Are mod cards allowed to be sold here w/o including any downloaded games? I have a Nintendo DSi XL that I'd like to sell but I want to make sure that I can include the mod card that I'm using it with.

I would say that as long as your not including any games that you dont own, it would be fine to sell it here.

Flash carts aren't illegal...only ROMs.

You're allowed to legally own copies if you own the physical cartridge too. So in that case many times even roms are legal.
