Since the mods closed my other thread (with it still remaining unresolved..), AGAIN, I now have to open my third thread related to this deal.

GTX4U, in "retaliation" has decided to take it upon himself to just "make up" stuff now, [I sold him a pentium computer system off of hardforum? Funny.. I haven't had one for sale on hardforum.. I had a p4 mobo & cpu combo [which I sold to cannon, not gtx4u].. I had an amd / shuttle SN45G which I sold to marklar.. but, uhm, No pentium computers...

Please remember this if you decide to have dealings with him.
 
Hmm I sold a 3800+ newcastle to him just a few days ago, he paid quickly, I shipped it and left him heat. He hasn't installed it yet but he seemed to be a good trader to me, sorry to hear you're having problems with him, but everything seemed okay to me!

Well, it is keeping the processor which likes to repeatedly lockup, fail prime95 after 30 seconds, etc.. quite cool. I'm running at about 27c, but with a system that doesn't stay on for more than say.. 30 minutes. that's to be expected.

Heres a tip: pay with your credit card through paypal, that way you can do a chargeback if the product you get is unsatisfactory and the seller wont do anything about it. I learned this lesson the hard way when I was sent an x800 that was doa (i paid $400 for it).

I bought a brand-new AMD 64 3500, it was factory sealed from eBay some time ago last year. At the time I already had a AMD 64 3200 intalled so when I got the 3500 I didn't bother to install the thing right away.

I'll admit that I opened the box, and picked out the box to check CPU to see if it was ok from the shipping from my Seller on eBay. Also I decided to sell the stock heatsink on eBay for some money, But I didn't realize the heatsink was so important for the warranty back then. But I never install the CPU, not even once, so there was no way for me to tell if it was a bad CPU or a good CPU.

Due to schoolwork I got carried away, the 3500+ just sat there on my shelf for several months. Until one day I got enough heatware and decided to sell it on the internet.

I sold it to malogato, he says it's missing a heatsink so I bought a 3800+ CPU with stock heatsink, and shipped the stock heatsink to him. I thought that would satisfy him.

Few days later he leaves me a negative heatware feedback without asking for Refund first.

Also before he left the negative heatware. I didn't know the CPU was a bad one, he didn't tell me he want a refund at all. After I got the negative I asked him why did he do it. He leaves negative heat, then he tells me he wants a refund and the CPU is a bad one. What a genius.....
 
Also I'd like you to know that, If I knew the god damn CPU was bad, do you think I would've sell it in the first place? I would never want a negative heatware.

exactly. All you had to do was come on here and reply when he put up his first thread. I think it goes without saying that if buyer gets back to you and reports that there is something wrong with the item the seller should offer ways to fix the problem. You still have a chance to make this right for the buyer. The made up retaliatory negative makes you look all the more trollish.

You were PM'ed, and emailed, multiple times. Your phone was called, but since your parents don't even know who you are, that was moot.
Mods sent you pm's telling you to reply to the troll thread.

ALl of this went unanswered. Finally, after waiting many days for your reply, and 2 days with the cpu being defective, then, finally being told by you that "I must not know what I'm doing" I left you negative heatware.

This was of course, after I had said to you (and in the "you are a troll" thread) that I wanted my money back.

It still does not excuse the fact that you left bogus heatware (should I say.. fraudulent? - you completely fabricated the concept of me selling you something, whereas, even if I had overreacted, you did at least, you must admit, screw up)

Since you were not communicating much (and when you were, you were basically telling me that I'm a stupid person, who doesn't know how to use a cpu, and that it is my fault for not purchasing a heatsink). It was my hope that there would be some actual dialog going on here.

Honestly. At this very moment, what would make me happiest is to have this cpu replaced (as I have since purchased a 2nd mobo and cpu elsewhere) and wish to use said 2nd motherboard to upgrade my gf's computer.




As you cancelled my paypal refund request (it must be a *refund* not a payment, otherwise I'll get charged a paypal fee...) I can only assume that you no longer intend to give me back my $185. But, that's ok.. It is my intention to have this cpu replaced by amd. This is what I wish to be the outcome.

My 'bones of contention' here are that :

1) Since I'll have to pay a small amount of cash to send the cpu back to AMD, a partial refund would be considered an alternative, to you "losing all the $$ I paid you"

I humbly suggest $7 which will cover the shipping cost + $185 insurance to california.

2) You told me to go purchase another heatsink.
I took this to mean that you would not give me the heatsink I actually paid for.
With that in mind, I went and purchased a heatsink. I spent approximately $30 (I have the receipt somewhere) and in my thread that 'points you out as a troll' I even show the distance i had to drive to go get it. - I factor in my total expense at $45.

I do not want, nor need, this big ass copper heatsink. The stock heatsink is actually quite fine! So, here is what I suggest on this is that you purchase the heatsink from me. I will chalk the fuel expenses up to "experience" - as I also ended up "Making the most of it" and took that same opportunity to go to a restaurant I like down in that area.
I will send you this heatsink, for $35 shipped. It costs, new, at best buy, $29.99 + tax and shipping. It will come with some knock-off thermal interface material that they included with it, and it's clear 80mm fan.

I am doing everything in my power to be fair.

1. Selling as new without required materials for warranty

I could probably think of more if I really wanted to.

He is now the first addition to my DNT list. Definitely not someone I would want to deal with.
 
I did ask him why he left the heat and the only thing i got was

"He send me some foul e-mails, that's all I can say. And from my point of view he's probably a little kid with no respect."

This was after he replied with threats (that i deleted and have warned him about doing again) of throwing a piece of earth in your headeral region.

Im assuming since he replied to that PM, that he did get the others that were sent before he replied here.

The fact of the matter is.. the SERIAL # on the HSF and the SERIAL# on the cpu are supposed to match _ The replacement HSF he sent me had a different serial # on it.

10/9/2005 - to maybe 10/13/05 - I continue to troubleshoot. I swap out parts as I have available [pci graphics card, different ram, no hdd's, not in case.. eventually even quasi-voiding the warranty on my hp laptop to pull it's venice cpu] and I eventually narrow it down to.. voila.. THE CPU.

P.S. now that i also have another motherboard to put the cpu on, I've tested it there.. and, wouldn't you know it.. it locks up there as well

10-14-2005 - I leave the negative heatware.


10/17/05 - I send a paypal refund request.
10/17/05 - He cancels refund request.

10/17/05 - I begin rma proceedings with amd.

My priorities were.

1) Warranty intact
2) is a functional a64
3) is new.

Well guess what heres my time-frame the last messege I got from you on HardOcp.com was 10-13-05 Just an update for you.

"I have purchased a $30 heatsink & fan (big, honking copper beast) and, now that I have it, I have finally had an opportunity to work on building the system.

Status is that I am having some stability issues. As there are multiple pieces from different sources on this, I have not proven to myself which component is the culprit. I'm down to "motherboard or cpu"

As the motherboard itself is an actual new in box evga (I know, I bought it straight from newegg, and the plastic was sealed) I am tending to lean towards your processor. I have already swapped out the ram and the video card.

The old ram passed memtest86, as does the new one. The video card has been swapped with an old PCI card, so that I can at least run prime95. Prime95 torture test fails after 1 pass., pretty much "automatically".

I've got over 20 years in the business, the only thing is that the company I work for (and I, myself, for that matter) have put off embracing 64 bit, so, this is our first a64, that is why I don't have 'spare parts at the ready' to swap around. We still build, P4 478s and A-XP's for our customers [nobody has asked for a dual core, or an a64 rig in this town]

I am working to get my hands on another S939 cpu.

As I *still* have not received the "warranty validating" heatsink from you........ (hint) if I determine the cpu I got from you to be the culprit, I will probably be looking at an alternative to filing a warranty claim with AMD.

I hope that we can come to.. a satisfactory solution, as honestly, I've been nothing but completely upset with you about this transaction since I received your package."

Clearly you did not state that you wanted refund of any. At that time I've already told you that I shipped you the heatsink. Then the next day you left a negative heatware without warning. Then ur problem will no longer be my problem anymore.
 
a simple thing I can tell u malogato is that, I don't need to know ur 20 years in the business, if you didn't want the CPU on 10-13-05, just tell me you wanted a refund, but instead you left a negative heatware. And guess what, all that junk u just typed? They'll all become MEMORIES in about 2 weeks of counter-strike source killing.
 
So they you're going to ignore the problem and basically become a bad trader? Thats probably not the best idea if you want to keep on selling. Plus it would be a good idea to remove the retaliatory heat as well. I hope that people search for your name from now on before buying from you just to find out your a bad trader. That's because I asked for a refund 4 days previous. When you refused, I looked for other options.

Wether you feel my negative heatware is "Fair" or not is completely seperate from wether you are entitled to just "make shit up" to negatively effect my heatware. My heatware feedback on you, at the very least, pertains to an actual transaction. The argument as to wether or not I should have left you a positive, or neutral, is seperate from this.

The fact of the matter is.. You can still earn a positive evaluation. Anyone who reads your heatware, and sees me give you a negative, then a week later, give you a positive saying something along the lines of "Seller made good on the transaction" will be happier to deal with you, methinks.

It is ok for things to go wrong. (This part is not what makes you a troll)

Hell, I feel bad on my part about one of the transactions I made recently (Selling my p4 mobo & cpu to cannon) because of the fact that I had to delay shipping it. The difference here is that, all during the time I delayed it, I was in communication with cannon, and he was cool with the delay (he was waiting on other parts anyhow, so it really didn't put off his build). However, had he said "Dude.. I need them parts now!" I would have either 1) Refunded his money if I just 'couldn't live without them' or 2) Figured out a way to get the parts to him.

The difference here is that I maintained communication, and "kept the customer happy"

I do not thank you for sending me a dead cpu, taking a week to get me the hsf, calling me incompetent, forcing my hand to go get a hsf, etc..

I purchased the hsf before I was informed by you that you'd actually sent me one.
I had the hsf i purchased for 6 days before I received the one you sent.


I offered up the partial refund option to you because

1) I don't think that you want to "lose the sale"

2) knowing the processor is bad, I would hope you won't try to resell it to recover your lost $185.00

3) I have begun rma proceedings already which means, I had to REGISTER THE PROCESSOR IN MY NAME, so, since amd already knows this processor is considered defective, -- anyone you try to sell it to will also discover that.

I have no expectation of getting any monies from him. I chalk it up to experience now. - I'm sure I can figure out a use for the hsf I didn't want to have to buy, and I am sure amd will warranty replace my cpu, as it was dead out of box.

So what if I spent $230-$240 for a used athlon64 3500+
