has anyone else noticed that the "legal" team lawyers who sent the letters:

1. the MOFO guy Sussman area of legal "expertise" is Corporate / M & A ,Securities, and Venture Capital.

2. the ICARDMERRILL guy Chapnick area of "expertise" is "over twenty-six years of business and legal experience involving creative and sophisticated estate, gift and charitable tax planning, business and financial planning, mergers and acquisitions, business succession, and retirement benefit planning."

wouldn't you want someone more familiar with Internet/ publishing law? Instead of a estate tax planner and a venture capital lawyer?

sort of like using a bankruptcy lawyer in a personal injury case.
maybe i'm missing something, i knoiw a lawyer is a lawyer but i would want someone specialized in a area who has kept up and knows the laws that would apply.

I personally think they are using these "in-house" lawyers name as a bluff.

I went to MoFo.com (his law firms website) and did a little reading up on Mr. Allen Sussman. From what I can see, he has really only handled the legal side corporate finance (mergers, initial offerings, etc).

I wonder if this law firm didn't invest some money in Infinium and they are trying to protect their investment. It wouldn't make sense to send a specialist in financial law to push around a website on an alleged slander issue... unless he was already involved with the company.

(just my opinion, please don't sue me Mr. Sussman!)

Losing Redwood and stomped.com hurt big-time, but if HardOCP was to become any less a resource of Hardness, I'd have to take a long sabbatical from the internet.

I guess they must just be trying to rattle Kyle's cage... probably they won't proceed.

They have little real incentive to proceed. If they did then it would be a top story on every gaming/technology site on the web, which would, of course, encourage more people to read the story... the exact opposite of what they would LIKE to see happen.

On the other hand, if they fail to proceed now then they look rather wimpy... there's no bigger loser than a bully that can't even back up its threats. Anyway, if it comes to it, I know I'll be willing to chip in a few bucks to the [h]ard defense fund!

As for the lawyer thing, I'll bet that they just figured that they would use their "general" lawyers to send the letter... I would assume that they would have the matter directed by more specialized counsel if they actually decided to push it.

when the phantom console is released, it will have a bitboys gfx card and its first game will be duke nukem forever

if bitboys and 3drealms were to take the actions of infinium, lawyers would be busy for years

Yeah a cease and desist is just a rich persons way of making a threat. Until they actually file, it really doesn't mean anything. The two things that would come up in front of a judge in an actual lawsuit would be: was their intent on the part of the Hard to harm Infinium through defamatory statements and if so, what was the actual damage.

In all honesty though, they have to send a C&D to protect their perceived market value. It is a prudent business practice when courting investors. It is immoral, but not unethical.

I seriously doubt it will go much further than it already has.
 
Well, for one, these Phantom dudes are nothing but cheapskates, no doubt. Trying to build a company that is in itself a phantom and has no products.

I'm pretty sure that whatever "lawsuit" they have with the [H] will fail; MOST likely to happen is that the legal system (probably including Kyle's defense) will find all the craptacular fake contracts, SEC filings, and fake company documentation with the government that Infinium has, then they are gonna get sued to hells end, and maybe even get put in jail.

Bottom line:

Infinium, it's NOT WORTH IT.

BTW, where can I buy some stock in Infinium??? :confused: :rolleyes:
 
This kind of reminds me of the company that was making anti-piracy stuff for CDs for BMG when they tried to sue a Princeton student for showing that you just have to hit shift to prevent the software from loading.

The company never bothered with the case once it got down to it, but they threatened the guy.

It looks more like he has been scamming investors for quite a while... I mean this money has to come from some where.

I wonder if this article can be sent to an official in florida, someone to keep an eye on this guy, I can just see it, its all going to catch up with him.

On the main Phantom page http://www.phantom.net/ in the lower left corner you'll see Mofo's logo listed in the logo cycle presumably as a sponser or partner. Since when do law firms sponser console development?
