Something about the EULA saying that it's governed by the laws of the state of Washingtion binds the agreement to that locality. Unless your area has laws saying that you can't be asked to agree to give up your rights to jurisdiction, then the entire EULA is valid because of that clause no matter what your local laws are. Or something to that effect. It was a late night bullshit conversaation with my friend and EULAs came up and I was trying to argue some points and failed miserably since I'm not a lawyer and he was. At any rate the accuracy of my statement may be completely off and nothing I said should be taken as Law (no pun intended).

Sorry, I don't want to go throught the hassle of searching for all the info again. I posted it in another thread in this forum about a month back though so if you search through the archive for threads regarding Microsft's WGA malarky then you should find it.

The case was about a guy that Microsoft tried to sue for breaking the EULA when he tried to resell some MS software on eBay because MS wouldn't refund him his money. He counter sued because the EULA was not valid or enforcable where he lived. This was in the U.S. too. Not saying all of the EULA is bogus but some of it is, again, depending on your local courts.

They asked me how many computers do you have this copy of XP installed on.
I said just this one, and the guy had me read off the numbers and then he was like ok type in the following numbers. I was done after that.

On new installs I suggested delaying activation until the integrity of the install is known but Gatticus wrote.

But you can't do that anymore becaue MS has changed it so that you can't get all the latest security updates until you have activated. How can you be sure your PC is running with no issues until you have all the updates?

I don't have this problem because I use Autopatcher for all updates. I never liked getting updates from Microsoft.

you paid for a license to use. In that license it says you have to activate it. Don't like it use something else.

Now I'm not a fan of activation, but it's painless and a once every once in a while issue.

...yes but the point is not that it is painless, the point is that we are being told unless you can prove otherwise, you are a criminal.

This is bad policy IMHO.

... and yes, I have spent hours with clients, desperately trying to figure out why they can't activate XP on their new PC with a previously purchased legit copy of XP Home... Ack!!!
