just found this on my desktop and can't delete it

I rebooted my machine and on the desktop is an icon for nemu.exe.
WHAT ?

so I try to delete it. NO WAY...this is being used by another process.
well I searched on google and it says this program is some game emulator.
which I don't have. and I can't find anything running it.
How can I find out what is running this so I can delete them both?

if I can't find the parent how can I kill this thing?

Try booting in safe mode, and deleting it that way. It SOUNDS like a game emulator, but if you didn't put it there, I'd be dubious. Could well have made it there via a Spyware/Malware/Adware install. Try running SpyBot S&D AND LavaSoft AdAware to remove.
 
tried both scanners and they didn't find anything.
I tried to delete it in safe mode and it would not do it.
BUT I was able to move it to another directory and then delete it.
I still don't know what program it was tied to.
I rebooted and everything seems to run ok.

its getting where everything is spyware untill proven its not.

Go into task manager and end process tree on explorer, then go to file in task manager and start a new task "cmd". Navigate to the file you want to delete and kill it. Close the cmd window and go back to file under task manger and start explorer again.
