I know someone who does this... and no i dont mean myself...im deadset on this being illegal.. yet i cannot prove to him it is. Can someone provide me with some kind of documentation so i can present it to him.

the RIAA tried to sue a dead man... im sure they can make anything that has to due with the consumer and music illegal (besides purchasing)

If someone were sued it does not necessarily mean they did something illegal ;), but otherwise i know what you are trying to say.

OP, i have no idea what the answer is...

Yes.
According to the RIAA, the use of tape decks for recording the radio is illegal.
Anything that isn't a personal copy is illegal.

In a nut shell, yes it is. will they come after you for the copy? prolly not. it's when you re-disubute it and/or make money from it, is when the get upset.

No, it is not illegal as long as you are recording it for personal use. It's part of the public domain. If the RIAA says it's illegal, they are wrong, plain and simple.

As I understand if you record a song from the radio (internet or otherwise) and only use it for YOURSELF (playing in the car/house/mobile MP3) then its not illegal. If you use it to distribute the music (torrent or otherwise), sell, or public use (club, meeting, ballgames, whatever) then it is illegal.

well, here's the deal: You can record it, but if you circumvent any type of copy protection scheme in doing so, you are violating the lovely DCMA.
