It seems more like a homage to teh guy than a rip off. Seems he sees it that way as well.

Can't artists actually be influenced anymore? Or does everything revolve around fraud suits?

Man it is just shitty to be any kind of artist these days.
 
Look closely at the clouds below the heads, they are exactly identical. But otherwise doesn't seem like a big deal.

I agree, except that lie would be less interesting. I mean, if people weren't upset about things, there would be no fun at forums, we wouldn't have fun reading things like "I'm going all thermonuclear on them..." and, of course, there would be no anonymous (there would be no lulz if people wouldn't get upset about the things they do...).
 
That reminds me of the bitching about Samsung having nearly identical packaging for their phone Haha.
 
Looks like Pitchford may fire the artist responsible for it. That kinda sucks. The cut and paste was lazy, but the artistic intent of the image was definitely an homage.

It is a complete ripoff (look at the other SW posters that he did to get the full picture). And yeah, the direct lifting of the clouds graphic is pretty lazy and sad. If it were intended to be a homage than they probably would have asked permission. Like Olly says, if they asked him he would have made them a sweet piece of art as he is a big fan.

The saddest part is that the Gearbox version is a terrible execution of Olly's design. The insert ripped off his awesome design concepts but they didn't understand how to make it work AT ALL. This is a major fail imo, and it seems Randy Pitchford isn't too happy about it either. Honestly I can't even fathom what the person who created it was thinking when they lifted the exact same cloud graphic, nevermind the rest of it looking very similar.

Olly is taking this waaaaay better than I would. But at least RP is trying to make things right from the looks of it.

I would have thought that too, but ironically I feel it is not similar enough to be an homage (it's off-center, lots of missing elements). An homage would (should?) have been much closer to the original. This is just a crappy rip-off as far as I can tell.

Plagiarism is a big deal too. Fired!

The design intent is the same, as is the point of context in both settings. It still doesn't strike me as a ripoff, though.
 
stupid kotaku... trying to add words to storm up drama, gawd that's lame.

That's all Kotaku does. It drives traffic. Honestly I stop going to Kotaku a while ago. Sometimes I get some article that pops up on my phone but I feel like I'm supporting some kind of gossip site when I read it which makes me feel like shit for doing so.
 
Nothing to see here. Stupid people trying to stir the pot. The artist doesn't even care, he just happened to notice it.
 
The proper thing to do would be to acquire a trademark on the copied (new) work and then sue the original artist. It says so in my MPAA/RIAA/Apple handbook!
 
people jump on the ripoff bandwagon too readily. Sure the style is very similar but they still did their own work and whatnot so its not like they're taking his hard work and turning a profit off it
 
Although the commenters here seem clueful, many of the idiots posting comments on Kotaku seem clueless about both copyright law and about Borderlands 2. For example, the comment: "You don't need two copies" of B2. That's the kind of stupid comment only an ignorant friendless loser living in his or her parent's basement would make. LAN games rock.

Look at the Orange on Black "clouds" on the image on the right.

Now look very closely at the Orange on White "clouds" on the scarf on the image to the left.

The clouds are tilted a little in the second one, but otherwise they are precisely the same.

That isn't homage, that is direct copy.

Whether it is a big deal is up to the parties involved though, not the rest of us.
 
Eh, they both look heavily influenced by some Apocalypse Now movie posters I've seen.
 
The problem was that someone clearly ripped the cloud design and put it into Gearbox's manual. The artist in question was just bummed out about it. Gearbox's CEO (who's a fan of the artist) sent an apology and is incontact with him because I'm sure they dont condone blatantly ripping off artists.

It's one thing to borrow designs or pay homage, it's another to simply lift designs and that was the problem, and it looks like it's been resolved.
 
Without naming names, game developer X under publisher Y used a resource from another company in rather popular game Z, just a tiny little thing that only sharp eyes notices, but if anybody above the responsible texture artist in position got to know of it and reported it he would be screwed, have his desk emptied, get escorted out by armed guards and most likely left without any pay and a bad reputation, because that's how serious it is, that stuff can lead to major damage, even a negative hit on the stock-market which is the worst thing these days.

..so if you ever get to work on any kind of art for a game be it a texture, a font or a cover - take inspiration, don't 100% rip something. Get contracts and licenses to use existing imagery, even part of it.

/wordy words of caution

..and the Borderlands artsy person who ripped this should be punished, yes, because that's fucking amateurish and ugly to do that :(

No, you suck at general image recognition. :p The crisscross "river" formed between the clouds is not similar, its an exact copy+pasta meaning they stole elements of his art rather than mere inspiration.
