Need advice about p4 ES

One of my friends bought a p4 chip off ebay, it turned out to be a ES chip, He didnt know waht it was so I explained to him about it. He decided he dindt want it and put back on ebay to try to get rid of it. He received a email from intel about it, sayin it was either stolen or given out by someone who wanst suppose to. They want him to email them back, or they will go to the local cops to take action about it.

What would any of you do in this situation. I know I woudlnt have put it back on ebay, but he coudlnt use it and watned to get rid of it.
 
email them back and tell them who he got it from.

why he couldnt he use it? its just a P4 with unlocked multi's
 
It appears that in teh email intel wants the CPU back along with info on where he got it.. this sucks for him.. he bought it and now is going to get screwed. I beleive his cooling wasnt up to the task, it was was throttleing very early, @ 57C and this was a prescott, so it would have been pretty hard for him to keep the little chip cool.
 
unless intel will give him the money for what he paid for, i wouldnt give it back. surely he has some proof of what he paid for it.
 
intel should at least buy it back from him. if htey dont, tell them that theyre out of luck - that you legally bought it without knowledge that it was an ES and that it is your (friends) property, by law.
 
Actually, according to the law, they can charge him with A) Buying stolen property OR B) Recieving stolen goods. Either way, Intel can get it back for free. Doesn't matter whether he knew it was stolen or not, it's still stolen. Not that he's at fault, just that he can't really do much about it.
 
He probably can't sue ebay, but hopefully he paid with paypal and may be able to get some money back that way.

Good news on one side.. He talked to intel, and they are going to give me a new cpu to replace the ES when he sends it back to them. They arleady knew who sold it to him casue he bought it off ebay. THey just wanted the ES back. So not all bad news.
