Remember all that crap about the Infinium's Phantom? Well, those shady bastards are thinking of suing [H]ardOCP over their supposed "misinformation" about the Phantom

In a conference call to analysts and the press, Infinium president and COO Kevin Bachus said the article was "false and defamatory," and it "painted a portrait of a company intent on swindling the public...and that is unacceptable."

According to Bachus, Infinium will begin legal action within 10 days unless HardOCP removes the article from its site. Bachus said the action is necessary for the company to maintain a "credible and direct relationship with consumers."

Phantom hasn't been the most eager company to say anything about their hardware though. Everything [H] posted was of their own research, with proof even. Even though, if nothing else, it is covered by the 1st Amendment, as far as I know.

Whats the freaking problem here?

I hope those bastards lose all their money on this baseless accusation!

They don't have any money of their own. That's why the want to sue others...it's their only way of making money. Lying about their product didn't rope in the venture capitalists, so now their on to option 2...desperation.
 
There's no way they can push this through unless they can give material evidence contradicting [H]'s article.
 
lol, they definitely came up with a great name for their console. The mere fact that they are willing to sue over this article, supports what was written by [H] staff.
 
Actually, I'm willing to bet that this is essentially a game of legal chicken. They're trying to bully [H] down cause they know that a legal battle would be costly and difficult to support.

Or else WHY would they bother giving a 10 day warning? Courtesy? HAH. They want us to give up because they probably don't have the case to support their lawsuit at all.

In fact if its so defamatory and false, why did they wait FIVE MONTHS to do anything about it? This whole thing reeks.
 
I'd tell Infinium to release the current build on the console to [H] to test to attempt to prove they aren't full of shit.

If the console at least exists, I would personally post an appology but I know there will almost never be a real console.
 
All I have to say is that those guys over at Infinium Labs are pretty damn pathetic if the only way they can think of to get money is to sue the [H]. I'm also going to have to agree with NightRaven--they can sue all they want but with no solid evidence to contradict the [H]'s article the suit will just get thrown out.

...besides, even if they do ever release their craptacular console, I'm not gonna buy it.
 
If you were me, I'd say "kill them all, and let GOD sort them out"

As a loyal [H] reader for a few years, I have to say I wholeheartdely stand behind Kyle and his response. They were given ample time to rectify the situation, and have chosen not to.
 
lol. Ladies and Gentlemen, welcome to the US. Yeah, this is the reason why so many people strive to become lawyers... pathetic attempts to sue people in order to shut them up, reap settlements, and get nasty things done legally. I'm pretty sure this lawsuit has no merit and Kyle can easily afford a half-way decent attorney and have the judge dismiss it.

I guess Inf. Lab is taking a page from SCO.
 
We will see what happens. Here is an official statement.

It is my opinion that Infinium Labs’ only interest is stifling HardOCP.com and our opinions. Hey they're just taking lessons from SCO. If it works for one group of _________ it might work for another group of ________. You have to fill in the blanks, I don;t want to get sued. :cool:

How does that apply to this? Both only protect you from governmental action. Even that has limits that are mostly sensible. If somebody says things about you that are slanderous, you can sue. Or beat the shit out of them.

but i have seen operational pictures of the phantom, its on their fourms (look for phantom pics). nothing exciting and i doubt it will come out any time soon. (they were home photos for christ sake, the other pics were 3d renders)

edit: and btw [H] is just too [H]ard for silly lawsuits. :cool:

I thought that the September article by Hardocp.com on infinium labs was awesome, that companies were in his mothers name and other crap like that I thought really gave a sense of what kind of company Infinium labs is.

--any truth to this or is it just a fabrication by Infinium to make the [H] look bad?

Wait.. wasn't the phantom at CES? You know, the only piece of electronics there that WASN'T hooked up, plugged in, or demo'ed.

I'd rather not say much more, or they might start pulling a "petswearhouse" and sue anyone who posts in the forum about their opinion of the matter for "defamation" and stuff.

vs.

computer website with large fanbase of computer customers who are hopefully going to be the one's buying said product.

tell me how this makes sense, they first say how great their non-existant product is, then when people question said non-existent product, they attack them? how lame is that?

im not tryin to be smart or support the phantom (definately because they are messing with [H] )...

those ppl at infinium shoudl talkt to some smart attorneys any good ones would advise against this, same thing as the MikeRoweSoft.com if he had talked to a laywer he would've found out that microsoft had no legal grounds and couldn've got a bigger settlement than a damn xbox

also with the article on Infinium Labs, it does seem like it doesnt even exist, as if its a scam to get our money

what i think is they just made up a company to start a money making scheme and when they get the money, they run to australia or somewhere far far away from the feds

well, I must say that I'm impressed with this forum's communitee more and more every visit I make (well... more like... while I do nothing but browse the forums) Normally what I see when a legal related thread comes up all the people who think they're lawyers come out and make fools of themselves:p


BTW, whoever it was that said they werent going to buy their non-existant console... i don't know why, but that was just histeracle to me lmao.

One more thing, I don't think that the big [H] is in any trouble at. This whole comapny is almost comical in the way that they start off their business by seuing a review site, lol.
