I have

GIGABYTE GA-P35-DS3R (F6 BIOS)
E6750 w/ Scythe Infinity HSF
2x1GB Crucial Ballastix (MicronD9GMH)
8800GTS 320MB Superclocked
CorsairHX 520W
Vista Ultimate

I am orthos stable (15 hours) @ 413x8 = 3.3 GHz
RAM @ 1:1 4-4-4-12 413 MHz - 2T - 1.8 VDimm memtest86 stable

I have tested the RAM up to 500 mhz 4-4-4-12 with increased VDimm
CPU Vcore is 1.36 in BIOS as opposed to 1.35 stock

Load is around 35-40C according to core temp 0.95.4 (everest/intel tat/speedfan show like 15c load.......) all i know is in BIOS in pc health cpu temp is always around 15-23C and one time 5c when it was cold.

Even @ 3.4 GHz orthos fails after 10-15 min even with 1.4 Vcore

the ram is tested stable so I assume it's something to do with chipset voltages? What should I increase? I have done up to 500fsb without any voltage changed but have not tried higher than 500fsb. I know I should be able to get higher stable clocks right.

I have cpu-z valid 3.6 but not stable

and is there a 1T/2T settings in BIOS for RAM? ( I am pressing CTRL+F1)

E6750 batch is L726A845 and google shows no results for it......

You can play with the FSB voltage but I have not seen it ever reported to do much to help with CPU overclock. You should have the MCH set at +.1V for stability anyway. If you memory tested ok (I assume several passes of memtest) at 500+ MHz increasing the MCH any more would just result in unwanted heat. No point in increasing voltage to the Memory Controller Hub if memory is not your issue.

Maybe you can or maybe thats it for that cpu. Lossen the timings to 5 5 5 15 and try a Vcore of 1.425 volts and try 3.4 again and try raising the FSB voltage a notch at a time for the 3 next values available over stock default. , if it wont do it, it wont do it.

No not on this board, in general Intel chipsets do not run 1T. There are a few boards that try to use 1T at just certain memory mulitplier settings, but not Gigabytes or 98% of other Intel boards.
