This is like Housewife's of New Jersey for Geeks. Newegg is taking care of it who freaking cares what the lawyers are doing in the background.

All I know is "Newegg continues to lie to its customers" are strong words.

And because they are strong words, does it make them wrong words too?
 
It is clear to me that this was blown way out of proportion before anyone knew what was going on.
"NewEgg is lying"
"NewEgg bought grey market goods"
"I saw the pictures..."

There is so much BS flying around.
All the pictures that I've seen have been OPENED BOXES! That means everyone who spotted the fakes had to do what? Open the boxes? Maybe install them in a computer? Do you want NewEgg or anyone else to sell only pre-opened boxes? Come on!

And I like the term "grey market goods". That's meant to imply that NewEgg buys from shady characters, and only now got caught. Pretty much assumes that some rogue employee didn't sit there and substitute fakes, and make off with the real thing. But hey I guess everybody on these forums has already done a full investigation, so we don't need to give NewEgg and law enforcement a chance to sort things out.

Then there are the, "NewEgg is lying" comments. Huh? I don't need to define a lie. If you're going off of the information you have it isn't a lie. There are statements that NewEgg themselves refered to it as both a Demo and Counterfit, but it actually takes a person to lie. Companies can't talk. So which person lied? Do you all really know what they knew at the time? Perhaps you heard from a misinformed person...

How about just letting it all play out, and reserve judgement until then. Kyle reported something happened. Great! All conspiracy theories are only theories until it all plays out.

The big news is that I think this proves that you geeks all have a serious caffeine problem, but I guess I knew that afterall. :D

If you read the text from the C&D orders, they basically say "we weren't involved with any of this, so cease and desist from wrongly spreading our name."


In the corporate world, when you need to "just tell the truth and explain everything" you use your lawyers.

It actually makes sense now... D and H sent out C and D letters because D and H wasn't the supplier.

I agree with Derangel...why in the hell didn't D&H just put out a damn press release saying the parts in question didn't come from them? For my part, if D&H indeed was not involved in this, I apologize for bashing them and speculating about their intentions.

Up to that point, all of us could only guess if newegg were told the chips were demo chips or did they decided that themself.

I'm glad newegg has revealed everything. As I mention earlier, its more likely that it was an honest mistake as its doubtful that newegg would intentionally do illegal dealings. Just wish that they mentioned from the beginning that they were invesitgating the issues, then I'm sure people wouldn't be accusing them of trying to decieve the customers.

Perhaps in the future, they should state something like, "we're informed by our supplier XYZ that they have mistakenly ship us so and so units". That way, people would know that newegg are merely the messenger here. Maybe they trusted that supplier too much:p

Unfortunately, if Newegg had pinned the blame on IPEX (or D&H, or whoever it would've been) before their investigation was complete and all of their legal ducks were in a row, Newegg could've been on the hook for a metric s**t-ton of civil damages from a libel suit (among other things). That's why the name of the "long-term supplier" was conspicuously missing from Newegg's Friday press release...they didn't have enough legal proof.

Clearly if D&H wasn't involved then I would say I was sorry for implicating them in this mess. However, I never claimed that D&H was was involved, therefore I don't owe them an apology, but Newegg does. This just gets better and better. I said this earlier and what a lot of people don't understand. If you are digging a hole that is getting deeper, STOP FUCKING DIGGING!!! D&H had every opportunity to say, "Hey, we weren't the supplier, so please stop saying we are." but they didn't, know why? Because they really didn't know if they were or weren't so they took a pre-emptive strike against Kyle as a hedge against it. It doesn't hurt them to send out their lawyers with a C&D, it's a win-win for them. See how that works?

Newegg has an even bigger problem on their hands. They implicated Intel and D&H. Both are not saying it wasn't them. Oh boy, let's watch the spin machine in action.

Distinction alert!!! The distinction is, is that Newegg sold these parts to a customer from their supplier without checking it. They just proved that fact. They implicated D&H in their press release because they were told it was D&H. Kyle simply reported it, he sold nothing to anyone now did he? See the distinction? Context matters. All Newegg had to do was say, "We understand there is a problem but we will not comment on it until all of our facts from our investigation are done, then we will present the facts as we know them to be true, to you our valued customers. Please don't come to any conclusions until we give you the straight facts for good or for ill. If it's our fault we will own up to it no questions asked, but we will fix it one way or the other."

See how simple that is?

D&H issued a cease and desist for good reason. D&H doesn't need to coddle people. If you screw with it's reputation they are allowed to go after you for $$ - after they issue a C&D and you don't comply.

They made an official statement to Gizmondo stating it was IPEX. Their press release only said it was a supplier, they didn't specifically say D&H. Kyle said D&H based on information he got from other, unnamed, sources. Newegg would have been stupid to name D&H in an official statement before they had finished their investigation.

Do you want your packages to be opened and inspected before they are sent to you? Especially a CPU? I highly doubt it. I'd be pissed to receive a retail box anything that had been opened.
