Phone Maker HTC Sued By Apple

Apple should just patent the word "Apple" just so they could sue everyone that has the word "Apple" on their bag of apples and advertisements...it seems fitting to what Apple is trying to make themselves out to be.

Funny how when you think they can't sink any lower...there they go again.

Oh they've tried. They've tried hard.

We can sit by and watch competitors steal our patented inventions, or we can do something about it. We've decided to do something about it," Steve Jobs, Apple's CEO, said Tuesday in a statement. "We think competition is healthy, but competitors should create their own original technology, not steal ours.

Ah hah!

AH HA HA HA HA HA HA!

God he's an asshole. Apple has stolen everything they've done since Woz left. Fuck, they even stole their name from The Beatles and then fucked them over too.

Well, I wish HTC luck with this one. I love their phones, and will buy them for as long as I can. Great hardware...

One thing everyone here needs to realize, the titles of those patents don't determine the bounds of what is covered.

What is in the claims is undoubtedly far more specific and complex than the titles seem.

Engadget already tore the patents apart. Basically, most of them are exactly what they sound. Ex: Patent #7,657,849: Unlocking a device by performing gestures on a screen.

I hope HTC win this, then have a nice word with their os makers, google and microsoft.. who then both go after apple for a load of things that they have copied over the years, As Microsoft have more money then apple, they could, if they wished then have a go at bankrupting them...

If that happened I would be committed as I would never stop laughing.

They already tried to sue New York "the big apple".

i think the courts should just kick apple out of the systems and not allow them to file for anything!

sure if you showed this to the apple zealots, they would completely side with apple!

On page 27 begins the claims section

It starts with "what is claimed is" this is where the description of exactly what claims Apple has a monopoly on. This is how the patent system works.

If something shows the requisite utility, novelty, and non-obviousness, a patent is granted. Alleged infringers will pretty much always bring a claim of invalidity, and then the court reviews the patent.

Under the law Apple has the exclusive right to produce any product fitting the description within any of the 23 claims in that patent.

That's fucked up. That patent is a month old now. I find it ironic that Apple waits a month after it is assigned to start lawsuits against other companies. It seems that Apple got that patent just to file lawsuits. Fuck Apple.

if you look at the first page, the patent was filed in 2005, it took 3 years to be issued. A lot of times it can take even longer.

Apple and Jobs are a complete joke. I don't understand how they are suing HTC when most of the patents they are referring to are on the OS level. I guess they don't have the guts to sue Google though.

Apple is a wealthy but relatively small for profit company (ab)using the law to protect its property. Google is a creepy mega-giant that aggregates and meta-connects the personal information of everybody who uses its products. In what way is Apple's aggresive litigiousness related to what Google does?

Apple has a 14 year old mistress. Nuff said!

I know how long patents take, I was just looking at the actual issue date.

So in other words, this lawsuit has been in the works for a while now... I wonder when Samsung and LG are going to get sued...

Yeah lets see - Android does the unlock one.. guess they don't want to fuck with google laywers?

Rotation of touch screen display was on tablets prior to iPhone - so dell should sue them.
Battery usage meter in a camera? Nikon and Canon can now sue them.
Automated response to sensing user activity in devices - Pretty sure this opens them up to counter suit from many companies.
XX Processor for improved comms capacity and quality? .. Right.. makes little sense to restrict advanced hardware types due to someones bs "patent"

Reducing voltage to a processor? Guess they'll have fun opening themselves to lawsuit from Intel and possibly AMD.

OO graphics UI? LOL laughable.
The last one is purely bullshit they stole this from fucking blackberry.

Seriously. Apple needs to get a good swift mega counter suit filed against them.

If there weren't so many interdependencies between large companies I could see a few of them getting together to gangbang apple in court.

Aside from the porno reference, I agree with it. Wish somehow those companies would join hands and unite

Kick some Apple ass.

Yeah, boo-fucking-hoo Apple. I hope HTC and/or Google countersue.

Just when I thought Apple couldn't get any more laughable as a company...

Revamp patent laws. ASAP. They are fucked up beyond all recognition and do nothing to speed up technological advances.

But, I guess jobs are being generated within the legal system by allowing companies like this to duke it out. Too bad it scares the little guys into not moving forward on stuff that I am sure would be creative and highly desirable by consumers.

after some interesting news articles Google recently threw it's weight behind HTC. As reading from the Washington Post this is what Google has to say: "We are not a party to this lawsuit. However, we stand behind our Android operating system and the partners who have helped us to develop it".

You need the right hardware to make multitouch work. You can't just write a software and magically make a screen multitouch capable.
Apple doesn't make hardware. Well, they don't make screens at least. HTC and Apple would buy their screens from Samsung or something.

Apple is about as much of a hardware company as Dell is. Whatever Apple is after, it's gotta be software related.

why are they suing HTC? dosent google make the software thats on the phone? thats like them suing Dell because windows 7 looks like MacOS...

or am I missing something here?

Here's what XDA-Developers have about the lawsuits. It's not all of them.

Count 1 – Patent 7,362,331 – “Time-Based, Non-Constant Translation Of User Interface Objects Between States”
Count 2 – Patent 7,479,949 – “Touch Screen Device, Method And Graphical User Interface For Determining Commands By Applying Heuristics”

Count 3 – Patent 7,657,849 – “Unlocking A Device By Performing Gestures On An Unlock Image”

Count 4 – Patent 7,469,381 – “List Scrolling And Document Translation, Scaling And Rotation On A Touch Screen Display”

Count 5 – Patent 5,920,726 – “System And Method For Managing Power Conditions Within A Digital Camera Device”

Count 6 – Patent 7,633,076 – “Automated Response To And Sensing Of User Activity In Portable Devices”

Count 7 – Patent 5,848,105 – “GMSK Signal Processors For Improved Communications Capacity And Quality”

Count 8 – Patent 7,383,453 – “Conserving Power By Reducing Voltage Supplied To An Instruction Processing Portion Of A Processor”

Count 9 – Patent 5,455,599 – “Object-Oriented Graphic System”

Count 10 – Patent 6,424,354 – “Object-Oriented Event Notification System With Listener Registration Of Both Interests And Methods”

It doesn't mean Apple cannot own patents to ideas licensed to third party hardware manufacturers.

It's probably referring to trademark names rather than actual hardware. If that's teh case, just have HTC name it something else.

They have AirPort trademarked btw.

So when is Palm getting sued?

My Palm Pre violates almost all of these "patents"

Just you wait till they get a patent for breathing air. Then you come back and talking about not violating the patent.

Blame patent law and not Apple. They're well within their rights to protect their patents. If you want to bitch about patent laws, go talk to your congressman.

...the argument here isn't weather Apple has the right to protect it's patents or not, but weather their patents are even being infringed upon. That said, I don't even see an argument - it's clear that Apple is just trying to make a buck from this bullshit. These patents that they have files are so fucking broad that I'm confident that most, if not all of these claims they're making will be overturned

+1, apple lives within a certain environment, and does what it can to get ahead within the constraints of that environment....

your precious microsoft patent trolls also, so dont go getting too cocky....
