Dealing with a damaged item?

I recently traded my HD5870+Cash for a GTX570. I received the card in the mail today, it came in very poor packaging, VERY little packing around the card, and as a result it arrived damaged. The PCI tab was heavily bent, and I had to bend it back into place to put it into my PC to test. It seems it is in fact damaged, nVidia software doesn't detect it and Windows sees it as a Tesla M2090.

How should I deal with this? I am still waiting for contact back from the other party (its only been a few hours) and would like to know the best course of action. Should I instantly put out a claim on paypal, what can I do to at least get my original GPU returned? As I said, its only been a few hours and I am waiting for a reply, but I would like to know the best course of action
 
Hope you took pictures before opening it, as well as the condition of the card before mending it.
 
Can't really do much until you hear back from the other party. And if he's a jerk there's probably little you can do to get your original gpu back. There is no ruling body for trades which is why I tend to avoid them now for anything over $100.

On a side note I have seen some truly horrendous packing jobs. Like a cpu sent in a regular envelope. A motherboard, cpu, heatsink just throw in a big box with no other packing etc. Maybe there should be a sticky on packing tips.
 
hope whoever you traded with is understanding that it's their own fault for not having packed the item thoroughly, hopefully he takes it as a lesson and packages better from now on, especially when they send back your original video card. (if they send it back). i hope by "cash" you don't mean dollar bills, i hope you mean paypal or amazon, if this is the case, put a claim in NOW. also, hope the other party purchased insurance on the delivery, provide pictures of everything, card, box, nvidia not detecting the card, so a claim can be filed.

most importantly, if the other trader doesn't make good on sending you back your cash and card, send the user name to a mod on here and leave negative heat for their username.

this is a shitty situation, i hope the other party makes good
 
There's absolutely no reason to put in a claim now unless you're near the end of the time limit (which I highly doubt, it's 45 days from date of purchase as I recall). The reason you open a claim is because communications breaks down, or nonexistent, or discussions/negotiations go nowhere and the other party is unwilling to work with you.

To me, filing a claim immediately without even waiting a day for communications is a sign of bad faith on the buyer's part.

As far as the seller/buyer thing goes with stuff like this...besides poor packaging of course...but isn't it up to the buyer to pay for extra stuff like insurance and what not?

Depends on the seller's policy and what they agree on. Different people have different opinions on this. Some believe it's always on the seller to provide insurance. Others believe that it's on the buyer. I believe the seller should make clear his policy on things like insurance in his FS thread, that way the buyer knows exactly what they're getting into. If the buyer doesn't read over that part or opts for not having insurance, it's on the buyer.

If you take paypal or Amazon payments and probably any other payment processor it is the responsibility of the seller to delivery the item to the buyer in the advertised condition. Which means its on the seller to purchase insurance to protect themselves. Sellers can claim what they want but when paypal and Amazon have to make a decision they will side with the buyer if the shit hits the fan.
 
Insurance exists to protect the shipper. It is the seller's responsibility to delivery the item as described to the buyer. If the item arrives in a condition that does not match the item description then that's the seller's problem. A seller that will not stand behind his stated description of an item's condition upon arrival is not a seller I'd do business with.

I agree. Seller's responsibility to buy insurance every time.
 
We are currently looking at RMA options and other things. We've been in contact and I've not yet pulled my money from paypal, as he has been communicating.

If all else fails, I'm likely going to have my card shipped back (in the same way I shipped it to him, with insurance and extremely well packed) and have both the damaged card and my own card returned on his money. I do not like being a dick in these situations but seeing as it was the sellers poor packing quality that caused this, I feel I am in the right to request he pay for both shipments, am I in the right? What else should I keep an eye out for?

There are no RMA options seller didn't properly package card for transit and was damaged by his mistake. No manufacturer is going to issue an RMA for this but if so inclined he could sure string you along until your time runs out trying that route. Get your card and cash back if he wants to try and get an RMA he can wait and be out the card while in process you shouldn't have to be.
 
Any chance we can see the pics of the bent PCI slot?? I would have thought that the PCB would have cracked or snapped long before it would get bent.

That must have been one very crushed box for it to bend the slot, and not break the cooler or PCB in the process. Im more intrigued than anything else to actually see the damage.
