When I'm gaming, could be hours or a few minutes (5-15) in the game freezes and my system locks up. Usually either there is a still image left or the screen goes dark.

This was not a problem with my 4870, just recently with my new 4890.

I haven't RMAd it yet because I was waiting for the previous owner's registration ID number but he never did, now I have to wait and see if they are even going to take it. Oh the joys of FS threads.

FurMark runs at 110C load.
Here is GPU-Z stuff.

Rig is as follows:
i7 920 @ 4GHz, 1.275v
6 GB RAM, 1.6v
Gigabyte x58 mobo
XFX 4890, not OC
4 HDD
2 DVDrs
Sound card
wifi + bluetooth dongles
Corsair HX520

By any chance is it a ZDFC with a black PCB and two PCIE 6-pin power connector receptacles? If so, RMA it at your earliest convenience and demand they send you the revision with one 6-pin and one 8-pin receptacle (Rev 3). The ZDFC Rev 2 with black PCB and 2 6-pins is infamous for being a cheaped-out piece of junk, using a dumbed-down cooling system and cheaper components on the PCB (even removing some, like the Volterra VRM chips).

If not, RMA it anyway.

It is not that card, it has a big red fan in the center of the card, although it does have 2 6 pin connectors.

Hm, then it shouldn't be so bad. The issue isn't well-known in the ZSFCs (I think this is the one you're talking about). 110'C in Furmark is probably expectable given the cooling solution XFX used in this one and the hot nature of the RV790, though still exceptionally hot (don't run Furmark). You might be able to improve upon the temps with a re-seating of the cooler.

If it's not running properly at stock clocks and voltages then it is simply defective and needs an RMA.
