If you are a teenager thinking about sending “teh nekkid pixtorz” to your girlfriend via e-mail or cell phone you should probably think twice about that. Jail time and being registered as a sex offender for the next 25 years would kinda suck.

He took revenge with an electronic blast — e-mailing the photos of the 16-year-old girl to more than 70 people, including her parents, grandparents and teachers. Three days later, Alpert, then 18, was charged with transmitting child pornography.

Every Wednesday he attends a class for sex offenders where he is joined by people who have raped and molested children. He's not like them, Alpert said, but the law says he is.
This is just making it worse.

That's pretty ridiculous. But he was also stupid enough to e-mail it to everyone including her grandparents.

I totally laughed when the article said he e-mailed a nudie picture SHE sent HIM...classic...then I read the 5 years probation, child porn and 25 years as a sex-offender status...and I wasn't laughing any more.

that is why I pass these kinds things on to you guys.

WTF did he have her grandparents' cell numbers?! Or even her parents for that matter?

Kid kinda deserves what he gets. I can't believe he was so stupid/revengeful or whatever to do that. Being 18, he should have known better and should have known the laws especially with 16's.

agreed...he should have at least done it from an anonymous computer or something and had some deniability ;)

If he is 18 and she is 16, any sexual activity they would have had would have been statuatory.

Actually some of you need to do a little research before commenting. Age of consent in many states is NOT 18. In fact, some states dive all the way down to 14 but it is still prosecutable even then if the is a complaint filed by the parents.

So to sum it all up, it is not statutory if it is consentual.

Granted what the kid did was dumb for sending it to everyone. I know this as there was a kid living in my neighborhood that was stuck in the same situation. Albeit, we are in the south, he was black and she was white and the girl's parents were racists and called it in to the cops after they broke up.

Yet another case of children/teens doing something that they "didn't know was wrong" then bitching about it when they get in trouble.

Yes it sucks that he is going to be punished like that, but by law he was distrubuting child porn. It doesn't matter what the reason was. Kids need to learn that posting nude pictures of yourself or boy/girl friend online, or sending them via a cell phone can get you into a lot of hot water and maybe even labeled as a sex offender. Same goes for the 20 year olds dating the 14 year olds.

Yeah, like being marked for life with a virtual scarlet letter is really the most constructive way of dealing with something like this. Yeah, that'll teach him to not do something like this in the future! (Considering that being on the sex offender registry pretty much guarantees no appreciable future.)

He was over 18, she was not. This is far different than the last outrageous case (minor charged as an adult for pics of his girl, who was also under age).

Agreed... I don't understand punishing an 18 year old for 25 years over a mistake like this. Of course he shouldn't have sent the pictures out, but that's what emotional people (teens) do, make stupid mistakes. Did he endanger someone's life?
Seriously, did he really need to be kicked out of college over this? The sentence has pretty much destroyed his life, so now he lost that money and will have to hope he can find some courses online...then hope and pray he can find an employer who can look past the bullshit.

It can still be statutory even if it was consensual. Like you said, the parents, family, or even the public can complain and it all of a sudden becomes a statutory issue, as it is now.

Also, I don't see the point in your last argument. Is the parents racist simply because he was black or is the parents racist because he just happened to be black and they would have never had an issue about a guy banging their underage girl if he was white? What if the color was reversed? I'm sorry, but I grew up with this whole racist bullshit.

What about the victim who's pictures has been distributed to all friends and family. Of course, certainly she will be able to enjoy a regular life and would have no problems or comfortably issues meeting friends and family.

Think about the victim, not the vengeful idiot.

Define endanger? As in, did he destroy another persons social and family life? or did it cause death or the potential of death?

So lets just say he blackmailed, extorted, or threatened someone, or perhaps stole something... should he be let go off the hook because he did not endanger anyone's life? Or should he pay the time for the crime? Think about it. He stole the pictures (wasn't given permission), most likely extorted and used blackmail on those pictures, and he participated in a pretty serious offense.

I know a lot of you don't agree with me, but I usually side with the victim, not the prick trying to destroy lives of those who are innocent at the time of the crime (note the "innocent at the time of the crime").

People aren't thinking of the victim so much in this case because the punishment for the offender is so out-of-line with reality. Really, do you think that one day before your magical 18th birthday you really are just a clueless dolt but the very next day you suddenly reach emotional maturity?

We aren't discussing the victim, we are discussing whether the punishment is warranted. Will it help prevent this kind of thing in the future? Fuck no it won't. Has it somehow prevented the criminal from continuing to commit crimes? Well, yes it probably has. Was it insanely overboard? Would a much smaller punishment have taught this barely-a-man the same lessons?

And if the girl sent a naked picture of herself to an 18 year old then isn't she guilty of distributing child pornography of herself? Or does that not apply to girls?

While the guy should get in trouble, it's the bitches fault for sending out the pictures. He did not force her to do it. I suppose if she uploaded her underage nude picture to a website that the website owner would get in trouble and/or sued. You might want to watch out, Steve. ;)

He stole the pictures (wasn't given permission)...
sun-sentinel.com said:
After his former girlfriend taunted him, Phillip Alpert remembered the nude photos she e-mailed to him while they were dating.
He didn't steal anything. The pictures were sent to him.

...most likely extorted and used blackmail on those pictures...
There's no mention of that in the article. This was basically post-breakup rage.

...and he participated in a pretty serious offense.
No, he didn't.

Using and distribution of content without the prior permission or intent is stealing.

Post breakup rage with nude pix usually involves some form of blackmail. People don't just go and send pictures to everyone known to them because they are no longer in love.

No, he didn't.

Really? I didn't know that sending CP content out is not serious offense? lol :p

this is just complete BS, its just like if a young girl decides to get a older boy into trouble all she has to do is go to the police station and say he raped her and then he will go to jail and be labeled as a sex offender even if he didn't do it.

There has to be proof to that charge. There doesn't have to be much proof, just enough such as previous engagements with each other.

While I agree with you that those laws and punishments are bullshit, keep in mind that this guy did so intentionally.... and was not blind sided as your example.

Do you work for the RIAA? Distributing content, without permission admittedly, is at worst piracy. There's no "stealing" involved whatsoever.

Is this your first time reading a jilted lover story? These kinds of things happen ALL THE TIME.

Really? I didn't know that sending CP content out is not serious offense? lol :p
Then shouldn't the girl be getting charged?

Hahaha asshole kid had it coming

First this chick sends him a nude pic but no he isn't happy and texts it to 70 people? That's fucked up

I was going to type another reply but this basically sums it up.

The court really needs to take consideration before labeling people as sex offenders. Those laws were made for the purpose of keeping dangerous people away from young ones. Instead, it's being used to destroy peoples lifes for mistakes they make. Give him the 5 years probation or whatever, but don't label him as a sex offender. That's BS.

I know it hasn't been mentioned, and while legally I doubt it makes a difference, but I couldn't help but notice that the article leaves it ambiguous as to how old she was when the pictures of herself were taken by herself.

They were taken at some point in the last 2.5 years... She is 16... So, she might have been 16 in the pics... or 15... or 14... Or even 13?

If I was 18 and had pictures of someone possibly that young, I'd delete them and then WIPE THAT HARD DRIVE SPACE.

People are calling these harsh, but this story is a terrible example to try and show how laws are incorrectly prosecuting.

An 18-yr-old ADULT potentially doing this to a 13-yr-old (at the time) has some serious issues when they broadcast their stupidity to, what was it, 70 people?

You put together a list of 70 people, and I'm sure there's gotta be someone on that list that if you send them something like that, regardless of who they are, they absolutely have to report it as child porn distribution. Failure of some (if not all) of those other adults to not report it to authorities could probably land them in hot water themselves.

WAIT: he sent it to teachers. They have no option but to report it...

But this story was absolutely not an example of "sexting" teenagers, and the guy probably could use some more time behind bars if he really doesn't understand what he did...

Ugh... I still can't believe he sent this to his or her teachers... If they don't report it, they themselves are fired... He might as well have sent it the cops directly! Why is he trying to damage so many others around him because she (obviously rightfully so) doesn't like the guy...

Not sure if time served, five years probation and 25 years registered is enough...

While I have been in screwed up relationships, this is something I would have never done. When I was 18 I dated someone two years younger than me, however, I had enough brains to realize that any nudity or anything of that nature = potential problems. I guess I had enough brains to realize that even at the age of 18 at that time that there is consequences for your actions.

Then shouldn't the girl be getting charged?

She should as the law requires. But keep in mind of what I said earlier "innocent at the time of the crime". She should be tried separate from this case and the ex-BF should be tried for carrying these photos.

Basically what you are doing is you are ticketing the drunk who crossed the road and was ran over, rather than the driver who was speeding and fled the scene. While the drunk was intoxicated and breaks the law, the driver had no right to do what he did and committed a much more serious crime.

What about the victims lives they destroy? Are they only worth probation? I can bet $100 that if your pictures were distributed across the world, you will want some justice... probation is not going to be enough justice for you. If you want a punishment that fits the crime, how about putting this punk to work for some serious community service and post his pictures up on the web for the world to laugh at.

You make some killer points.

Too many kids these days are self centered, irresponsible, and totally lacking any empathy or concern for others.Either they aren't being taught right from wrong,or just don't give a damn.Someone has to get tough with them,or the future is bleak. The punk got what he deserved.

Amazing to me that there are some here who are *defending* him. He's not in poke-me-in-the-ass prison folks, jeesh. I think 5 yrs probation was very fair, seeing as how others are actually in jail for similar offenses. I think the 25 yrs registered as a sex offender should serve as a message to the dumbass.

I'm not saying that there shouldn't be consequences for what he did. But being labeled a sex offender for 25 years? It may be the appropriate sentence for the jurisdiction the crime was committed in, it just seems misapplied given the circumstances of the case.

She should as the law requires. But keep in mind of what I said earlier "innocent at the time of the crime". She should be tried separate from this case and the ex-BF should be tried for carrying these photos.
She was only "innocent" because the other person in possession of the photos had not notified the authorities of their existence. I'm guilty of not obeying the speed limit every single time I drive, but I'm not about to tell the cops that.

Just cause I've been to busy with work to pkay with you, Ockie lately, here's one for old times sake.

Using and distribution of content without the prior permission or intent is stealing.
First sale doctorin could be applied here depending on how he first got them. If she though "Oh, I'll send my boyfriend a treat" and sent them to him without him asking, then you could apply the first sale doctrin as an unsolisited recite and they would become his property to do as he sees fit.

Most post breakup rage I've seen has nothing to do with blackmail, they are just out to emotionally hurt the other person.

Really? I didn't know that sending CP content out is not serious offense? lol :p
CP is a very serious offense. However, there is a lot of grey area involved with 2 people within 2 years of each other in age and frankly involved in private matters. I'm curious are they going to charge her for CP like they did that other girl? Or have they finally figured out you can't be the child victim and an adult perp at the same time.

Uhg, Ockie always playing devil's advocate. Except that he really believes what he says.

Ok, so the "law it the law...do the crime do the time" nonsense. So what if the for distribution of child pornography was punishable by death? I'm sure many people here wouldnt mind the idea of a few pedophiles being given the needle, or even better, a 21 gun salute. So, thanks to our wonderful judicial system, this kid qualified for such punishment. Do you continue to stand on the side lines and say "well technically he DID commit the crime, execute him!" ????????????

What we are trying to say here is that the line needs to be redrawn. Trust me, this girl is going to be fine, her life is not over as a result of these photo's, she will GET OVER IT. Her suffering is too far disproportionate to his. This is no better than claiming wal-mart is a victim if I steal a shirt from the clothing isle, therefore I should have my hands cut off as punishment. Think of the victim!!!

Do you people understand what marking an 18 year old as a sex offender for 25 years (longer than he has even been alive) will do to his future? I have a single many, many, many year old charge for possession of marijuana paraphernalia. I have had this charge expunged from my record (legally removed). But, you know what happens when I apply for the wonderful job I have now in one of the 5 biggest companies in the world? They find out anyway, even though my record was "expunged" and they want an explanation.

Now when you are talking about 15 year-old paraphernalia charge that's easy to get by. What if you are talking about a 15 year running currently-in-affect REGISTERED SEX OFFENDER? For being barely more than a child and acting just like a child. That is fucked up.

And you think that after those 25 years of being a REGISTERED sex offender that somehow this kid's record will be magically wiped clean? Fuck no it will not and he will then be discriminated against. But we live in America, where we want to hurt and punish people, not help them reach the potential they have.

I think it's about time people learned there are consequences for actions. He did something stupid and illegal, therefore he gets the punishment. There's a very easy way to avoid getting your future ruined: Behave.
