Uh oh, this can’t be good. People are getting refunds because Sony removed the “install other OS” feature? If this is true, I predict a flood of refund requests.

The key statement is “which was made known to the seller at the time of purchase,” where Sony made it known at the time of purchase that you would be able to install an ‘Other OS.’ This was raised with Amazon, and their policy was to offer a partial refund whether that feature had been used by said consumer or not. It should be noted that in European law responsibility is placed on the retailer and not the manufacturer.

Good. Sony should get raped over this, for removing a feature they originally used to sell the system.

I highly doubt any large retailers will cease to carry Sony products over this. It does suck for the retailers, they are seemingly getting caught in the middle and held responsible for Sony's decision.

still got my receipt from game, so I've sent of an email highlighting the Amazon case, and citing both laws which can be applied.

Hopefully something happens.

Don't you think those big retailers wont do anything if this explode? Retailers will sue Sony...

Yeah this is going to bite Sony in the ass I think. Just don't know how bad it will hurt them if it hurts them at all.

Well, it's a rather upstanding thing for them to do, but I don't understand why they would remove this feature to begin with? Does anyone have any reasonable reason for it?

If I didn't have a full backwards compatible PS3 I would be all over that refund and get myself a slim. But since I have a 1st gen PS3, I'll stick with it.

Because a vast majority of console gamers install Linux on their console game unit, right?

Retailers will not care. Sony's doing the refunding. Retailers are still profiting from merchandise sales.

Err.. Thinking slower than I'm typing this morning. Sony would be refunding the retailers is what I meant to say.

You can bet retailers are going to demand reimbursement from Sony for lost profit.

yeah, that seems pretty rediculous to hold the retailer responsible... however, I'm sure they'll be going after Sony for their losses anyway so whatever.

I have no sympathy for Sony in any of this. I wonder if they'll cave and add the feature back in, or just deal with the refunds.

As NickJames noted above, the backwards compatibility of PS2 games was also used to sell the PS3 initially and that "feature" was partially then completely dropped a while ago. This isn't new territory for Sony.

I wonder if they would every consider adding the OS option back?

I find it extremely funny how some of the hardcore PS3 zealots are ditching the PS3 purely over this issue and actually going over to the "dark side" and buying a Xbox 360, something that would normally never happen unless a certain place down below got frigid... Microsoft makes out like a bandito LOL.

Even funnier is when most of them would never install another OS on their PS3.

Doesn't matter if it was one person OR 1million people. Simple fact is the product that was sold essentially got downgraded

America has laws against this (bait & switch) its just the EU ones are a bit more consumer orientated

Wow, why the hell would retailers be responsible? That is ridiculous...
because the sale contract was between the consumer and the retailer Not between the consumer and sony

I agree that bait and switching is wrong, but come on, who installs Linux on their consoles besides you and a tiny handful of tech savvy people who would already know that there's another way around the block?

Those who demand refunds are just whiny fanboys who put ideals before common sense. What other console allowed you to install Linux? Almost none. How many get hacked anyways by those who cares enough to put Linux on them? Almost all of them.

Retailers use 1 day to get my product they send it to wherever it is(less shipping for me!) no proforma to be filled, no international sending!

ITS GREAT! with rules like it

And beside, if i buy a product with 3 month warranty, or without warranty, i get 3 years on all electrical stuff.
Phones got 5 years same with amps, and all stuff meant to live for a while (phones isnt, thats why they improved the warranty) 3 times repair = new phone.

How much better can it get ? :D

Bait and switch tactic is right.

The whole plan was that once the PS4 (next gen) is released, our old PS3 hardware couple have linux loaded on it and could do different interesting things with it once no longer needed as primary gaming console.

With such a law, maybe not so bad. Get fully refunded for PS3 to go toward PS4 purchase price. Might not be such a bad thing. Maybe these people should be thanking Sony ;-)

I do wonder if this will push Sony to re-implement the alternative OS feature.

If they do, for god sake sony, plan videocard vendor and specs more wisely, nvidia didnt have hdr support+aa at the same time, a bum for ps3, but the memory is also a mission for devs and the linux too!
That the ONLY things thats bad with ps3.

i dont understand why theres so much outrage over removal of this feature.

I mean i dont remember seeing nearly as much out rage when the US essentially removed the ability to watch over-the-air TV on analog TVs. People didnt go demanding refunds for their TVs during the switch over

and how about microsoft's removal of online support for original xbox titles on live such as halo?

and how about the removal of online of older EA sports games?

Because it was an advertised feature that Sony is removing after having sold it to millions of people.

Bad example - the US govt paid for converter boxes so you could continue to use your old analog TV.

and how about microsoft's removal of online support for original xbox titles on live such as halo?

Bit different. MS is no longer providing an optional, paid service. MS didn't remove a feature of the console.

and how about the removal of online of older EA sports games?

I'm not familiar with what you are referring to..?

also regarding the converters, thats a 3rd party solution.
with the ps3, theres that 3rd party firmware that puts it back.

almost the same sort of situation, only difference i guess is that the digital switch was government mandated.

/facepalm

No, no, no.

The "hacked" firmware isn't a "3rd party solution".

The digital switch was covered by the U.S. government. You are confusing so much here, it's freakin hurting my brain.

TV is a service. When you buy a TV, shows don't magically appear in the box. The hardware links you to a service. Your TV still works even with the move to digital: the service has changed.

The other OS isn't a service, it's a component built in the hardware and marketed as a feature. Imagine if your DVD player was sold with Divx playback, but then divx playback was removed once you brought it home.

And this whole "small portion use it, so what's the big deal" is
1) selfish
2) same reasoning behind discrimination of all kinds (if it ain't me, why do I care)

Even if 1% of the playstation 3 user base uses Other OS, that's still around 23,000 people out of a feature they paid for. Sure, 23,000 out of millions isn't a lot (until you're one of them), but saying this isn't a big deal is basically giving ever one of those 23,000 people the big F you.

No. First, the converters were PAID FOR by the US govt. Sony isn't paying me for the feature they removed.

Second, the hacked firmware is just that - a HACK. It is not a "3rd party firmware" - it is a hack. A hack Sony is going to try and prevent. A hack that voids the warranty.

They aren't removing features, they are stopping services. Very different.

This goes to show how truely f-ed up EU laws are. They don't hold the responsible party responsible.
IF you haven't worked in the electronics retail industry then you don't know how truely difficult it is to get sony to RMA something or issue a refund or credit. When I was at CrapUSA there was a stack of Sony laptops that we couldn't send back. We had them for over 2 years before we finally got a manager smart enough to say F-it and discounted them and sold them to the public at a huge loss.

It isn't a good law. Sony should be the company that gets punished, not the retailer.

The retailer get the money back from Sony. The retailer in not being punish in any way. *IF* the retailer refused to give the refund then they would be punished.

Likewise if sony fails to refund the retailer the retailer can take them to court.

please keep up

Retailer still has to waste its time (and money) acting as a middle man. A middle man that has no control over the product. It sounds like there should really be two laws. One that targets the manufacturer if they remove a manufacturer advertised feature and one that targets a retailer if the retailer advertises a feature that the manufacturer doesn't.

Taking a Law class is nice I recommend it to everyone, hell it should be included in high school curriculum but its not. Probably the most important class I took in my MBA.

Sony likely found a way to pirate games using a different OS so they where forced to remove the feature.

But for the consumer it is far easier to sue to place you bought it. Sometimes you don't even know to manufacture of the product and only know where you bought it.

Like if you bought a toy truck at Toy-R-Us and the truck was made with lead paint in some factory in china trying to sue the company is china would be damn hard but suing Toy-R-Us is super easy. Then it is up to Toys-R-us to sue the company that sold them the toy.

It puts responsibility on vendors to not sell crap....Its one of the better parts of our legal system.

Consumer laws in the Uk and the eu as a whole are great, ok fair enough it is sony's problem, but the consumer didnt buy the console from sony, they bought it from a retailer thus the retailer must then claim the cash back from sony.

Uk consumer laws are a great thing, especially when you end up getting shafted and are in need of them.

Lets be realistic here. Anyone who actually attempts to get a refund is probably still living in their mother's basement. All the internet "laywers" are going to come out and cite laws to retailers....give me a break. If I had to guess I would say less than 3% of PS3 owners have used this feature for any length of time.

For as long as the PS3 has been out, no one has really tapped into the Other OS feature to make something amazing. Sure you can install Linux on it but big whoop. Beyond the novelty there is not much useful functionality. Correct me if I am wrong but it is not like someone has created a linux ps3 distro that will make a mean folding machine or anything like that.

I could understand if there is a larger community that actually used it but from everything I have seen, very few people use it....I can count them on one hand.

Also the OtherOS thing was partly done so the PS3 could be retailed as a computer as oppose to a gaming system (and thus could benefit from reduced tax)

#1 We have known for a long time now that the slim would not have Other OS.

#2 Commercial applications that are still using older PS3 versions will just not update their firmware. Is it really that difficult? I mean I guess the military needs to connect to PSN?

Or looking for a free handout.

Hell, remember the whole hot coffee fiasco from a few years back? Rockstar JUST paid everyone that jumped on that class action lawsuit.

I'm willing to bet that a LARGE majority of those people didn't give a rats ass about the content, but were looking for free $$$. I recall reading gaming forums when that happened where 'members' were telling other people to hop on board, if they purchased the game, so they could get a piece of the pie (and a lot did)

the same will happen here.

Don't be such an asshole. I use the "Other OS" option on my PS3, and I have my own place.

It is also completely, 100% irrelevant if very few people use the feature. The feature was advertised, Sony is now removing it. That cannot be condoned. Personally I think everyone should jump on the sue Sony bandwagon over this if for no other reason than to send a message that we, as consumers, won't put up with this shit - even if they had never used the Other OS option nor had any desire to.
