TLDR;
There will be a cap on how many AI GPU’s are allowed to leave the US and how many is allowed to be imported by each country. All of them will require active licensing.
It will penalize countries that resell them allowing them to be smuggled out into China.

Significant likelihood SuperMicro was smuggling the cards into China and Russia.

It's not likely to go anywhere.
Nvidia isn't legally responsible for the actions of the AIBs, but as they are Chinese there is nothing there to sue so they are targeting Nvidia by proxy.
If the AIBs tell Nvidia that they are selling the GPUs to gamers, then Nvidia can either call their "Trusted" partners liars and demand the truth, or they can accept them at face value.

Nvidia is likely just going to have to settle to make it go away and turn around and penalize those AIB's by either cutting them off or fining them in some manner.

Nvidia is only responsible for tracking their own FE cards, now if a significant portion of those sales were drop shipped to miners that would be one thing, but if they were going to Best Buy and Best Buy was turning around and selling them by the pallet to miners then that's a whole other animal.

This all started because shareholders got mad that Nvidia bought back all those 1060 GPU's from Gigabyte who drastically over ordered to feed their crypto miners, sadly those board members didn't stick around long enough to reap the rewards when Nvidia sold them for 2x their price to miners as part of their dedicated mining series.
