About 1 year ago I was extremely busy and bought a 9800 pro from a local place, and had it installed. About 2-3 months ago it burnt out and I had brought it back to the local computer place to get it repaired/new one from warranty, being a sapphire 9800 pro. About 1 week ago they brought me one back with a scratched heatsink and it was a totally different heatsink, being a closed heatsink instead of the open sapphire one. The heatsink is scratched and the bag is open. Im thinking this place is fraudulent..... (they possibly sent mine in for a brand new one, to sell on their shelves, and gave me a shitty one) BTW is has wierd graphic anomalies and I can tell its also fucked. The local place said that is how sapphire sent it to them, but I believe that is a load of bullshit. I believe sapphire either would not of sent one, or sent one in good condition, sealed. Any thoughts?

I work at a computer shop probably similar to the one you visited. At our store we sometimes like to test the cards we have had shipped in to make sure they work before we sell them to customers. And even one time I broke a fan in the process, replaced it, then put it back on the shelf for resale. As long as the card works fine, and they still recognize the warranty, I don't see a problem.

Listen and listen good, better business bureau has NO POWER OR AUTHORITY at all! I don't know why people always refer to the BBB, they aren't a government entity. Contact someone legitimate like your attorney general if you come across a fradulent business.

MFZ is correct, the Better Buisness Bureau does very little to protect consumers. For example companies have to pay $$$ to be members of the better buisness bureau. If you file a complaint, the BBB will note it and that's it! The company in question will have one year in which to respond. Hear that? Just Respond, not rectify the problem. Responding, could even mean go screw yourself...Most small companies will do anything to avoid court or bad publicity. A threatening letter by an attorney should do the trick...
