I recently bought a full build from a fellow member.

http://hardforum.com/showthread.php?t=1624072

The build came in the mail and I was thoroughly dissappointed in the condition that it came it.
It was mostly wrapped with newspaper and came with no foam. Anyway. When I opened it, the video card was still hanging from the pci-e slot, in which the pci slot was coming loose from the motherboard(the motherboard was still in the case). The large heatsink had a screw missing, meaning I couldn't mount it.

I was able to forgive all of that as I had checked if the system booted up, and electrically it worked. The only gripe I had was that the case was in bad condition. The case was a HAF 932, the 5 front plates were missing and the expansion backplates were missing. I could not fully screw in the psu as the back had been bent, so I was only able to put in three screws. The case feet were also broken, and a few edges were bent. I understand everyday use and stuff breaking, but I believe the seller should atleast describe these things as it is an OBLIGATION of the SELLER and not the buyer. In the original post, it says "+$50 shipped for case", but I wouldn't have paid the extra $50 if I would have know the condition. I contacted the seller asking a refund for the case because the condition of the case was not described in the post(completely left out really), so I assumed that the original packaging would be included, but he said that I was just having buyers remorse. Im wondering if you guys could give me some thought into what I should do. Wether its my fault for not asking about the condition first, or the sellers fault for not completely describing, and also who should pay for shipping if the refund is going to take place. I'm only asking for a refund of the case, as I am willing to let go of the unmountable heatsink and poor packaging.

Below are a few pictures of the condition of the case.

Thanks again.

tough call.

buyers remorse is an accurate description though, i'd probably feel the same way.

is the pci-e slot actually damaged? i noticed the vid card wasnt in the top slot anymore.

there are some pretty basic questions i try to ask when buying used cases and mobos, ie., slot covers, i/o plates, condition, etc. i've found if you don't ask - sellers will leave out the details.

Yea. I feel partially at fault as I was naive and took the [H] community to a higher standard. I actually haven't checked that slot. I was too scared to. I'm at my parents place for the weekend, so I can't check it now. But it seems that that the pci-e slot is quite bent. I found the card hanging from it as I unpacked it. It was still in the slot during shipping with no support >_>. One of the USB headers was bent on the board as well, but it worked....so I didn't mind. Although feel like I am at fault, I also feel I am giving the seller a lot of slack as I'm not even asking for a refund on the HS, on the account that I can't even use it. I just want a refund for the case.

Wow that is pretty beat up....

Did you really pay $850 for that thing?.....cause you could of built a brand new system with the same shit for around the same price...

One thing you have to watch for is not everyone that sells on the [H] forums are good.....I think there is even a list of bad sellers.

Anyway sorry to hear about your bad luck....what a horrible seller.

You shouldn't have to suffer from poor packaging choices. This isn't a case of buyer remorse IMO.

I would send it all back and get a refund.

Not sure how he would do that IF the seller wont give him a refund.

So far he's only asked for reimbursement for the case. Really though, with that kind of a shipping job the components might have been damaged.

Perhaps after seeing this thread, the seller will reconsider.

Very true. A Tarnished name on Hardocp.....well that wouldnt be good if you want to sell future items.

Good luck TS!

I don't think I'm asking for too much. I just don't want to leave and receive bad heatware. But now I don't think I have a choice if he doesn't comply.

Always make it mandatory to ask for pics and description! And ask questions in a Buy and Sell forum like ours.

.... don't just rely on high Heatware, make sure the above is your topmost responsibility as a buyer!

So. What do you guys think I should do? Paypal dispute if no refund agreement is reached?

Considering the condition of the case, and how sleezy the seller seems I would want a full refund.

No telling what he did with that hardware....specially with the case and PCI-E being like that.

my 0.02c

i would put in a paypal dispute, you should have taken pictures of the packaging too. also if you checked out his heat he had a neutral about undisclosed condition already.

In the pm's you never asked about the condition of the case? or the other parts?

Yes you definitely got burned here from the looks of it. We don't have the seller's side to the story so it is not objective to form an opinion based on one side only. Now you know to always get pictures of the merchandise you are buying before you buy it. You cannot rely on words alone. Make sure you document everything. PayPal generally sides with the buyer on these sorts of things and you should get your money back. If this is as bad as it seems, hopefully the seller will get reported and his subnet will be banned from the forums.

I bought an Antec 300 from someone on this forum. The box arrived in perfect condition, but it was badly packaged like yours. The wire mesh front had 3 dings in it where the fans go. The seller claimed it was shipping damage, but I found that hard to believe as the box wasn't damaged in any way. I asked for $10 off the cost of $40 case, which I got after opening a PP dispute. I don't think you should get the case for free, but some $$$ back or the ability to send it back would be in order. Buyers remorse? More like crumby/dishonest seller.

It does happen though. I bought a case from Newegg where the box was in good condition, but the front bezel was cracked about a inch long and the mesh like optical driver cover was slightly bent in.

no matter what, it was bad shipping packaging (or bad disclosure by the seller)

you still deserve some refund for the bad shipping and non-working use of the heatsink/damage to other parts

Every seller should provide full disclosure on all items they sell so the buyer can make an informed decision. If he doesn't want to cooperate then open a dispute. You should also point this thread out to him.

He's had one incident on his heatware in the past where he didn't fully disclose the condition of the item (granted, it was in 2008). He's also never sold a big item (biggest was an Xbox 360), but he packaged them well according to the buyers that left heatware feedback. I won't assume that he's a dishonest guy looking to gyp somebody, but I think he is at the least mostly responsible for what happened.

I would definitely try anything (through proper recourse) to get a refund, as he very poorly shipped the computer, and it damaged the components - forget about disputing the case, because this has escalated to an issue with the components. For example, I would think it to be common sense that you take the heavy graphics card out of the case when you intend to ship it, because it can absolutely do the damage you've seen. There's no telling what other problems could occur due to his shipping method.

Labeling this as a case of "buyer's remorse" is insulting IMHO, especially when it shows up with pieces hanging from it.

IMHO, I would leave a neutral heatware feedback if the conflict is resolved to your liking without a payment dispute, and a negative if it isn't. The way it shipped wouldn't be tolerated by many of us on any FS forum.

Agree with above. For sure file with paypal, keep all pictures for any questions.

Can someone be banned from H forums for being shady? (Just curious)

I would for sure dispute it, that is a lot of money, and not really fair deal. Maybe u can get half back or something?

Closing this before it gets ugly.....BaoTung you a got lot of opinions....if you want to add more info PM myself or any other FS mod to have the thread opened back up

Opened back up so that Roflcopter_Down can post his side of the story...

thx crosshairs for opening

hi i am the seller. i'd like to add my side of the story and clear my name of OMG HORBLE SELLER!!!1 i dont understand why this thread was made. from the start, i said was very sorry for the poor packaging job and i would help make everything right.

i left the computer with a local shipping company and paid them well to ship and package it. it doesnt bother me since it was insured. i told him he can ship the case back to me and i'll refund him $50 when i receive it or i can file for an insurance claim and will send him $50 when it comes through. i have not heard back from him since.

but in my defense, $50 shipped for the case is pretty cheap. look how much other cases are. yes, it was missing a few covers in the front (i had a couple optical drives/card reader so i didnt notice until i removed all of them) and it was missing the back pci covers. those parts dont really matter and can be replaced for cheap. the feet were broken (in transit) but an extra set of replacement feed were included...

the heatsink was tested and shipped with all 4 screws. even if a screw was lost somehow, a replacement screw would be very cheap... the seller originally asked for a refund on the hs but since changed his mind.

I would recommend getting some pictures from BaoTung of their packaging job, because it sounds like they did a poor job and ultimately caused the damage to the computer. It's obvious that that could be a valid insurance claim.

I've had that happen to my bicycle once - paid the UPS guy who "ships bicycles all the time" to pack mine, and sure enough it arrived covered in grease and packing peanuts, and the expensive rear shifter wasn't protected at all...
Ended up getting refunded the cost of replacing it, after UPS first denied the claim.

Though the replacement parts are cheap, a little more disclosure on what was/wasn't included would have saved everybody a bit of a headache, and it wouldn't come across as a shady deal ;)

Im actually glad stuff like this is posted on forums, Theres always something i take away from the post to help protect myself and others be it im selling or buying. Always nice to see things get worked out also

Closing this up again, involved folks, you know the drill if you want anything updated.
