I would want a video showing him accessing the device and going throughout menus. I would want to see the serial at the very least.
 
If it was sent factory reset and the pics you get are with the phone already set up, that would trouble me as well. If the scratch bothered me that bad I wouldn't be doing a damn thing with the phone and contacting the seller immediately to discuss the issue.
