I'm telling you right now, this is all technology's fault. This kind of thing never happened in the days before cell phones. I guess it doesn't matter, at least these two criminals are off the streets.

The female teen took a plea deal—even though she was listed as the victim as well as the perpetrator for one of them. If she hadn’t taken the plea deal, she risked being convicted and labeled as a sex offender for the rest of her life.
 
This is what happens when there is evidence and why 'forever' electronic communication is bad. Shit like this makes me want to move up into the mountains and never look back.
 
This is why you need an analog camera and your own dark room, so you can pass photos in manilla envelopes tucked in text books to each other.

This is dumb and probably needs to happen to get laws remade to catch up to the technology. So she is being charged with exploiting herself? I think I need a better source than gizmodo for this.
 
The GIZMODO article leaves out a few details, like the "sexting" included nude photos of both kids.

As far as the law is concerned, kiddie porn is kiddie porn and there are no grey areas at all. Possession is felony, transfer is a felony, sale is a felony, there are just a lot of felonies all the way around. While the writers at GIZMODO are all a dither that some kids are getting busted for "nothing serious", these photos were on their phones. I wonder if they got backed up to the cloud.

I think some of the people questioned have very valid points, that the Cumberland County Sherriff's Office is going overboard in bringing charges against the kids. I can only think that they are trying to send a very strong message to all the other kids in order to save them the problems that have been heaped on these two. Sacrifice two for the sake of the rest maybe. Keep in mind that the kids names weren't released by anyone until a local paper let the names out. These are perhaps the biggest assholes of the bunch.

This is how Denson is settling her case.

In court on July 21, Denson told District Court Judge Stephen Stokes that she was responsible for the crime of disseminating harmful material to minors. This is a misdemeanor and does not have the life-ruining requirement that she register as a sex offender.

Pretty much it's far from the first case these cases have been going on for a long time now. Any child who takes a nude of themselves can be charged with child pronography.

Fair enough. After searching it seems like it isn't a widely available article. I meant nothing against what was linked here, more against gizmodo for writing a giant opinion instead of covering details. :)
 
Just to be clear, the prosecution was worried that these kids would screw up their lives forever. To fix this, they had a bunch of adults look at nude pictures of the kids (for confirmation of course), then they smacked them both with child pornography charges so nothing bad will happen to them.

And I believe the guy is getting sentenced to 10 years in prison, to keep him safe.

I'm sure there are many fellow [H] members that hate clickbait with a passion (and also need it to be SFW) and those that don't mind the ads on clickbait sites.
 
How did the pictures even get found? I just can't figure out how police would possibly get involved.

They are charging her as an adult instead of a child, and the picture of herself is somehow the child version of herself even though the legal system already deemed her an adult?????


This is something I don't quite get. If you are going to be treating her as an adult, why isn't everything directly related to her taken as adult? Just so they'd have a case against her?

If we are talking about another party here, fine, but herself??? Seem extremely oxymoronic to treat her child/adult status depending on situation...

It all started when local police looked through the male teen’s phone for evidence involving a statutory rape case they are investigating (he is not the suspect, but they believed evidence may be on his phone). While they were looking, they found explicit text messages sent between the male teen and his female friend. And then charged them both with sexual exploitation of a minor.

Did they have a warrant or did they help themselves to this evidence?

Option 1: The police used their authority and a misdirected belief that phones are fair game like a wallet. Found the photos and charged them.

Option 2: The kid cooperated with police when requested to assist with their other case. The police/DA made sure he will never cooperate again.

Option 3: They had a search warrant to look for the evidence of the other crime and somehow got a "in plain sight" pass by a judge of the irrelevant (to their case) evidence they stumbled upon.

This is a case of police officers (and prosecutors) not using common sense. I hope they find a way to sue the hell out of this city/county.
 
So the fix is you must be 18 to have a camera in your phone?

I think the police have overstepped all authority here. It would be a different situation if it was being distributed or something like that but no what thise kids did is not something that should be illegal but that said it opens a door to some illegal things...

Yeah best fix is make cell phones with cameras be an over 18 thing...
 
Yea I really think this needs worked on. All we talked about in high school was girls and their *ahem* "parts". Finding pron on computers magazines. This would have gone on then if we had smart phones then but it would have just be a parental concern. I couldn't imagine having to go pick up my kid because he sent a dick/tit picture out to a friend and got one back. I would talk to them about how this road can go if it continues and educate them but I seriously don't think the legal system should even be involved. I know they are trying to scare others with an example but that is not fair for the person being used as the example.

"sexting" means nude photos. We know about the law, we think the laws are idiotic.
 
It's disgusting someone is allowed to ruin other people's lives just so they advance their own career. Poor kids.
