Will AMD strike back

AMD laying off redundant job positions is to be expected. Any company, whether they were experiencing record profits or not, would do the same. It has nothing to do with their recent quarterly performance.

Now Intel laying off 10,000 employees, that's a different story. Hehe.

I'm shocked no one has brought up the lawsuits AMD filed against intel for illegal price fixing/quota based rewards. IMO, when the suits get settled on this, there will be Billions changing hands.

That's because you haven't been following the news.

The judge has dismissed the most important parts of the of the case. It's nothing more than a PR exercise at this point.

If you're referring to THIS, you need to understand that the judge only ruled that AMD can't use foreign sales to calculate damages due to Intel's behavior. If you've got some more information, feel free to post a link- Or at least expand on what you mean by "most important parts of the ... case"
pcworld article said:
The case has no direct relation to the antitrust suit leveled against Intel in 2005 by AMD...

more interesting reading:

Since 1999, according to the complaint, Dell Computer would secretly design AMD-powered computers every year, but it would never ship them "due to the large sums of money the Company would lose from Intel for breaching the exclusive Dell/Intel processor relationship."

If you're referring to THIS, you need to understand that the judge only ruled that AMD can't use foreign sales to calculate damages due to Intel's behavior.[/URL]

The news came September last year when the judge decided to exclude foreign issues from the US suit. A major part of AMD's case is that it claims it is a domestic company competing with another doemstic company that has done it wrong. However, AMD manufactures processors in Germany and packages and tests them in Asia. Intel's actions overseas might affect AMD, but it can't be claimed in a US court.

All that AMD has remaining is to claim is the alleged rebates, the predatory pricing, and restraint of trade. First, the Clayton Act allows for preferential pricing if the manufacturer does indeed save due to volume production. The preferential treatment for an OEM if they drop AMD and only use Intel is indeed illegal, but you can bet Intel has trained their sales staff not to do such a thing. Basically, if AMD had a smoking gun, they would have presented to the judge by now. But right now, they're still looking through Intel's discarded emails and whatnot.

Like when all the nutsies were sure the IRS would fine Intel $$ Billions...and Intel ended up with $275 million in tax relief???

The case between Intel and AMD is still pending. AMD's case is a longshot.

Whereas complainants against Coca Cola's actions were actual businesses who brought proof of Coca Cola's coercion,
whereas Rambus' price fixing case was brought against manufacturers who made both types of chips, choosing one over the other and where the evidence was apparent from the pricing,
AMD's case against Intel lacks a business partner to corroborate their claims.

In this type of case, the burden of proof is on the accuser.

The trifles made over Intel's bungled email "scandal" are laughable. AMD shouldn't need any internal memos from Intel if partners like Dell, especially Dell, would pony up their end of alleged bargaining. Since Dell is committed to AMD, and they're under no jeopardy, and they stand to lose nothing if AMD wins the case, why don't they?

So now, AMD's case rests solely on self-incriminating evidence against Intel.

As the saying goes, if it walks like a duck and it quacks like a duck, it's a duck. I'd rather hear it told by someone with good hearing and good vision than hear it from the visual and hearing-impaired.

This is why we have a judicial system. It's because we believe in justice(I sure do, at least). Keep your prejudices, but remember that the case will be decided by the courts.

Not really! No one's proved that Co-Branding is against the law=P Dell still saves tons of money running than Intel Inside ads. AMD is mentioned in about every 4th add for their Dell inside PC's and Servers. Go to a Coke sponsored Fast Food Franchise and order a Pepsi?

Missed in that report might be this.

Another challenge for the class-action suit is Intel's motion to dismiss the entire case because it says customers were never harmed by increased prices. Instead, Intel says it used its dominant market position to compete with AMD by decreasing prices, Small said. Farnan said Wednesday he would rule on that motion by the end of March.

Now, some first year law student could easily make that case for Intel. First Pentium D and then Conroe forced AMD to cut prices. NOT artificially raise them LOL! Customers would still be getting screwed if AMD was still kicking Intel's ass like X2 vs Pentium D. What? Short memories of $425 3800+? Please don't tell me no shit about performance when AMD is bitching about Intel keeping prices high LOL!

Layoffs suck=P It doesn't matter one bit to the folks getting sent home if they worked for AMD/ATI or Intel.

http://www.networkworld.com/news/2007/040907-amd-will-restructure-business-after.html

AMD expects to report revenue of US$1.225 billion for the quarter ending March 31, 2007, down from the company's prior forecast of $1.6 billion to $1.7 billion. The number would also be lower than AMD's performance in the first quarter of 2006, when it reported revenue of $1.33 billion.

Hell there are Geeks on this forum who knew AMD was FOS when they forecast-ed that high and had a heated thread here. At least 3 folks called it criminal! Come on guys, last year AMD was getting TOP DOLLAR for its processors and all Intel folks could was say wait for Conroe. That was a KILLER quarter and they only made 1.33billion (not profit) in sales. What hell made them think they sell between 1.6 and 1.7 billion while getting their asses kicked! I mean geesh, there only so many JoAnne Freeny like folks to fool people. She said AMD's stock would be at $45 at the start of 2007 LOL!

...

A state should do the best it can to protect its cash cows ; Intel is such a company for the US.

In the last 7 years Intel invested over $35 billion in the US.How much did AMD invest? Nothing , in fact they reduced their work force and closed FABs and design centers.

AMD is sponsored by the EU and Germany ( a fact ).

Altough this shouldn't have any influence with the IRS and the justice systems , it will always give Intel the upper hand , no matter how small the advantage is.

in 2008, one name will strike fear and terror into the hearts of AMD and intel. One name will shroud their skies with black and green. One name will end the reign of the two siblings.

NVIDIA CPU!!!

For 10 years Nvidia had been secretly developing a completely new CPU architecture, one that doesnt resemble any CPU making technology to date. A Tacheon flux processor.

Processing your data faster than time itself !!! By creating an artificial time distortion field around it's processor core, the NVIDIA 696969gtx CPU core actually STOPS time within itself, while it take it's sweet time to process your data. In other word, your data will be processed instantaneously, time becomes irrelevant. It's so fast, it cant be measured in time !!! Dual core? Quad core? Octapus core? It doesnt even matter anymore!!! With the NVIDIA CPU's time manipulation technology, INFINITE amount of software and processes can be initiated at the EXACT same time and completely processed instantaneously.

when overclocked, the NVIDIA CPU will GO BACK IN TIME to process your data and bring the processed data BACK TO THE FUTURE!!! In other word, your data will be processed BEFORE you enter them. Your favorite games would be completed before you even buy them!!! Your porno will be watched and masturbated to before you connect to the internet.

AMAZING!!!!!!!!!!

I can imagine this coming out and still giving people gpu bottlenecks and bad driver support :p

well my friend Bob has made a CPU in his garden Shed, that is actually a time machine and can simulate god. It can actually speed up the expansion of the universe and stop the aging process of living organisms.

its called Bobs first processor and will cost £10 and work in a AM2 socket. The only problem is that Bob can only produce 2 a year, and ive got dibs on the first batch.

Not as hard as Intel though!

PS "their"

Where and when did I remark that english was my mother tongue ? The internet does not revolve around the english language,as some seem to assume.

Oh,and as per the usual,Eds 'Op Ed' is right on the money....

duby and friends will really have to pull all the tricks out of the closet,to put positve spin on the above.Last year I predicted four straight losses,Two down for green, two to go.

is there any plans for a dual core barcelona instead of the quad, like the current x2s but with the shared L3 cache?

What you're looking for is Kuma. Kuma is dual core with shared L3 cache, and Agena is the desktop variant (of Barcelona) featuring four cores and a shared L3.

I hope AMD strikes back, but only if it makes Intel strike back again! That way all I will have to do in 2 years or so is upgrade my computer processor (hopefully my mobo will support them).

I'll have to tell you the same thing I tell Donnie... If you use my name against me the least you could do is invite me... Send me a PM and tell me to join the conversation... Geezzz. Come on people. Get over yourselves... You aint no better then me so get off of yourself...

Besides, maybe you shopuld go back and actually read Ed... How many times has he predicted AMD would die? 30? 40? Two months agao he predicted that AMD would be sitting at 5$ a share right now... Come on.... Next...

Then I'll warn you not to use me as an example or you become fair game again:) You should NOT spread lies about Ed as well. Maybe you should email him so he can defend himself?

Yes, $5 is bad but it isn't as Dumb as Joanne Freeney's bullshit about AMD $45 at for the start of 2007 or AMD's own BS about record profits while Conroe, Memrom and Woodcrest Kicked their asses. No wonder you guys like to switch subjects, flame and then get thread shut down.

First Donnie, you come in here, and slander my name, and then make excuses for doing it... Grow up man. Who is changing the subject? Not me. You cant make a valid argument, so you slander me instead... Come on man.... It is not cool....

Second AMD never made any claims about record profits... I specifically recall a press hearing about record sales. Which is in fact true. As far as analysts go, well we already know how horrible analysts are so you can stop putting BS on AMD for some stupid comments an analyst has made.

Third, well all you gotta do is search Overclockers for Eds articles and read the freakin titles, at least 5 are titled in such a way to make you believe AMD is going under.... Nevermind the articles, just read the titles...

Lets try to stick with facts, and leave the insults out of this...

I thought this was about amd? You guy's really need to stop arguing in the forums. If you have personal things to say to each other do it in a pm or else just shut it up.

Yep your right. Sorry about that man...

Please continue folks I'm outa this one.

I don't share your opinion of the IRS and the courts. The IRS always wants its money. The courts have no incentive either way. It's a civil case, not a criminal one.

I don't know.... $$$ is almost always an incentive. ;)

Last I checked I did not need you permission to post, nor did I ever read about having to do a curtousy 'pm' :D

Nice. "'Will AMD strike back?" was the thread topic. It's derailed into an IRS v. courts debate?
