North Carolina Banning Tesla To Prevent Unfair Competition?

Last month, Tesla requested such an exception, and was denied.

Yes, because "State law requires manufacturers to sell cars through a dealer, unless the manufacturer can show that no dealer is available."

...and that it is impossible "to say definitively that no dealer could meet Tesla's needs."

Thank god decisions aren't made by people who post on forums like this...armchair, omniscient lawyers who disregard the plain facts.
 
Another way to look at this is the people who can afford a tesla can probably afford a little trip 1 state away to grab one, and that state will reap the sales taxes.

Its funny though to hear this, I have seen a lot of BS, there is a company trying to start up a car, elio motors, they started in MI, but found it difficult to get any support or cut through any red tape with the big 3 around. How ironic it is that with all those empty plants in MI they were forced to move all the way down south where another state not only helped them to get in but also offered to give them tax breaks and train the employees for the new plant. Ironically it was an abandoned GM plant. Meanwhile an ex state rep working for the company is running around trying to get legistlation passed in various states to give them a monopoly on their class of car through careful wording.

Whoa there! Maybe you should learn a little bit more about how things work in China before slinging around such absurdities. You're talking about a country where you have to pay off officials if you want a business license approved, or you just want to have a second kid.

I do not think that phase means what you think it means.

The situation is explicity from invasive (aka "big") government. Now its Local invasive government but its government meddling none the less.

My point was to highlight the irony of a republican state who's elected officials praise the virtues of limited government and free enterprise, and then proceed to do exactly the opposite.

Exactly. This is a joke. You can't have both sides NC. This is over-government if I have ever seen it and a complete attack at free enterprise in the US.
 
North Carolina was taken over by the Talibaptists in 2010 and it has been down hill.

Just this year, they have :

1.Raised taxes on the parents of college students by making it so you can't claim a college student as a dependent if they live in a different location from your own residence.

2.Attempted to establish a state religion and declare that the Constitution does not apply to them.

3.Forced state-run schools to teach that abortion causes miscarriages in future pregnancies (against the testimony of the doctor who's study they misinterpreted, no less).

4.Made it a felony punishable by time in state prison for a women to go topless.

5.Made it illegal to film animal abuse

6.Pushed a plain that would raise taxes on food, start taxing drugs and other basic services while simultaneously lowing the income tax for the "top" earners (A married couple making $40,000 will now have $1200 more stolen from them by the state).

The Tesla ban is just another in a long line of states doing what states do : Prostitution to the highest bidder. Automobile dealers don't want to compete so they get in bed with politicians including people who laughably call themselves "Free Market" (anyone that believes Repuglicans are free market should go buy beachfront property in Iowa).
 
damicatz, have names for anyone you hate? Not exactly what I'd consider a mature post despite having some good points. Sure, I don't agree with religious zealots & corrupt politicians, but your post really just gives me the sense that you're not too far off from being a hellbent naysayer.
 
I thought it was the auto-industry that wanted this practice. You cannot sell a car directly from manufacturer to customer. Paid a bunch of politicians to pass this. Want to point fingers, point them at greedy car manufacturers.

That is so upsidedown it isn't funny.

Car Manufacturers get ef'd over by state dealerships and local state governments constantly. The states for a long period passed retroactive franchise laws that re-wrote whatever contractual obligations of dealers. Hence the local dealer can treat a customer like complete crap and manufacturers can do nothing about it.

The US manufacturer had for a long time been retroactively re-written. The Japanese dealerships in the 80's and 90's were relatively new and hadn't been rewritten by state governments as much so the dealer experience in the US car dealerships was complete crap in comparison. Now that the Japanese dealership have been around for a while, they are converging on where the US dealerships are.

The reason that the dealers are fighting this over Tesla with relatively small volumes in a niche market is that it sets a bad precedent that the dealers don't want other manufacturers to be allowed to follow.

If you made it the Death Penalty to propose a law that violates the constitution, half the state legislators in the US, and 2/3 of Congress would be taking a dirt nap by now. :eek:;)

I think he's referring to a law prohibiting animal rights activists from secretly filming conditions in plants in the meat industry. Probably sponsored by politicians in the pockets of said industry.
 
Jeez this makes no business sense for the state...
not a whole lot of sense for dealers either.. I really don't see Tesla having a problem with doing business with retail people in the future if they need quick expansion.. right now yes they need very tight control of the product, it is a very different product, with a range of difficulties they need control over... they can't just drop some cars and hope for the best... they might be able to if there is more and more market expansion for them...
Its difficult to understand.. have this business people genuinely interested in Tesla being part of their dealers? probably not... I just don't see Tesla unable to cut a deal, even if for space for a tent on a tesla-controlled store inside store type thing.
 
Let's ban US companies from selling it's products while we bring in more Japanese built cars. Sounds likes a great idea to help our economy.

But Subaru is built in America, you are helping the economy by buying one...Besides Chrysler, and Viper, are any of the American brands actually built in North America?

If you buy a car out of state, you generally pay sales tax when you register it in your state.

The North Carolina Republican Party has already made public statements that the Constitution does not apply to them.

The North Carolina General Assembly does not recognize federal court rulings which prohibit and otherwise regulate the State of North Carolina, its public schools, or any political subdivisions of the State from making laws respecting an establishment of religion.
