Some guy says the Stop Online Piracy Act violates the First Amendment for "several reasons." Who is this guy and why does he think he is smarter than our elected officials? Just some guy that also happens to be a professor of constitutional law at Harvard. Thanks to TheWeazmeister for the link.

The notice-and-termination procedure of Section 103(a) runs afoul of the “prior restraint” doctrine, because it delegates to a private party the power to suppress speech without prior notice and a judicial hearing. This provision of the bill would give complaining parties the power to stop online advertisers and credit card processors from doing business with a website, merely by filing a unilateral notice accusing the site of being “dedicated to theft of U.S. property” – even if no court has actually found any infringement. The immunity provisions in the bill create an overwhelming incentive for advertisers and payment processors to comply with such a request immediately upon receipt. The Supreme Court has made clear that “only a judicial determination in an adversary proceeding ensures the necessary sensitivity to freedom of expression [and] only a procedure requiring a judicial determination suffices to impose a valid final restraint.” Freedman v. Maryland , 380 U.S. 51, 58 (1965). “[P]rior restraints on speech and publication are the most serious and the least tolerable infringement on First Amendment rights.” Nebraska Press Assn. v. Stuart , 427 U.S. 539, 559 (1976).

The better question is, how long until even that fails to protect us? Will we hit that point before people wake up and stop voting the same corrupt douchebags into office over and over? Or will be be at the point of no return then?
 
People have been saying it was unconstitutional since it was first proposed, sadly it has not stopped it dead yet.
 
well, Our last 2-3 administrations didn't give a shit about the constitution. Plus most universities are teaching this Constitution is a "living document" BS getting everyone conditioned to change it. And once we start changing the constitution then we are all pucked.

Our current POTUS was also a "professor of constitutional law at Harvard" and based on his policies, doesn't seem to have a clue about what the constitution says.

He attended Harvard Law, but taught at Chicago Law.

They are already trying to put a law through where they can detain and imprison US citizens without any appeal or trial, good thing I'm just a resident, I was contemplating citizenship but with all the recent loony laws being passed, I think I'm safer being a subject of the queen.

Do you have any idea how many times this bill has been kicked down this is the 5th or 6th time and the 4th name it has had internet black list protect ip now sopa one other I can't remember too bad the reason it keeps coming back is groups like the riaa and mpaa keep paying too try too push it through I wonder a if it will finally die or if it will get forced through just too be kicked out.

It is a matter of corporate corruption throwing the same thing on a wall till it sticks

Since when has a silly thing like the constitution ever stopped them from passing legislation. Seriously though. We Need to get some hardcore libertarians elected to start hacking off big pieces of the federal government. It's so out of control I doubt the founding fathers would recognize it.

As for the constitution... it's already being broken. However, the fact that it's there still makes it a bit more hopeful. I mean, without the constitution we probably wouldn't have Ron Paul or Ron Wyden. Both, I believe are pretty against things like these.

I do believe that Ron Paul is not corrupt. They are few and far in between, but... I believe they exist.
 
That's one thing I hear a lot about Ron Paul. He's crazy... his ideas are crazy, etc. Can someone explain to me what they consider is crazy? and why?
 
While I certainly don't like everything Ron Paul says I certainly agree with enough of it that I'm voting for him come hell or high water. None of the other candidates even come close and the ones that do I have no faith in; because they're probably bought and paid for and certainly saying whatever they think will get them elected. When talking about Ron Paul there is no doubt he will try and follow through with his promises. He has a long track record of doing just that.

today i saw a pro sopa commercial on good ol fox news.

this whole truth of this sopa thing goes back to the ben franklin statement: "Those who would give up essential liberty to purchase a little temporary safety deserve neither liberty nor safety.".

they sell us these bills as protection against the "HUGE" problems of piracy and file theft. and trump it up to something bigger than it really is. a small group sees more truth to these statements, but their voices remain small and mostly unheard, and a large portion of people who hear the truths either choose to simply not care, or disbelieve it because our "gov. is here to keep us safe, right?", yea right.

our rights and liberties have been eroded GREATLY in the last 2 decades. the mob(greater america) has been sold on many things that are at best half truths. complacent people are easy to take from.

people think they are taking action with these new groups/ideas/movements(tea party, occupy, etc) but these ideas get so mixed up and diluted that they lose direction, and they tend to pick a side of the 2 party system, so it only continues to support the same government thats causing the problems to begin with.

we honestly need to push for accountability and transparency. we need to limit all elected officials time in office. we need to overhaul the system as it stands today, possibly by not reelecting any of them. as silly as it sounds we need entirely new blood, non career politicians. people who know business and accountability. know how to budget. know how to give fair contracts, and hold the contractors accountable for their mistakes.

WE NEED TO VOTE, RECALL, REMOVE.

Can you point out a time when he's wrong on what he said about the constitution? even better if you have it as a video. I'd like to see it.

This. I think he's got some kooky ideas, but his highs outweigh his lows.

I wish we could have a President Ron Wyden, but I'll settle for Ron Paul.
