I sold him five giftcards. Two $25 Shell Gas cards and three ebay giftcards. One worth $50 and the other two were worth $25. The two $25 cards were not working for some reason. When you try to use them it tells you "they are not ready to be used" I contacted ebay multiple times but they just tell me to call Paypal. There is nothing i can do about it so i decided to refund his money for those cards. Nick only paid $21 per card. So he should get a $42 refund, right? Well he wants $63. He paid me $126 total. I know its not alot but i dont want to get scammed here. He already started a paypal case and they are now reviewing the case. They almost always decide in the buyers favor so he would probably get a full refund of $126 plus he already got the codes. Mods can check the private messages if they want.

so he paid $126.00 for 5 gift cards (2x25 gas card and $100 ebay gift card) and only the 2 ebay gift card of $25.00 each does not work, mathematically he should only get $42.00 in refund, i'm not sure why he wants $63.00. Did you ask him why?

Yeah multiple times. He says he bought 6 cards or something and he never got the 6th but if that was the case how did he not notice it before? He is just now saying something about it a few weeks after the fact. I'm not real sure. I'm just waiting for him to reply here and explain why he wants $63. Like i said the mods can read the pm's and see that he only bought 5 cards.

This is the problem with buying or selling gift cards. It may work or may not work when you go to use it. Honestly just too high of a risk to even sale or buy them here. The sad thing is every time some get sold, it end up in here with a problem. I'm not attacking you in general but there is just too big of a gray area in trying to move these. If someone wanted to be dirty they could sale some then go report them stolen. Or get the credit moved to another card, etc.

I don't even want to think how he missed getting shipped a gift card though. Honestly he could have bought another gift card from someone else. And thought he got it from you. Hopefully you can get it sorted and resolve the matter and both parties be happy.

Am I reading that you sold gift cards (basically cash) to a user with very little and somewhat negative heat? On top of that you used paypal?

http://www.heatware.com/eval.php?id=75920

Is this not the same guy?

The heat was old and had positive reviews since then so i figured it would be fine.

Anyways he wont respond to my messages now but ive got everything from his home/work address, phone numbers and his facebook so atleast i know something about the guy

Make sure you point him to this thread.
I have dealt with you before and you were cool to deal with, and were kind enough to trust me to ship first.

He needs to have a chance to post in this thread, and if he ignores it, it looks worse on him.
So far it looks like neither of you have left heat, so there is still room to resolve this in good faith.

I read both sides of that heat and I honestly would have no problem dealing with nicklemarr based on that one bad eval......

In the meantime Ill send him a PM to respond here and hopefully you guys can work this out

Okay, I'm here. Let me sort this thing out. The deal was struck February 4th and I paid February 5th, it's now March 16th, and the entire duration I've had nothing but problems from this guy.

This might be long, but I've got every one of his messages in a folder here for reference.

I was weary of buying from him because I've never bought used (in the sense of already owned) gift cards, as well as the price, but he had fine feedback, and he needed to get rid of them.

He sent me some codes in a message here on [H]. One missing. Four didn't work. I called eBay customer support and they said the codes were invalid and had an old format, so I figure they were used, I didn't want to accuse him, so I messaged him at that time. He didn't message me back and I saw online activity so I messaged him again. At that point he said he wasn't getting my messages.

I then asked him to call eBay and handle it because he sold me a non-functional product. He said of course he would. I wait another week and nothing. I message him and nothing. I message him again because I get the Shell cards in the mail (they work fine). He says he was supposed to get a call from a supervisor and he didn't. No other explanation and seems like he gave up in my opinion.

I'm getting upset at this point because it's been almost a month and I've only gotten three of the cards that I paid for, with no hope in sight from this guy.

I told him, at this point, that if he refunded my money, he wouldn't have to worry about negative feedback and I understand mistakes happen (even though I had been waiting a month).

Here is where the dispute actually lies. I told him in the original message the following:

If I'm paying $21 per card, and I pay $126, then how is that five cards? He refuses to believe that I paid $126.
So I refer him to the transaction details on Paypal here:

oVBQ6ck.png

I made sure to spell it out in the details in case this happened.
I asked him why did he take my $126 if he all of a sudden was only going to give me five instead of six. I'm trying to be understanding about this. Let's just SAY, he really only had five. Then why not ask me what the extra money was for? Why not say anything when he saw the transaction details? Why not say anything in the messages BEFORE I asked for the refund.

It's basically a cash exchange. Something I'd never do with a poor heat user.

For the 10 millionth time one of the ebay cards was worth $50. You had the two shell $25 cards. thats $50. You had the one $50 ebay card. Thats $100. Then the two non working $25 ebay cards. Thats $150. You paid $21 per card or $21 per $25 i guess you could say since one of the cards was worth 50. So that comes out to $126. Exactly what you paid. I can take pictures of the cards and the codes, he paid what he was suppose to. Since the two $25 ebay cards were non-working you only get a $42 refund.

I understand and have understood what you've been saying, but if that were true, why didn't you say ANYTHING about it BEFORE I wanted the money back? Also, I said $21 per card. PER CARD. Not per $25. The value of the cards separately didn't matter to me, only the total value. That's why I paid $21 *per card*.

wait so if it's $21 per card, that means you are paying $21 for a $25 gift card and $21 for a $50 gift card?

He needed to sell them and I told him I'd buy every card he had, whether it was 2 or 20. We were negotiating and we finally settled on $21 per card, as shown in the two previous screen shots.

It's just $21. It's not a big deal, but when the messages and Paypal transaction say one thing and he says another, it becomes a matter of principle. I always make sure to detail everything out in the Paypal transaction just in case something like this happens.

If i understand you correctly you want to pay $21 for a $50 card? Do you think i am going to give you a $50 ebay card for $21? The same as the other $25 cards? I don't think so.

That's convent for you to say after you already said yes and have had my money for over a month. If you didn't like the terms, why didn't you say something before?

What terms? You paid 84% of each card. Not $21 for a $50 card.

Also so everyone knows that i am not lying the two non-working ebay cards were never used. When you try to use them it tells you this

"The coupon code could not be used for your purchase.

This coupon code is not yet ready for use. Please try again later."

Try it for yourself. If you can get it working you can use the money.

When you try to use a card that was already used it tells you this

"The redemption code could not be used for your purchase.

There is no balance left on this redemption code."

Try it with the $50 card he already used.

...The only terms we had. $21 per card for all the cards. You can't turn your back on our agreement after I pay you man. I don't understand what the problem is. I paid for six cards and only got three. End of story.

I'm not turning my back on anything. i will give you a refund for the two non-working cards. Not for this imaginary card you made up so you can try and make a quick 20 bucks. You bought 5 cards. You didn't pay $21 for each card regardless of the value. That's not how things work.

Since the 2 of you are talking now, why dont you try and work this out in PM....

I bought 5 cards? Then why does it say six?
I didn't pay $21 each? Then why does it say so?
Where is the fantasy world you're living in?

The BOTTOM LINE is that if you didn't like the terms, you shouldn't have taken my money.
I'm done with this thread. You're obviously living inside a bubble and Paypal is going to have to make a decision.

From where I sit, this looks like is was just one big misunderstanding .
nicklemarr if you take the $42.00 your not out anything.......he is offering that to you, and even though if you take it, your not getting the great deal you thought you were, you still did pretty well at $21.00 per $25.00 .

I cant make anyone do anything, but that honestly seems like the best way to put an end to this

I totally understand that man. And I agree with you, I know it would be the easiest way to get through this, but what sort of man would I be if I took the easy way out every time? I'd rather have negative feedback on heatware than let him renig. If I let him renege, then I'm an enabler for anyone else who wants to do what he's doing.

Hey I tried..I can respect a man who stands up for what he believes in....I personally would be more inclined to just settle it and put it behind me...:)

Still seems to be a discrepancy here. You're saying $150 is the total amount. The Paypal sheet says three $25 eBay cards, one $50 eBay card, two $25 Shell cards.

That's $175. $175≠$150. Is there a larger misunderstanding here...not just communication or how you want to slice up a bulk purchase, but rather what someone thought they were getting?

Finally, someone who gets it. Lol. Either way, I'm settling this privately now.

I just think its funny, all this hub-bub but NO showing of the sale or the PM's that displayed the actual details of the transaction. I'm just saying!

He and I have both shown the PM with the original transaction, you should read the thread first. Either way, it's over. We've came to an agreement. Close the thread please.
