I just got a 160 gig Maxtor 6Y160M0 that I got on eBay which the description said was perfect. Anywho, installed it and now the VIA Raid utility tells me that the drive "Has risk of data loss".

What gives?

Well, it sounds like the drive probably has bad sectors and the guy is trying to pull a fast one. It might be the via controller though. Go to the maxtor website and dl thier drive fitness test to see if the drive is in bad shape.
 
I can't do the fitness test - dont have a floppy drive


is there some kind of a bootable ISO i can burn? Ultimate BootCD didnt have the right fitness test :(
 
you can go to hitatchi's website and download DFT (Drive Fitness Test) they have a bootable CD Image you can download. I usually search google for "hitatchi DFT"

will it work on all makes?
 
the hitatchi dft will work on non hitatchi drives but instead of telling you the error the message will be in eather green (which is good) or red (that is bad) if there is a problem it will say "a problem has been found on non-hitatchi disk drive" it will give an error code which you can look up on their site i think.

Then message the seller and explain to him that the drive was not as described. It was described as perfect but it clearly isn't. Ask for a refund and if you don't get a response, file a complaint to Paypal (I'm assuming you paid via Paypal) and he will have no choice but to give you a refund.

If the drives out of warrantsy, get a full refund, otherwise ask for $10 or so back and ship it off for RMA. Maxtor have a pretty good advance replacement program as long as they have a credit card to hold a charge on.
