I sent my email on Friday of last week, and surprise surprise, I am still awaiting a reply.

I will update as necessary, but it appears we are all being given the royal runaround. I would also be in support of undertaking further legal action if this issue is not resolved soon, given the ridiculous amount of time it is apparently taking to disburse money to successful claimants.

I tried calling KCC today multiple times. Looks like the receptionist took a vacation because nobody answered each time. Will try again tomorrow but this is pretty annoying. And of course, no e-mail back either. I think they're catching on if you ask me.

Theres alot of talk over on reddit as well. Same results as us.

why would they mail out a whole bunch of checks a month or 2 ago and then stop?...also why would they mail letters to others asking for more information?...I'm thinking that they intend to mail out the rest of the checks but the question is when

Damn that just blew up over on reddit. And some guy over there mentioned he JUST got a $29.99 check from NewEgg this week. I don't know if it's legit or not, but I'm not sure how NewEgg is even involved in any of this?

If someone really did receive a check for this from newegg that would worry me a bit.

It does worry me that a representative from newegg made the statement, that even though she provided me the serials of the GPUs by email, they "could" be wrong. I kept questioning her to make sure I understood correctly what I was being told. Maybe newegg is responsible if this happens?

Also, a rep for the lawsuit did state that claims have no "real deadline" .. call in and ask around if you still haven't filed.

We The People demand our money!

Also don't forget the old reddit post too:

Hmm, I think KCC is now just playing games. I tried calling once again and it just keeps saying "We're sorry but due to high call volumes we are able to get to your call. Please try again another time." It doesn't even let me leave a message. It's been like this all week.

For those interested, this is the DIRECT LINE to KCC Class Action Lawsuit. (866) 627-2104. You do NOT have to go through a receptionist unlike the number above. This is the direct line.
