Even with the patent, they won't implement this unless they're sure they can get away with it (I don't doubt for a second that they'd love to do it). If the PS3 doesn't take a commanding marketshare lead (70%+) then they won't use it.
A slightly interesting question is whether they'll include the hardware for this in the PS3. The patent mentions several possible implementations, all require some overwritable region. Presumably the game developers would know about it long before we would (it's a major benefit to the game studios), but it seems very unlikely that Sony would implement this in their first round of games (even if you assume they'd implement it ever).
