OK here the story. I bought an x2 3800 (230 paypal discover card) from LauperAl on 1/25/06 and he was going to ship it on 1/27/05 but was unable to. He then shipped the item on 1/30/06. I waited for shipment coz he said he shipped it overnight but haven't received any item. I AIM him and e-mailed him but no response.

I waited till 2/1 and then I filed a dispute on paypal. He responded to the dispute and posted a tracking number but the tracking number was sent to bail_w. He apologized for the mistake and now I've been in contact with bail_w to try to check his front office of his apartment for any packages (he said he will do so today) but bail_w is saying not to blame him if the package is not there or if it's open. UPS will pick it up monday in front office if it's there and not opened and send it back to the sender.

Now I am not sure if I will ever see the light of this CPU. Any advice? Will I get any money from paypal since LauperAl said his account is -230 after I filed the dispute? Should I just go ahead and do a charge back with Discover (discover advised me to wait for paypal dispute)? What are the chances of getting my money back if I don't get the CPU? Would paypal refund me even if he has nothing in his account? Should I wait and see if bail_w will see a package or not before I do anything? Please help.

updates:

well, bail_w said there was no packages. So I called the front office of Valencia apartments and talked to Erica. I gave her the shipping number and she said that bail_w (Baily We) did picked up the package at the front office and signed for it. I asked her to verify the signature from the other packages he picked up and she said it was the same signature (see updates 2/8/06)

Update 2/8/06

It turns out that bail_w found the package. He said it was picked up by his room mate and put under a table so he never noticed it. We are just waiting for LauperAl to respond to his pm's so he can send the CPU (if amd box is not openeted) to me or to LauperAl.

Update 2/9/06

I talked to LauperAl last night and he said he sent 25 payment to bail_w via paypal. bail_w confirmed receipt of payment and is going to ship the cpu 2-3 days shipping via USPS.

Well, as to what you should do I have no idea, but here is how paypal works. Once you file a claim, and then cancel the claim you can not file a claim again with that same person, so I hope you still have the claim on this guy. Second, paypal accounts are tied to a bank account atleast, or a credit card if the account is upgraded, should this guy have no money in his paypal account and it turns out you win the claim (yeah...right) then paypal will pull it out of his bank account or credit card if that is on file. If he's got no money in his bank account I think you're screwed and take it up with discover. And since the guy DOES have a tracking # even though it's sent to the wrong guy I'm not sure what paypal will do, because you can't say he didn't send it since he does have proof. Seems like a nice pickle.

If his account is negative 230 then paypal is holding the money until the dispute is resolved. You are looking atleast a month for either the money to be returned to you or the guy gets it back. Either way it's a coin toss for paypal.

Keep in touch with bail_w. Personally, if a package turns up out of the blue I'd of course open it and no I wouldn't take any responability for it, I mean one I wouldn't know who the hell it came from or why, so I'd hang on to it to see what happens, if he's really nice and had opened it he would pay the shipping back, but yeah, what kind of world do we live in...because no shipping service will return a package that has been opened.

What's LauperAI's heat count? Personally I can't see how hard it is to get packages to the right person, I mean you either have to be in a hurry, or real dumb. Just keep in touch with the 2 guys, submit a lot of info to paypal (becuase they say this helps paypal....yeah right). Is LauperAI verified with paypal?

I was screwed out of $50 bucks after a 4 month period after the transaction was complete, so with paypal you really have no idea. It's suck becuase it's the only service that does this and they can get away with it.

Good luck either way!

I have a bad trade going with this guy too. I bought THIS motherboard on the 27th.
On the 2nd I got
THIS
email. I caught him on AIM and told him I wanted a refund. The response was 'you'll have to wait on that' 'money transferred to bank account'.

Just a few minutes ago also on AIM our conversation went like this:

SkirkOn22s: i dont ignore your messages
SkirkOn22s: you see how ive been on for 1 day and 13 hours

SkirkOn22s: so get over it youll get your money back
Tootuna2: So you are saying that my board got shipped to someone else, right
SkirkOn22s: from now on email me I dont talk on aim very often
SkirkOn22s: and I have some errands to run so you can send me a email or if you really want leave me a im

SkirkOn22s: now i have errands to do that are more important than you
SkirkOn22s: so emailme and ill get back
SkirkOn22s is away at 2:17:44 PM.

I may or may not get my refund or the board. It won't kill me if I don't. But this is an example of sloppy lameass trading practices by noobie traders. I haven't had a bad trade in a very long time, and I thank all the 70+ people in Heat. I got complacent and sloppy myself in letting my guard down, and I hope this is resolved to your satisfaction. Good luck to you.

thanks a lot for all your reply. Krypto thanks, I will follow your advice.

wouldn't it be great if that were true?

Fixed.

I've never had a problem when after I win the claim having the money returned to me. It's just winning the claim that's so hard to do.

Whatever you do, don't get all pissed off when you write a responce to paypal about a crazy dispute against you, that seems to shorten the time peroid and the disputer has a great chance of winning, and I do mean a great chance :D

Indeed. That used to be true, but since the class-action settlement, they no longer do that. Now, they just send a collections agency after you. Also, just reciently (Jan 20th, I believe), the wording was changed so you could file another claim on the same item. Furthermore, if the tracking shows that it was delivered to somewhere besides your confirmed address, then it should never have been closed.

Wait, after reading AIM that Toonage posted looks like that guy is sending shit to wrong people? Maybe he has a friend that he sends this stuff to and friend sends it back, and that is the way they scam? by sending each other Items so taht it looks like they actually HAVE shipped it?
The guy is playing you both, that is for sure...... To the threadstarter, go deal with Discover, paypal can't pull cash from your bannk account, unless that seller will put money on his paypal, you will not see a cent back, even if you win the claim.

clemsyn said:
I had that feeling going too...thanks for the advice. I will do so.
You welcome, trust me trolls get smarter as paypal stays stupid. They will never rule in your favor if he actually shipped the item. By the way did he actually ship in the right state?

adalos said:
ya, paypal can not pull money from your bank account period.

Maybe not from your bank account, but they sure pulled the $50 right from my credit card that I had on file...

well bail_w lied about the fact that he never received the package coz I check with valencia apts and their records shows that he picked up the package (I verified the shipping number with their records) and actually signed for it. I asked the lady to verify the signature and she said it is his signature.

Well, now if bail_w is an honest person he'll ship it back and the seller should re-imburse the guy for doing that. If bail_w decides to hang on to it and do nothing then you need to talk to the seller for a full refund of your money, becuase he was the dip who can't get an address right, he should be working his butt off to get you that card back since it was his mistake. Tell him what you found out, call the dude who has the package, it's easy to find a phone #, call the seller, tell him you want the package or a full refund soon or else you'll take it to the next level.

Anyone else with a good tip?

I knew it would be a matter of time untill that Turd bail_w showed his true colors in public.

He responded via PM's to my Anandtech WTB thread a couple of months ago, I was looking for an LCD monitor. He offered up his used Dell 1905 for the same price I paid for one NIB 4 months before that.

When I told him I was not interested at that price he responded with a barrage of "F" bombs that would make my mechanic blush.

When I typed up a reply to tell him just how childish he was acting he had already blocked me from sending him PM's.

Good luck with your situation, I hope it all works out. Regardless of bail_w's involvement LauperAl owes you either a CPU or a refund, it is always the shippers responsiblity to make sure the buyer gets his product.

EDIT: if you look at both of their heat accounts, neither have left any heat for each other, so I wonder why LauperAI has bail_w's address?

bail_w's heat showed that he bought an X2 3800 at the end of last month.

Are you contacting bail_w now about the package he signed for? He is posting here, but not mentioning anything about it.

because i already contacted laurperAL about it. just waiting for replies

I have a feeling that bail_w and Trucker61 might be packing for a vacation  .
But yea, bail_w your english sucks...
Glad you got the issue resolved.

I traded my 2005FPW to special_k for X2 3800 and 7800GT. the reason LauperAl has my address because at first i call dibs on the CPU, then when i paid LauperAl; i found out he sold his CPU to someone else.

Trucker61 and bail_w stop the pissing match, this isnt the place for it, keep ti on topic

Bail_w your attitude thru this hasnt been the greatest but that aside I do agree that the sender should pay for ship ONLY either back to him or to clesyn.

Funny how bail_w is involved in this mess. He has a terrible attitude. He responded to one of FS threads and Anand with a major lowball offer. I responded with a simple "no thank you" and he came back with some nasty remarks. He is on my DNT list. Hope you get this resolved soon, sounds like a scam going on.

Well everyone involved has posted so for now im goin to lock this up, any more info needs to be add hit me up and ill unlock this

Here is the sequence of emails (2) Immediate PayPal was sent the 27th. Of particular interest is whats in the last one at the bottom. The fact he would even consider reselling the motherboard when I have paid for it is inexcusable. He has never told me he sent my board to someone else, he hasn't sent the board or a refund, and has gotten worse with the excuses. This is officially now a very bad deal. Although I wanted a refund I'd be satisfied to get the board to have something to show for my money. God knows what condition it would show up in, he's spent all his time avoiding and there's no time left to pack properly.

Well Victor, you want email here it is. I want to know about my refund. I have seen nothing to my paypal account. We are going on 2 weeks without either the board or my money back. I have alerted the Mods at Hardforums, Anandtech, and PCPerspective about this transaction as well as PayPal. Please do the right thing and refund my money before things go to the next level and I start alerting authorities in your local jurisdiction about internet fraud.

Regards

Who is that directed towards CDS? If its me, I've got squat. I talk to Clemsyn almost daily and he's said nothing about getting anything either. LauperAL has not contacted either of us. Although it still helps resolve the issues here, I find it interesting that you are the one getting information and its our money thats out there.....what a deal...........lol. Thanks for your help nonetheless. I'll leave it to you to respond to bail_w's last post and with great effort keep my typing fingers silent about that.......

I think you are a left behind, how sad . you need to talk to clemsyn more because last night i thought clemsyn told me that he was on the phone with LauperAL.....

So you are going to hold on to that X2 3800 and not send it back or to the correct owner because of a few dollars for shipping?

bail_w is shipping the cpu to me today. This is the shipping number

Thank you. someone finally updates.

LauperAL can say refund in PayPal all he wants. The facts are that Clemsyn has a claim against him there and any money deposited will be held. I understand comepletely that Clemsyn wouldn't release that claim until he has the unopened cpu box in his hands sent from bail_w. This all comes down to two people simply doing the right thing. Lauper could send just send the damn board that he has and at least fulfill the original buy and leave PP out of it. bail_w can take the high road and send the package he mistakenly got to its rightful owner. If it was me, I'd even do a Heat evaluation because he was honest and forthright. As it is, the cpu has been held hostage because of a little bit of money to send it back out. The thot plickens........lol

Actually, bail_w said for $20 hed send it out, LauperAL sent him $25.

As of right now it looks to be the CPU has been shipped. We'll wait and see when he gets it

A processor costs $8.25 USPS Flat Rate Priority. Add .45 for Delivery Confirmation. What a deal to make money on a bad situation. I'm glad for Clemsyn that the wheels are rolling for resolution of his situation. This thread has certainly brought to light the issue of integrity, and the lack thereof.
