I don't think you can download S Note. There are manufacturer specific sections of the Marketplace that only appear when you open it with one of their devices.
Yep, Windows Marketplace checks your OEM keys apparently and will not let you download it unless it is registered to one of the per-approved manufacturers.
Do you or did you ever have a Samsung device? If you already downloaded it on a Samsung device, it may be attached to your account so you can re-download it anywhere. I'm not sure.
As for inking, OneNote is widely considered to be the best program out there. The desktop app is part of the Office suite but the Metro version of it (also allows inking) is free on the Marketplace
I have a Samsung Ativ Smart PC that comes with S Note, there's both a desktop and Metro version. They simply don't hold a candle OneNote 2013 on the desktop. OneNote Metro lacks many of the most powerful features of OneNote on the desktop, most notably the ability to search ink.
As feverlax said, OneNote is considered to be one of the best note taking programs out there, when it comes to ink I think it is THE best. If you have any interest in using ink for note taking on your Surface, you have to give OneNote 2013 a try, it's just amazing.
yup, I just use one-note. I even pin it to the taskbar when in desktop mode to grab small notes. I think that's basically what s-note would be doing as well.
