Try calling in to place an order and explain that the pricing is messed up. They might give it to you for the $269.99 price. Just tell the rep that's what the ad said. You can try at least. ;)

Yeah I saw that lol. It showed $299.99 with a slash through the price and said to click to add to cart to see the lower price and it went up to $319.99 when I added it to my cart.
 
Black Editition is only 215 after live cash back...

An eVGA Core 216 Superclocked is only like $178 after live cashback so two of those would save you about $75 if you were buying for SLI. The Black Edition has nicer factory clocks but the eVGA should probably have about the same OC potential.

evga will give you a warranty if you buy from ebay, but they won't let you do a step up.
 
Try checking buy.com on ebay for it. I just bought a GTX 260 (although it was the 196 version) and they make you use paypal off of ebay. Now at first I thought this would ruin my CB chance, but it didn't. In fact, it was pretty lucky it worked that way. For some reason, they seem to want to relate all sales back to their site. Anyways, the point is, when I go print a receipt from them, it has no traces of ebay.com. It looks like you bought it right off of buy.com.

I clicked on the link to fry's online and it said $299, but click for special price...when you click the link it says $319...lol.
