TT Max Orb - retention screw missing threads??!

I'm assembling my new Q6600 system here tonight and something seems to be seriously wrong with the TT Max Orb I got from newegg. I got everything installed up to the point where you actually mount the HS and it says there's a nut that secures it to the retention plate. The thing is that post that rises up out of the plate does not have any threads on it - it's a totally smooth shaft and I see no way to screw any of these nuts onto it since it doesn't have threads!

Did I get a defective unit here or what? Actually while I'm asking, should I have even gotten this unit with the board I have (Gigabyte X38). The retention clip thing doesn't really clear the northbridge cooler very well, it's just sitting right on top of it...

I bought a TT V1 at Fry's last night and RMA'ed the Max Orb... It was definitely screwed up, the nut had threads on it but the shaft it was supposed to go onto was perfectly smooth, like it wasn't threaded in manufacturing...
