Google And Bing Have No Obligation To Censor Searches For Torrents

A music industry group actually tried convincing Google and Bing to block any site or link with the word “torrent” from coming up in a search. Luckily, the courts used common sense this time and decided that would just be a tad excessive.

The group had called for a complete block on searches that include the word 'torrent' as well as blocking sites whose name includes the word. The court found that SNEP's request was far too broad, saying: "SNEP’s requests are general, and pertain not to a specific site but to all websites accessible through the stated methods, without consideration for identifying or even determining the site's content, on the premise that the term 'Torrent' is necessarily associated with infringing content". The court order goes on to point out that if the word 'torrent' was blocked, it would block access to all manner of non-piracy related sites.
 
Considering a torrent is just a text file (it really is just a text file) they really go a bit far in all of this, to be honest. As with anything else, the use of torrents for various purposes - both completely legitimate (Linux ISOs, program updates, game demos like Bizzard uses it for, etc) and of course completely illegitimate (movies, music, porn, whatever) - can be one way or the other so attacking search engines for such reasons is just flat out stupid.
 
And then all those porno heads that work in the music industry are going to realize they just screwed their own pooch!!!
 
Speaking of torrents, looks like tpb is being trolled in the hd video category ... all top listings are 2-3 members, and they all contain *.wmv which I wouldn't touch with a ten foot pole. And listings for things that aren't even out yet ... yeah, that's legit
 
Might as well block any search with the words, "Download." Or perhaps "MP3" and "FLAC" cause clearly non DRM media can only be used for one thing. I stopped buying "pro" produced music long ago, not only because its all junk anyway... these people are just to stupid to support. There are Tons of Indi bands and musicians out there and they are all very easy to discover these days, when you find ones you like supporting them directly isn't any harder.
 
The courts were smart this time, however we all better hope. No, screw that... CONTACT our congressional representatives, and demand they vote against the TPP. Otherwise, this ruling, and any ruling made in the future by an American judge, would be overridden by the international corporate court. The text already says ISP's will be mandated to remove this type of material, and is extremely vague in other areas as well. Not to mention the end of fair usage and other censorship.

Yeah, the “Investor-State Dispute Settlement” clause of the TPP is absolutely insane. It's amazing anyone would agree to that. It undermines the sovereignty of any nation that signs on.
