I placed my order for a Swiftech Apex Extreme Kit for $259 on Tuesday December 6th. Nowhere on their site does it say "Backordered", it only says usually ships within 1-3 days. 2 days go by and I call them up asking the status of my order, the woman answering the phone says that its being drop shipped from Swiftech and should be shipped as advertised in 1-3 days. That night i opened a support ticket asking to make sure that it is in fact the Extreme kit and not the Ultra kit, and was at that point told that the kits are on backorder and it would not ship until the following week probably on Tuesday. Today comes around and im quite fed up with this waiting game as hes not even sure although its "Scheduled" to go out Tuesday, and so i call up to cancel my order cuz its getting a little ridiculous and id rather order from someplace that has the item actually in stock. I talk to the same guy this time as on the ticket, and he says there will be a 15% restocking fee. I said "How the heck is their a restocking fee for something you dont even have in stock?!" He said "Its just our policy". I told him that in no way was i informed when i ordered from you that it was backordered and he replied with we dont have time to update our site. Well hell, all the other sites seem to have time to say "Its on backorder" or "Out of Stock". He then said "We contacted you within 3 days to tell you it was backordered", so i replied "actually i contacted you where you pretty much said by the way, its on backorder." I highly doubt they would have ever even contacted me to tell me and id just be sitting here wondering where the hell my kit is. After much argueing, i was so pissed that i didnt care about the restocking fee as id rather put my money elsewhere after this crap. I now have my kit ordered from Jabtech and it should be here soon as they actually have them IN STOCK. Never again...

I'd call the CC company and refuse to pay the restocking fee... you never received the product, there can legally be no restocking fee.

really? Well, they charged the entire price on my CC the day i ordered. So they really put me at their mercy cuz they will only put back the amount on my card minus their $40 restocking fee.

i don't know about states side, but in canada restocking fees are totally illegal. plenty of places try to charge you for them, but if you refuse to pay, you refuse to pay. in canada, in your position, i would contact your CC company and inform them of the situation, and you you consider this to be an instance of fraud. so long as you did not at any point agree to the restocking fee (it sounds like you might have) then the CC company has plenty of ways of "dealing with" the offending party.

US law might well be different, but the better business bureau can probably give you some quick and free advice on how this treatment sits with your consumer protection laws.

good idea, may have to contact the good ole BBB.

On a lighter note, i ordered an Apex Kit from Jabtech at 11:30am this morning, and its 1:45 now and i just got a tracking # !! Kudos to Jabtech, they will get my business in the future.

What you do is you tell the credit card company about it and that you are refusing to pay it. The CC company will usually tell voyeurmods "sorry our customer doesn't want to pay" and they take the money back from voyeurmods.

i just filed a complaint with the BBB and im on the phone with the CC company.

well, the CC company would be a pain to get the charges taken off. I would prolly have to get em taken off and then close that CC and open another one. I'll just let the BBB take care of em as i requested a full refund in my complaint as to "What would you like the company to do?".

Sorry to hear of your misfortunes bro..Thanks for the heads up on the way VM treated you. I have been considering ordering from them in the past. On a lighter note, you are going to love your apex kit when it comes in! Be sure to post pics!!!

I hope the Apogee does not live up to its Apologee name...

Ordered some tubing and some other stuff from VMODS on thurs. now monday they say they shipped today but tracking shows they have been nitified but hasn't shipped. I know this will be the last time they get any of my biz.I dont know whatCC co you have but I have contested charges before and had no problem getting them solved to my satisfaction without any need to close account if you contest the charges you will win out. Just so people know VOYEURMODS SUCKS BIGTIME!

I ordered around Black Friday, still hasn't shipped. I had to open a ticket to even get a message that my product was backordered. I think the swiftech black radiators and swiftech rez's are on backorder. Needless to say, I won't be ordering anything from VM ever again. They have just been sitting on my money with no intention to contact me.

Ya , I got the Storm with my kit. Temps have been great. Anywhere from 18c-20c idle to 32-35c full load. I have been really impressed.

ya, but i now have an Ultra kit on order from Jabtech, who shipped it out within 2 hours of ordering. 11:30 i placed the order, 1:30 i had a UPS tracking #. I've never had WCing, so i prolly wont know the diff between the Storm and the Apogee.

whats your room temp?

I usually keep my apartment pretty cool. But I have ran it with the heater on before Id say mid 70's, and its only gone up by a couple of degree's.

Hear hear. I ordered a whole setup from VM on november 23rd or so... a week and a half later it was still not sent, so i opened a support ticket... then that took a while for a response where they said it was just shipped. The order status is still saying its not shipped, and I still haven't gotten it in the mail and its now what, december 13th? This is ridiculous and VM should be avoided. Their only saving grace was their thanksgiving free shipping sale, but boy have I paid for that.
boooooooooooo....

well, just to continue my drama, I opened another support ticket today asking if it in fact was shipped as they had said last week. They replied saying that danger den had messed up and sent them the wrong part, but they had it fixed overnight so that it was packaged and shipped out today. funny, i ordered this 3 weeks ago and just now they realized they included the wrong part? plus, who doesn't have a million maze4's on hand for a water cooling company. So its a bogus lie, and they lied about shipping it out last week. oh, and they also blamed the danger den ppl too, great job voyeurmods, you've set a new low.
on the bright side, they apologized and included some free pc ice (which kinda sucks I hear). They also upgraded the shipping (so they say) so it should be here soon... but i won't keep my hopes up.
anyway, don't buy from voyeurmods.com!

yeah thats funny beucase i ordered from them a few times with no probs??? Looks like thier customer serv took a nose dive. Thanks for the heads up!

here's the entire BBB complaint...

Complaint Classification: Credit/Billing/Coll.

Complaint Description - Posted 12-12-2005

I ordered a watercooling kit for my computer from them, and according to their site it was not backordered and "Usually ships in 1-3 days". I placed my order and began to wait. Two days later i called to check on my order and the secretary said it was being drop shipped from the manufacturer and should still ship in 1-3 days. Later that day i opened a Customer Service ticket online asking for some information on the product. Only then did someone tell me the product was on backorder and wouldnt ship until roughly a week later. Of course their refund policy states you have to cancel before 3pm on the same day of the order to get a full refund. The following monday i had become tired of waiting and called to cancel. I was told i had to pay a 15% restocking fee even though they dont have the item even in stock. 15% on $270 is alot. They of course charged my Credit Card as soon as my order was placed the week before, so now they will only refund $220 of my money. The funny thing is i placed my order after 3pm that tuesday, so technically i could have never cancelled without paying the restock fee. When i asked him why it did not specify it was on backorder he said that he didnt have time to update the site. This is misleading. I checked other retailers, and all of them specify if they are in stock, backordered, etc. This vendo made it appear as in stock, but it wasnt. I was locked into the deal as soon as i ordered and no matter what they would make 15% of the $.

Complaint Summary

Issue a restocking fee for items that are not even in stock although they are advertised as so.

Resolution Sought

Issue me a full refund, the amount of $271.10. They need to update their site to inform the buyer of backordered items. It is also an unreasonable cancellation time period.
Company's Response

Initial Response - Posted 12-23-2005

This was handled in compliance with our company's policies stated clearly on the website under terms and conditions which the customer agrees to upon purchasing items with us. The policy states:” Product Availability, pre-orders, and backorders-...When ordering any item, you assume the risk that the item may or may not be in stock and ready to ship at that moment in time. Although we attempt to get the items to you as efficiently and timely as possible, we are sometimes at the mercy of our vendors and cannot avoid some delays. We also attempt to update items with a status of "on backorder" whenever we are notified in advance by our vendors.."The prepayment policy then states,” Because several of our items for sale are considered custom, rare, or "hot" items...Prepayment is not a guarantee that your item is in stock or readily available. However, if the item's estimated time of arrival is unknown or excessive, we will be happy to issue you an in-store credit or a refund minus a 15% restock fee." And finally the policy states "...Any cancellation after the package has been ordered from our vendor, shipped, or packed is subject to a 15% restock fee and shipping charges (if the item has been shipped)." In addition, the customer had no problems with the policy and waiting for the product until he found a similar product elsewhere for cheaper and wanted to cancel after the item had already been ordered for him. This was the reason for the support ticket referred to in his complaint. The policy is in place because the majority of our products are custom made to order and often one-of-a-kind. It was then the customer was not willing to accept the cancellation policy. And our policy would have allowed him to cancel the order had it been before 3pm on the day of the order....or, if placed after 3pm..the following business day before 3pm. This policy is in place due to the shipping cut off of our warehouse.

Initial Response Summary

The situation was handled in compliance with our company's policy which is cleary stated on our website.
Consumer's Rebuttal

Rebuttal - Posted 1-20-2006

The policy is stated, but you must scower the site to find it. It is dishonest to not inform the customer of out of stock items and then immediately charge their credit card before having a product to ship. Make a note that "I" contacted you about my order, not the other way around. I have read of numerous accounts of Vmods doing this to others, except 3 weeks would go by, order status would still say "Sent to Shipping". This was no custom made kit either. Nowhere on the site does it say "PREPAY" because nobody would buy something not in stock. This is fraud, plain and simple and is Classic bait and switch. I pay my money VM says "Thanks we'll ship it out when we actually get it" Its FRAUD.

Thats why its best to use AMEX.

I'll tell ya one thing, after reading this post I'll never order from Voyeurmods for any of my builds.

Why do you guys think I was hep to talking Sharka into being an AC dealer? They are just a short drive across a few towns and then it is cash and carry. :D I don't like doing on-line business except for software where I get the license immediately.

I had some problems with Vmods also. I ordered about 5 things from them 2 of which were out of stock at the time. One came in stock right away but the storm cpu block I ordered was still out of stock. I opened a support ticket asking when it would be in stock and after a week still had no response to it. So I found it in stock somewhere else and ordered it from there and had the storm block canceled at Vmods. They held the rest of the things I ordered waiting on the storm block which is pretty irritating, but after I canceled the block they shipped it out that afternoon. All in all, there customer support isn't very good and I don't think I would order from there again.

VM is one massive scamer.
I know more than a few people who have been burned by them.

STAY AWAY AT ALL COSTS!

Because they have an even larger 20% restocking fee? ;)

Sorry to hear of your bad misfortunes with VMods. My one and only experience with them did have a couple of bumps, but was resolved in a timely manner.

I ordered, via PayPal, a Black Ice Pro II radiator with UPS ground shipping. When I got my notification that the item had shipped, I found I was charged for UPS shipping yet they sent it USPS.

So, I wrote them a little note asking for them to refund me the $1.75 difference between the two shipping methods. The following day, the difference was refunded to my PayPal account. They even noted my online order history to reflect it.

I will probably order from them again, but not any pre-configured or custom water cooling kits as I want to avoid what has happened to you all.

IIRC, that applies to returning non-defective merchandise at their discretion.

i did indeed.. In fact if you browse through the pages you will find others who have had similar experiences with them.

Very Dissatisfied

Very poor etailer. I purchased an item only to find out after i had to contact them due to it not being shipped only to find out that it was on backorder. They do NOT label items on backorder because, Quote from Brian the Owner "It takes too much time to update the website". Upon trying to cancel my order i was charged 15% restocking fee for an item they dont even have in stock and they refused to work anything out. I have now filed a complaint with the Better Business Bureau and have had to dispute the charge on my credit card. I give this etailer a nice huge F...

wow, looks like some of you guys got screwed. I've ordered from VM many times and have always had fast and reliable service. Hell the one time I ordered a pump that was turned out to be out of stock and after an e-mail they simply let me choose another pump, any pump. I made out with pump that was actually worth $15 more than the one I orginally ordered. I think they have a great seledtion and thier prices are spot on. I'm not denying that you guys have had problems, just getting another opinion out there.

So you ended up just getting the Apex Ultra kit? I have it and it works nicely. Granted I dont have AS5 on my CPU just some thermalright crap..when I get As5 ill put it on. Load temps w/ a stasis neptune GPU block in the loop is about 33-35C (2.75GHz @ 1.53v) and idle is about 27Cish.

Similar problem here. I ordered a WC kit on the 30th of January and my order was confirmed. I called and spoke to a women on the 14th of Febuary whom told me that it would be shiped the 21th of this month. I sent an email the 24th saying I have yet to recieve an email call or anything yet as to where my WC kit is. I'm getting to that point where i think i may put geting my refund back in the hands of my Credit Card CO. cause i really dont want to deal with people like these guys. I mean its going on 30days since i ordered the damn kit! :( :( :(

Yup, they will make you pay a restock fee. Dispute it with your CC company and leave some comments at resllerratings or the BBB. This is getting out of hand, and needs to be brought to everyones attention possible.

i submitted this to their "Support Ticket" system.

Brian at Vmods,

http://www.xtremesystems.org/forums/showthread.php?t=82910

I have threads like this at numerous computer enthusiast forums regarding what happened with my December 6th order with Voyeurmods.com, i encourage you to register and respond. I have unfortunately read of this same occurence happening to others dealing with you. I lost $40 to your backwards business practices, but i wonder how much you are loosing by treating customers this way? Your website has been put under the "Sketchy" section at numerous forums now, if you want to do something good for your business, register on the forums and talk to your customers.

Sincerely,
Chris Prosser

I hope Brian reads this thread...I probably won't shop with voyeurmods after hearing what happened to you...and I used to like them. I can understand a mistake here and there or a bad person on the phone but I can't accept a policy of not updating the website for out-of-stock items and then still charging for them.
