I would contest them on this. Tell them to send a USPS shipping label or get fucked. You should not have to drive out of your way to send it back to them when they screwed up.

Well, I'm honestly rather surprised that they weren't willing to take a hit on the card and let you keep it. Honestly though, if it really is alot of trouble for you to get to a UPS location call them back. Then ask to speak to a CSR/RMA supervisor. Explain your situation to them once again and kindly ask that they arrange for a UPS pickup from your home. They should be able to issue a calltag and the UPS driver should come out to your place, slap the label on your package, leave or hand you a 'recipt' and be on his merry way without you having to hunt them down.
That is at least what I'd have them do. Again, you're doing the right and honest thing here but you shouldn't have to pay (be it in the form of money, time or gas) for their mistake.

I replied to their original RMA email they sent me and sent them a link to this thread , lol ... I'm curious to see if/how they respond

i'd send it back if an independant seller made a mistake...but honestly, what are the chances of you or i sending 2 7900's instead of one?

that mistake could only be made by an underpaid pawn of a heartless corporation and in my version of morality, taking advantage of said corporation is my responsibility.

at the prices we pay for these things and at the frequency they must be updated, we should all get actual deals like this one. buy 2 flagships, get your next for free! act now and get a tshirt, yo-yo, hat and badge stickers for you and all your friends.

i still have my half-life 2 tshirt and AMD yo-yo's.

:D

QFT.

call the company. Test both, select the one that works (better) and have them pay for return shipping.

You should be like hell with you... I don't have to $hit... Tell them you come personally and pick it up yourself and just toss the card in the closet until they do...

its not worth doing that with threedees luck they will destroy his credit and dont say they cant they can and they will. remember the conversations are recorded. do u know how quickly he could get screwed? anyway threedee man i know it doesnt mean anything to u but u got my respect dude you're probably in the 5% of people in these forums who has real morals and true honesty man. like i said before most of the people in these forums are little shitheads with no morals no respect and unfortunately many are from my generation. and its really getting on my nerves with all these people bitching about the markup on highend cards and actually thinking it only takes 20 bucks to make a highend video card. without that high markup on the highend cards, ur highend stock starts to cannibalize your midend stock. you drop the price on the highend cards, u need to drop them on the mid end cards and finally drop the prices on the low end cards. its not smart business. u dont want a highend card for a highend price? suck it up and buy midend

They cant legally charge you for the second video card. They sent it to you unrequested, consumer rights FTW

Exactly. Thats like throwing garbage at someone, and telling THEM to pick it up cuz they touched it last.

they can charge you. and they will charge you. you REALLY dont wanna risk your credit. You think you're all self righteous and that they can't legally charge you, then your credit gets fucked up, you hire a lawyer in an attempt to clear your name, you lose for the second time, now you're out of good credit and out of cash you hired on a lawyer cuz you thought you knew what your consumer rights are. and oh by the way genius, you have 30 days to notify the company that you did NOT want the product and within that same 30 days return the product or they can LEGALLY charge you.

it's evga who has to pick up the card... Threedee doesn't haven't to do anything if he doesn't want to... They can't touch his credit... That's just bogus...

Yeah, if they make a good faith effort to get the card without costing him any more money, then he does have to return it. However, forcing him to drive a half hour to the nearest UPS drop off is not acceptable unless they are offering him compensation for time, fuel, etc.

i rmad a 3000+ to amd and got a 3500+ i didnt say anything i was happy thats all nothing more nothing less. but this case is a bit different :p

still waiting for a response from eVga ... they're supposed to be emailing me a UPS label , but I sent a few emails to them after my last phone call with a live person there

Woah dude plain and simple in the U.S.A. they cannot charge him for something he didnt ask for and they cannot even touch his credit over it consumer rights exist for this reason.

According to what your saying a company can just send you random shit and a bill you for something you never asked for or wanted? Dude do a little research before coming here making an ass of yourself.

You shouldn't have to drive a far distance to ship something back because they made a mistake. If they want it back, they can organise a UPS collection. They can't give you the option of driving far to correct their mistake, or charge you. That's BS. It's their mistake and they can either correct it, or leave it be.

I voted to send it back. But i would email them first and ask if it was a mistake, and if they want it back. Becuase if it was a mistake, and you did not report it they might want it back. And you may have sold it, then you are screwed. You now have to go and buy a new one and send it back to them. But maybe if you are truthfull then they may let you keep it. :) Do what you wish.

Should've just kept them both and stayed quiet.

nah ..there are certain things that if you start letting yourself get "numb" to ...I think that is when a person truely starts dying.

still no reply from eVga

are you fuckin stupid? companies do that all the time. they send random shit out, and send you a bill for it. and by law you have the right, within thirty days to inform them you do not want that stuff send it back to them and then you cannot be billed. ive done much more than a little research my lawyer has too. thirty days is the rule. any longer then u have to pay or send the items back.

they shouldnt be able to, but they can. all of u people fail to understand the concept. so let me get preschool on you guys so you can understand. a person delivers a car to ur house. u did not pay for the car but the dealership is delivering it to your house. you dont really need the car so you go and sell it. do you really think that you legally could sell the car knowing you didnt own it? and do you think that the dealership really wont bill you? come on now. get real. the only difference between this and the car scenario is this is a much less valuable item. the people who keep mentioning consumer rights need to get their heads out of their ass and go to law school or consult their lawyer.

I would keep the 2nd card. God told someone to mess up at the packaging area, so use it until you find another use for it. Like putting it in someone else's comp that needs one built.

Yes, but you wouldn't have to send the car back. They would have to make arrangements to take back THEIR CAR. You would have to inform them though.

How are people supposed to know every single law there is?

This is why the judges/police say "ignorance of the law is no excuse". Unless you're talking about one of them or their buddies, then slack frequently gets cut. We peons, ha.

But then the authorities break laws to get evidence or just downright corrupt... Who is going to judge them?

This is a hard choice. If it was me, I'd keep both cards unless they asked me about it then I'd send it back, otherwise...tough cookies dual video card setup time! :D

Happened to me when I had to RMA my 36GB raptors...they sent me back three brand new ones...they contacted me a few days after I recieved it in the mail saying they knew they sent me three but they said I could keep it anyway. I wish I could find the email...
I ordered Clearflex60 from Performance-PCs, they sent me Tygon R-3603... I E-Mailed them, and they said I could keep it, they made a mistake to my benefit.

This happened to me many time in the past.

Paid 100 dollar bill for food worth 30 dollar and got back 90 dollar.. :D

Customer front of me decided she dont want 3 dvd worth 40 dollar total and cashier left it on the table then somehow cashier forgot about it and put them into my bag.. (Already been scanned to disable the shop lifting protection) :D

The list goes on. The bottom line is they screwed up so keep the card and let them pay for their miskate.

get a new passport, drivers license, and move. and instead of making new friends, use your 7900gtx sli rig to game like crazy. fuck friends and laws! lol

Well if they want it back, they should hve to pay for shipping IMHO. And they mostlkely wont, because they have to oay for shipping, get it back, then restock it. Too much hassle for them. Thats what Antec done for me, they sent me the wrong part, and the guy said just keep it, i will send you another. Sales reps dont care, as long as they get paid.

For those that haven't actually read this thread...
They want it shipped back and are paying for shipping... HOWEVER, they expect him to actually go to a UPS location, which for him is 30+minutes away, to send it out. There you go. Facts of the situation encapslated for those that don't like to actually read ;)

**Update**

eVga sent me a UPS label to return the extra card they sent me ... and it turns out (after using the handy dandy UPS center tracker thingy doo-dad) that there is a place that sends out UPS stuff just downtown on main street here ..only open 8am to 5pm of course , so I'll be seeing if my 10months pregnant sister (who lives in my house with me as well as her husband and baby daughter) can take the card down for me tomorrow ..

still no replies from eVga on my 2 other emails that I sent them tho

ah well ... maybe next time I get an extra video card sent to me ..they'll let me keep it

:p
