Its not a big deal right now, but i have recently purchased an iPod from a user here. He told me that the iPod was in very good condition and that its been in a protective case since it was bought. (after taking it outta the case, ther are quite a few scratches and scuffs, but it wasnt really a big deal to me), But to the main point, i recieved the iPod yesterday, and it wouldnt charge, no biggie, figured the battery was low, so i charged the iPod for a day, and it seems that the iPod doesnt work. Loads, but gives an error message. So since i live by an apple store, i took it in there and waited to speak with a specialist, and he informed me that there is a problem with the Hard Drive and its not recognizing it.

The user and i made a deal for half $ now, half $ when i recieved the ipod. And he isnt on at the moment, but im sure we'll chat very soon. but i was wondering what can i do about this situation? I obviously dont want to keep a non-working ipod, i guess im just wondering if i can just send it back to him and be refunded of my money....guess i coulda waited and asked him, but i just wanted to know if anyone has had a similiar situation, and has any input.

Based on your side of the story alone, it sounds like you should get your 1/2 of the money back, and return the iPod. I would be OK with paying return shipping just for the heck of it, but it would be fair of the seller to offer to pay IMHO.

 
if you have to and if u payed ith paypal u can open a dispute, but u prob deff wanna talk to the guy, i almost certain u can resolve it some other way and he seems like a decent guy...
 
yeah, he hasnt logged on yet, but ive sent a couple pm's his way, included my # with them, so hopefully he logs on soon. I wouldnt have a problem using my money for return shipping, thanks guys for teh input!
 
Did you not get any contact information? If you did give him a call rather than wait for him to log on. If you didn't get a phone number and used paypal send an email to the persons email address that you paid the money to. No need to wait around for someone to log on here.
 
definitely true...guess i just dont think of the obvious when a situation arises. Will email and call (i think i have his #), tomorrow!
 
well, emails were sent, and still nothing. complaint made with paypal, followed by a dispute, in which they sent me this:

Dear Frank Leavitt,

Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a

Well don't post it up here, but did you get and verify their name, phone number, address, etc....? These are all things you should do before an online purchase, so if you didn't you did leave yourself at risk. If you did, you need to try calling them and tracking them down.

At this point, I think it's fair to post who this was with. What was the members name? I saw some replies to your thread, but no confirmation on who the deal was with.

I had looked at the Heat, and it said he has transactions under the username ShadoWing , so i mean, i figured he was cool. I still have not sent my 2nd payment to him (70.00 before, and then 70.00 after) . I pm'ed him the day i recieved and told me i would like to charge it for a bit, and make sure it was in working condition. I dont really understand why he would not respsond to any pm's or emails, since i havent sent him the 2nd part of the payment yet. I thought maybe he was just away, and giving him the benefit of the doubt..but to this day, nothing...paypal has even emailed him, but still no response. I also gave him my phone # before the transaction ever took place, incase he had any questions.

I suppose im just really nervous to call him..ive never been in this situation, and it is kind of akward for me.

Also it sucks what happened dude and I bought a dvd player from someone and the battery last only 2 hours and my seller has agreed too purchase it back.

Even some people with good heat can still be a scammer or as others said something might of happened.

If you happen to get stuck with the iPod look around the web. Sometimes you can repair the HDD with a format. If you are mechanically incline you can change your harddrive yourself. I don't have the link off the top of my head.. But I did print out the webpage because I have fix a couple of iPods in the past.. Also the person who you traded with could of had the iPod apart and didn't hook up the connector properly.

It's very easy to replace a hard drive in an iPod-no sweat at all. If you want a non DOA guarantee, go with the ebay companies that offer warranties on the hard drive. They go for a little more ($100), but you get a warranty and a guarantee that the drive works.
 
i just went ahead and bought a refurb from apple. Least this will come with a warranty.
 
just an update for everyone! We're communicating and everything is good now, he has sent a refund back to me. This guy is great. Thanks everyone for the help.
