Trademark Troll Loses In Court

Something tells me we haven't heard the last of this guy. At least the courts finally canceled his trademarks so he'll have to start from scratch now.

Langdell had previously filed lawsuits and claimed damages from EA over its use of the word edge in 2008 game Mirror's Edge. He also squabbled with Future Publishing regarding Edge magazine - despite the fact they had already licensed the mark from him.

Wow. Just wow. Not a single one of these big companies besides EA decided to take it to this troll? They all paid out?

It's an obvious word.

Yeah, well.....juries are usually filled with idiots. If it goes your way, great. If not....well, then it is going to cost you.

The companies that paid probably viewed it as cheaper to pay him and be done with it.

Oh this is rich! This company trademarks "EDGE/THE EDGE". Emphasis on ALL CAPS. The get a computer manufacturer to pay them because they call one of their computer lines "Edge". They got 20th Century Fox to pay them royalties for a movie called "The Edge" with Anthony Hopkins about bears in fuckin Alaska....bears in Alaska! And another company because they called a Wii game controller "The Edge". Not one of these used caps.

Then on top of all this, they parade these poor fools right there on their webpage for the whole world to see. How humiliating is that?

But yet they make no mention of a person who has been calling themselves "The Edge" since before this company has been around. There is literally prior art of someone going by the name The Edge.

The company is too legit to quit.
 
One change to the legal system will STOP the majority of frivolous law suits and these ridiculous trademark and patent lawsuits.
If you drag a person into court and make them spend thousands on legal representation and all other losses involved; if the system was changed to LOSER PAY most of the suits would disappear.
What patent trolls want is to collect unwarranted licensing or out of court settlements.
Typically when the evidence is closely examined it is found they never had a leg to stand on in the first place.
Do they expect the defendant to tip is hat on go on his merry way?
He is out thousands of dollars; his reputation is smeared, along with other losses.
He has to counter sue to try to recoup his losses and secondly rebuilt his reputation.
Call it what it is. Frivolous lawsuits and unwarranted trademark and patent claims is FRAUD.
 
I agree with that. At least for patent/copyright/trademark cases.

How does this help someone who cannot afford to put up the money for a shyster to begin with?

The system is loser pays. You just have to be able to afford a lawyer to file the appropriate motions.
 
Too bad it's the small companies that can't even afford to fight that get hurt.

If the patent troll is sure to lose when challenged (and therefor have to pay all the legal fees), then it sure would be nice if there was some legal defense fund/team set up by the big guys to cover the small ones.

Think about it- it could actually be profitable if you're going to win all these otherwise settled cases.
 
Well it was much pretty much sighted before, that something like that would come to happen and it did. I feel sorry for the guy, but laws do take care of themselves.
