In the case of a trademark you *MUST* sue if there is even a bit of similarity otherwise your trademark becomes invalid. Electronic Arts is basically forced to sue in this case or risk losing their grip on their own trademark.

Odd system, perhaps, but Electronic Arts isn't being "sue happy" in this case, they are just doing what they are required to do.

My personal feelings on the whole trademark issue is that it shouldn't have to pass close examination to tell if they're different so much as quick glance. If you see a 3 frame flash of the logo on TV could it possibly be confused with something else. I'd say at first glance these logos are very close thus the second is infringing
 
I watched that "commerical" for laughs. Sorry but "negative volcanic ash ions" don't make you stronger or improve your balance. Pressing down softer lowers the force applied and moving the force application point inwards makes the force you feel lower via decreased leverage. Idiots and their money are quickly parted.

While, I myself don't think they are similar enough to really sue... but I'm probably more lenient than most... but I don't see Electronic Arts losing this.

I'm for the lawsuit as well. I don't like Electronic Arts that much, but at least their products work (for the most part). The stupid plastic bracelet (sorry, silicone or what ever...) is a SCAM! Yes sir, SCAM SCAM SCAM. It sells for what? $29.99? And it probably cost them $0.30 cents to make in China. The testimonials are even worse. Talk about examples of stupidity in adults. If you want to feel refreshed or pain free or what ever, at least take something that works like Vicodin. Your judgement and reflexes might be compromissed for a while, but at least you won't feel anything, and nope, no one will throw you off balance either.
Seriously now, are those goofs from Energy Armor for real?
 
I can't blame EA for not wanting anyone to associate them with these hucksters. I can't believe they can get away with such patently false advertising,they're nothing but modern day snake oil salesmen.
 
We gotta take the lesser of the two evils guys. Atleast EA's games work. Negative Ion Bracelets? Jesus christ. I hope our EA wins.

Because the alternative is haveing a government agency like the FDA having the responsibility (power) to validate all claims of all products. It would put a tremendous amount of red tape and cost into items. Also given the power of lobbying we see in this country would allow more powerfull companies to "legally" strong arm the smaller companies.

Such proposed legislation as the FDA having to approve every single ingredient in deitary suppliments.

Its really just a question of do you want the dangers of a free society or the safety of complete control? :)
 
Personally I think that the company should be sued to protect stupid people from fraudulent products. That balance test is pure fraud. They have you balance on one leg the push down and away to tip you over... then they put the bracelet on and just push down and maybe a bit towards you. Now you seem 5x stronger or more balanced. Pure 100% BS. I hope this lawsuit drags this company into bankruptcy.

There are only so many ways to draw an "A" and I don't see a copy of one to the other here. The "E" has a similar italicized slant and that's about it. The Electronics Arts "E" has an empty spot in the letter, the other one does not. I don't see how a sane judge with two good working eyes would rule these are similar enough to justify this crap. -- I'm not defending these bracelets, they sound like a bunch of crap.

It has the letter E and A in it which is where the similarities end so you trolls. The E in Energy Armor's logo has NO BREAK IN IT like the Electronic Arts one and the A has a lightning bolt on the bottom whereas Electronic Art's has has no lightning bolt at all, anywhere and Electronic Art's A has the center line terminating in the center unlike Energy Armor's which carries down to the bottom of the A.

This is a lawsuit for the sake of a lawsuit and I hope they lose. How different does a logo have to be before it uses letters that have nothing to do with the companies name? How about making Energy Armor use a Z and a U? Would that make everyone happy?

Go ahead and side with electronic arts on this one and soon you will all be able to be sued for having initials that resemble the letters in some other companies logo.
 
The benefits of negative ions has been medically established, however Energy Armor has not demonstrated that their products actually produces such a benefit. As far as I know, the bulk of the research in this area deals with negative ions in the immediate environment, and not something which can purportedly impart negative ions by contact. Considering that Energy Armor has not pointed to any actual data, I assume the data doesn't exist (or else they would have pointed out even weakly associated studies).

It may be a BS product, but other than that, the logos aren't that similar.

Agreed... and yeah, the Energy Armor logo looks very similar and a rip-off of the Electronic Arts one. Great point on "International Beers of Munich" shortened to "IBM" as an example.

I think your theory is correct as far as the zombies go...

I know this post is about the legal issues of the name, but seriously a high school student could see how bogus the science is behind this product. I had to laugh when the presenter said that the band stores negative ion and transmits them to your body. That would mean that after a given amount of time the band band would have to disintegrate since it was slowly being transfered to your body. Anyone who buys this shit is a complete moron.

I support the software company only because the premise of other company is really lame.
