NVIDIA's shady trick to boost the GeForce 9600GT

An interesting read over at Techpowerup! They claim that Nvidia is playing around with the clocks i.e. driver reporting one thing while the Rivatuner reporting another, with the card overclocking itself in sync with the PCIE bus frequency. What do you guys think? Should Nvidia clue consumers and reviewers in when they pull something like this, or is it just a tempest in a tea cup?
