Got my self in a small predicament with some Seagate drives and Newegg; hopefully the Hard Forum community can provide some advice. I'm not sure if this is the right section so please move as needed.

Here is the short version of the story:

I bought three Seagate LP 2TB drives from Newegg last week. The drives were listed as Open Box return OEM drives. What I received are Seagate Certifed Repaired HDD's. Sounds like Bait and Switch to me. Another person in my Office bought the same drives and received the same items (bought OEM, received Certified Repaired).

The drives were cheap enough, but they are supposed to be open box new items, not recertified. I emailed newegg and all they want to do is a refund. I want Newegg to ship me what I ordered.

I also checked the warranty of the drives. Newegg lists the warranty as three years (for OEM drives). I couldn't find a definative answer from Seagate (for Certifed Repaired). Seagate's warranty system does list the warranty expiring in July 2012, in two years.

Should I accept the refund and send the drives back? Do I return them and buy a different brand, potentially from somewhere else?

1) Accept refund
2) Send drives back
3) Don't buy open box hard drives

I was the other person in the office and my drives are the same. The difference is that my email inquiry has not been answered yet. How I miss the old NewEgg. Did I need to mention the terrible packaging? There are hundreds of posts on this issue going way back but seriously 4-27-2010 and Newegg CA wherehouse still ships with no real padding with a single layer of bubble wrap in a box of packing peanuts.

drop them on the floor a couple of times, and then send them back

4) Don't buy from a bait n switch seller anymore

Well I don't buy open-box hardware from Newegg after hearing somewhat consistent complaints from people about their experiences. They've been great other than that (and their notorious price "adjustments" of popular items).

Personally I prefer to buy from Amazon; granted their "frustration-free" packaging for hard drives is a bit underwhelming but they sent me a properly packed replacement shipped next day after I submitted a RMA. Non-frustrationfree packaging has been steller from amazon

Do the drives work? Do they have any kind of warranty? Who cares what they are.

If I paid $100 for new drives and got recerts that should cost $80. I would pissed if they warranty a worked.

He didnt get what he paid for....end of story.

Open-Box is a used part. Why would someone return a good, new hard drive?

These drives are new drives that the customer installed and returned as DOA. NewEgg sends them back to Seagate who probably replaces the controller PCB, maybe sprays some WD-40 on it ;), whatever and returns to NewEgg to resell.

Open-Box does not mean just as good as new but cheaper.

Seriously? They have a word for hardware that's been repaired, and it ain't open-box.

I know I am taking a chance with Open box, but expect open box and not Certified Repaired. I tested one drive (not so glowing reviews on Newegg for the full price OEM), it tested fine.

The warranty is short by a year and I can't figure out if the warranty should be three years from date of purchase or not.

i don't think they're "bait-and-switch"ing you, i think they just have a broader definition of "Open Box Item" than you (and other e-tailers) do.

did you happen to read their definition of "Open Box".?

What is an Open Box item?

Open Box items have been opened and touched and/or returned. Because they originate from different situations, they may or may not include accessories, documentation or retail packaging. Refurbishment is done by the manufacturer. Open Box products are warranted for only 30 days. We recommend that you try out your Open Box product immediately after receiving it.

you should probably also read their "Open Box" return policy while you're at it.

Open Box Refund Only Return Policy

* Return for refund within: 30 days
* Return for replacement within: non-replaceable

Products that state "This item is covered by Newegg.com's Refund Only 30-Day Return Policy", or items labeled as “Non-Replaceable” (or similar labeling) must be returned to Newegg within 30 days of the invoice date for this policy to apply. Products covered by this return policy may only be returned for a refund. “Return” constitutes receipt of the product by Newegg, and not the mere issuance of an RMA.

This is our Detailed Open Box Item Return Policy. Newegg often sells items that are listed as "open-box." Because these items are sold at greatly reduced prices, they are subject to a limited refund-only return policy. Such items can only be returned within 30 days of the applicable invoice date. “Return” constitutes receipt of the product by Newegg, and not the mere issuance of an RMA. Newegg cannot provide replacement service for these items, as their stock is limited. The entire risk as to the quality and performance of these items is with the buyer. These items have been tested for functionality, but may have superficial physical defects including, but not limited to, scratches, dings or dents. Should these items exhibit a functional defect following their purchase, the buyer (not the manufacturer, distributor, or Newegg) assumes the entire cost of all necessary servicing or repairs, unless otherwise required by law. These items are not covered by any 30-day satisfaction guarantee.

If you purchase an Open-Box product Newegg guarantees only that you will receive the product itself; accessories MAY OR MAY NOT BE INCLUDED with Open-Box products. Newegg will not send you a missing accessory, even if the missing accessory is required in order to properly make use of all the product’s advertised functions.

this is why you need to read this stuff BEFORE you place an order....don't assume anything, get confirmation.

thanks for digging though Neweggs site looking for their definition. Too bad they don't tell you that when you agree to their disclaimer, copied below, before they let you buy Open box items. Newegg also has a sepeate section of Recertified items, and they use it. So why would they list these drives as open box OEM instead of Recertitied if in fact the items are recertitifed? Sounds like an automated Bait and Switch to me.

I either case, I'm sending the drives back, unless someone wants to buy them from me. The $20 savings isn't worth the two year warranty or Newegg's bait and switch. I long for the newegg of old

DISCLAIMER

Your order contains an Open Box product(s). Please read the following before you proceed:

Open Box merchandise are products that have been purchased and delivered to other customers, and then returned to Newegg. Open Box products are sold considerably under cost. Newegg provides a 30-Day Refund-Only Return Policy for Open Box products.

Newegg tests Open Box products for basic functionality only.
Due to the varying quality of products returned to Newegg, YOU ARE TAKING A RISK BUYING OPEN BOX PRODUCTS.
Newegg makes every attempt to supply the original accessories for Open Box products. However, regardless of what the product description says, Newegg only guarantees that you will receive the product itself; accessories may or may not be included. Bear in mind that your open box product may not contain cables, adaptors, manuals, CDs, drivers, fans, etc.

Newegg will not send you any missing accessory, even if the accessory is required in order to properly make use of all the product’s advertised functions.

While Newegg does not like to discourage sales, please purchase open box products only if you know how to deal with potential missing accessories.

Did I miss something? When did this forum turn into the Newegg complaint department? Seriously who cares -- when you buy open box you're rolling the dice, end of story. QQ

Good point, the origial intent was to determin if I should keep the Certified Repaired drives or send them back based on the fact that I didn't get what I ordered. I was concerned with the warranty and quality and after dwelling on it, I'm returning them.

Thanks everyone! Thread closed.
