Seems not correct to me.

Sun opensourced ZFS (Not a community but mainly a Sun engineering project).
When Oracle bought Sun, they owned ZFS (the license)
But they are not able to undo the Open-Sourcing (the sources up to the time when they bought Sun and stopped OpenSolaris,
newer modifications like encryption in Solaris 11 are Oracle closed source)
