I am almost 99.99% sure that my 9800pro dun have a ship. I am pretty sure the guy I got it from took it off. My questions is, can I still install the VGA Silencer rev 3 if I have no shim on my 9800pro?

You run the risk of crushing the core by doing that. I wouldn't do it unless I could find another shim or improvise. A little rubber strip that you could glue to the PCB or to the Cooler itself might do it. I WOULD NOT try to tighten down that VGA silencer without a shim, because it will crush the core, and then no more nice video card.
