Why no driver level AO?

So I'm not understanding why nVidia cards can have driver level AO for games like skyrim (as well as framerate increases) but ATI cannot. It's not like the cards arent capable of it.
 
Ah, so I guess my next question would be...what's the nVidia equivalent of an HD6950

Don't buy yet! Kepler is literally like a week away. If you are going Nvidia wait for Kepler.
