Gaming, wife does some photoshop, a few server 2008 VMs for work related stuff as needed

~700$ but Im flexable --tax and shipping are not included ill pay what they are outside budget

Considered an SSD but I think Ill wait on that as it would eat into my new receiver budget for the home theather
 
if you werent aware the P67 chipset is the one that had the problems with the SATA ports a few weeks ago. intel was supposed to ship new chips and board manufacturers were replacing the problem boards sometime around march-april. i dont know if that is an updated board or not, but something to check out first.

i dont especially like OCZ for power supplies, and you can save $30 if you went with one like this. im sure that will work though, mostly personal preference.

besides that- looks good.
 
After a quick look through the egg you could go with:
I7-960 and ASUS Sabertooth X58 mobo in a combo for $471.98
add in CORSAIR DOMINATOR 6GB TR3X6G1600C8D for $119.99, $99.99 after EMCKGJK23 promo code
and go with the Seasonic x750 Gold over the OCZ. Price is $129.99 after EMCKGJJ76 promo code.
The H70 will set you back $104.81, but has a $10 MIR. so total price after everything comes up as $806.77 or $796.77 if you get the MIR.

Sorry, just checked your link for the H70, could save some $ by going with micro center on that one. would make your total about $801.95, then $20 back for the H70 MIR

That's the biggest issue with your planned setup. I recommend getting this significantly higher quality Corsair 650TX PSU instead:

Thanks for the suggestion. Ill drop the OCZ and pick up either the corsair or the modular XFX power supply.

Do you have any opinion on this Gigabyte board over the Asus?

Biggest gripe I have with all of the Gigabyte socket LGA 1155 motherboards is the lack of the UEFI bios. So personally I'd go with the Asus just for the UEFI.

In addition, that Gigabyte H67 motherboard linked to cannot take full advantage of the i5-2500K. In fact, it treats that CPU exactly the same as if it were permanently locked. In that case, it is a waste of $30 compared to the plain non-K i5-2500 if you have a mobo that cannot use any of the unlocked multipliers.
