The 2nd U.S. Circuit Court of Appeals has upheld Apple's $450 million e-book settlement. Reuters noted that the Supreme Court will, as early as Friday, decide whether or not it will hear the case.

The 2nd U.S. Circuit Court of Appeals in Manhattan rejected a challenge by e-books purchaser John Bradley to the fairness, reasonableness and adequacy of Apple's class-action antitrust settlement with consumers and 33 state attorneys general. U.S. District Judge Denise Cote in Manhattan had approved the settlement in November 2014.

'''Apple agreed to the accord after Cote in July 2013 found it liable for having played a "central role" in a conspiracy'''

so basically they settled out of court admitting that they were liable for criminal conspiracy... which means that every time that apple is is served a fine or restricted because of misconduct they are automatically guilty. Some lawyer probably pointed this out to apple's current board and likely they realized that they had to cast doubt on the case in order to keep doing biz, ethical or not. Either that or they have something in the works or something that they already did that would result in them going to prison and they are bailing water as fast as they can so no one looks into that. All just speculation since they had over a billion in their war chest which meant they had more than the fees in their petty cash drawer...
