Dear Forum,

I wanted to personally tell you of my gamestop preorder expierance (pardon mispellings)..... A couple days after the xbox 360 went up on the gamestop.com site I went down to my local gamestop which we've only had for a few months here and placed my preorder for the system on 8-26. As of this time, the system was advertised shipping on 11/22 on the website with everyone ordering being in the 1st batch shipped. Gamestop.com was full of inventory, with nothing shown out of stock and everything ready to go. As you know, about a month later preorders where stopped, and later on reopened for a 2nd shipment ordering status. My order being placed on 8-26 was well before the i think 10-10 cutoff date for 1st shipment status.

Well, after all these months I called the local store today to see how my order was coming along and they told me my xbox wouldnt be here till the 2nd shipment !!!!! I almost passed out, I did turn red, and did hang up the phone... only to get online and hop over to gamestop.com to find its corporate information so that I could get this mistake fixed fast. After calling the # provided on the gamestop site, I was directed to #1 to talk to someone about their local stores. The person answering, I didn't get his name .. was so frustrated I didn't even ask .. after hearing my problem explained that ordering from a local gamestop store was not the same as ordering from gamestop itself. The advertised shipping dates that the corporation, and everyone that ordered directly from the gamestop.com site were guaranteed are not guaranteed on orders placed at local stores.

Now, I sit here.. the day before the xbox360 ships, with a nearly 4month old preorder.. that I could have placed on any online site, or with many local retailers... but chose gamestop, and in store pickup delivery only 15miles from my house to be xboxless come tomorrow. What makes it even worse is that people that ordered AFTER me, are now receiving their xbox's while I sit here with none.

I have began filling out fraud forms online and encourage anyone that has had the same expierance to do the same. Below I will provide 2 of the online reporting sites which I have already used and i'm still looking for more sites to file my complaint on. I just wonder how many poor saps ordering from their local gamestop stores have had this happen to them.

If anyone is having the same problem, please make a post as I feel this is great class action lawsuit material.

Sincerely,

Jamie D. Folds

Response from other forums has been great, it seems that only in store local orders have been shafted. As a followup, the customer support of corporate gamestop has put me in contact with the distract manager so we'll see what he can do... if nothing, i'll seek someone higher up.

i work at a gamestop, from what i understand, there's nothing that we or you can do, microsoft shipped less consoles than what the corporate guys predicted so lots of pre-orders got pushed back. I know my store could only fill 6 of our 60+ reserves on the first night.

I think the game stores need to eliminate taking money for preorders when they have no fucking clue how many they're getting. Then people wouldn't feel so ripped off when they discover the store got 4 out of 120 like my local store. I know it's not their fault for how many xbox 360's they got, but shame on them for taking so many people's $50+ and not delivering. It's kind of like wanting a car, and making payments on it, but then when you go to the dealership, they don't have one.

indeed.

Gamestop gets all my orders right. 'Cause I don't use 'em.

In all seriousness, I'm sorry this happened to you. Maybe try the BBB and report? I'm sure they'll agree that it's mostly MS's fault, however. Gamestop was told they would get the boxes, but MS didn't deliver.

Same here, although it's been out for delivery and I still haven't received it!

Patience ;)

I'm kinda in the same boat. I pre-ordered my xbox 360 in August. Yes i know that was kinda late, but the store had only been open a week or so, and when i pre-ordered, i was pre-order #5. When I called today to see if i could get mine, they told me i was bumped to 2nd shipment. TOTAL BS

Two weeks ago I went in and was confirmed that I was #5 and that I was on the first shipment

Today the guy told me that he they got less than 20, but I was bumped to 2nd shipment. How does that happen??

simple.. you didn't order $500 worth of games and accessories at the same time.. if you had,you would've gotten your xbox

The first 4 guys prebooked 5 each? :p

Pretty much they gave them to people that paid more by buying other stuff. Pretty much you just got shafted.

To the OP

There was no fraud involved here, merely you misunderstanding the disconnect between ordering in the store and ordering online. Gamestop keeps a certain # of the consoles to fulfill the online orders, they then allot the rest of them to the local stores. If you preordered at the local store you are in a different part of the supply chain, and thus are not a part of the same promised first shipment.

I am sorry to hear that you misunderstood, and it stinks, but waiting a few weeks wont kill you. I camped out in the freezing rain to get my Xbox only to have it be defective. So basically you preordered and have to wait, I froze my ass off, stayed up for 48 hours straight, and probably got a cold and am in the same boat as you. I say count your blessings.

the 4 guys preordering 5 wouldnt work,

when i went in to check on mine, the guy said anyone that preordered more than 1 had all their extra preorders dropped to a later shipment.

as for the people who paid more, if that's the case, then that is some complete BS. 50 bones down guarunteed my copy. grrr....

Well, sorry to say that i ordered from gamestop

gamestop is gamestop, the sign on the store says gamestop, the website says gamestop, the corporation is gamestop so my order as of 8/26 was for a held xbox 360 as of that date from all the order that gamestop received.

What has happened is that store preorders, the people that actually paid a down payment in cash have been screwed over by a company that decided to ship all its alloted units to people that ordered online and in my case ordered one and even two months later than myself.

The words 1st come, 1st served are supposed to mean something, meaning that when you place your order your in a defined line that the date of your order sets who gets what first.

If there was 1 single unit shipped that was ordered on 8/27-11/01 then that unit was mine, not only mine but belonged to every other preorder placed before 8/26

It's downright criminal what has been done here, the have's have been taken from so the have not's can get their systems first. I don't know what's going to happen in my case, but i'll keep on the phone and emails till i reach the top of the chain whoever in gamestop that might be. Whether they have to recall an xbox from someone that placed an order in october, or whether they have to break down one of those $4000 plasma tv bundles, or whether they have to get online and order a $1500 xbox360 from ebay i'm going to have satisfaction of knowing my order meant something on the day it was placed, and that my place in line will not be forgotten as they are gonna have to somehow ship me a unit.

Crime does not pay, as the old saying goes.

Let's dont forget that all online orders shipped... people that ordered in september, october and i've even heard of someone ordering on november 1st receiving their units all on time.

That is NOT a lack of xbox 360's, that is a lack of respect for those of us that ordered in the local stores before anyone else.

Gamestop started taking preorders in May. I have it on good authority that some of the latest first shipment preorders were placed in July. The end of August is simply too late.

Honestly, the problem here is one of information. Who controlled the information about production capacity? Who had beta dev kits in the developer's hands only months ago? Who released the backward compatibility list only a week ago? The answer to all of the above is Microsoft. They handled the launch badly. They may not have intended it to be lousy, but they sure are the ones to blame for things not being in order. Chill out on the retailers, believe it or not they really DO just want to sell you stuff.

Go for the gusto sir. Let us know where you get.

date seems to have nothing to do with who's got shipped, as online orders placed september and even october shipped therefore august was not too late

I don't know about you guys but all I had to do was go to my spot at 7:45-8:00 AM Yesterday and wait until about 9:40 to get mine. No need to pre-order and no need to camp out. There are places to get things on launch day but you just need to think of other places and not places everyone would think to go to.

OP:

Once again you are simply misinformed. What applies online does not necessarily apply to all the individual stores. McD might have a special deal online, but guess what, it doesn't always apply to every store. Their monopoly game might be set to run through a certain date but if the store runs out of the pieces early then guess what, it ends early for that store.

You are trying to find Gamestop at fault here when it is really you who was at fault. You failed to realise that the 8/26 cut off was for online only. You might wonder why the online orders have a later cutoff...well they were put up for order much later. Some Gamestops were taking preorders months before you could preorder online. Therefore if you went to the store there was probably already a long line for the units.

I'm not misinformed at all, everyone ordered from gamestop

If they wish to seperate their retail stores from the corporate company then I suggest they form a new company, maybe call it 'Not Shipping R Us' and then have all new neon signs made and place them over each retail store.... then their retail stores won't be connected to gamestop in any way.

ppppfffff...... not the same my arse

why dont you order something from gamestop.com and then return it to the local retail store and see if they refuse to exchange or refund it

And what about Black Friday sales? Do you now demand that every BF sale be available online so that you dont have to fight the crowds? Gamestop decided to set aside a certain number of consoles for online orders. If they didn't they wouldn't have been able to have any online orders now would they? There is nothing at all ethically, businessly (new word woot), or legally wrong in what they did.

you should be crying, they took your xbox... one that was preordered in may just so they could give it to someone that ordered it 6 months after you online !!!!

if there was enough retail store orders to completely strip online sales, then so be it, no online sales cause all of the units were spoken for already.

thats the basis of 1st come, 1st served. it means what it says

it seems that some have lost their sense of right and wrong... i for one have not, and for those that have i can only hope one day you find it again.

Heh the reason EB and Gamestop so short on system is because they sold most of the online. I think they just said the hell with $400 pre-orders when we have $800 bundles with alot more profit going like hotcakes. They figure having you dudes wait until next year is no big loss.

i'm just pissed off because two weeks ago i was confirmed to be #5 on the first shipment.

somehow between then and yesterday, i got pushed to #4 2nd shipment.

Ok, so i have to wait a little while longer. Big deal, i can handle that and im not pissed because of it. I'm just mad that they told one thing and then did another.

And some americans wonder why people overseas have the impression you sue over anything....

I can totally understand the guy being unhappy, I preordered months ago and if the same happens I will be livid  but a lawsuit... ??????

The company allowed people who pre ordered later than others get consoles. That is just wrong. More or less they shifted supplies to sell bigger bundles. How is this not price gouging? The stores advertised Nov 22 ship date and did not deliever. How is that not false advertisement? I don't care if M$ shorted them shipments. M$ did not take my pre order. Other companies were smart enough to stop pre orders a long time ago. Other companies did not greatly divide what shipments the did get into so many bundles that almost non of the regular people got systems. GL with your situation, I hope you stick it to them.

I didn't get my pre order either so I know the feeling. I'm only pissed becuase I know people that ordered later who received a system from gamestop

Oh well... I'll be playing my PC and waiting for gen 2 of the console.

Their is no fraud and you have no case. there are many outside factors affecting this which were out of gamespot's control - like MS pulling back on stock and also probably many other people ordering just as soon as you did.

perhaps there was some fine print you didnt bother reading some where.

Again, and I shouldn't even have to say it for the 5th time, considering 2 posts above someone has already repeated it that there was NO SHORTAGE for preorders placed at the time when the shafted customers placed their orders.

Shortages would have affected online sales, as they were placed so late as to be considered as walk in purchases. Yet online orders shipped, and retail store orders did not.

How do you place a poll on this thing? Let's see how many hardocp users got shafted by gamestop

Poll: I preordered a xbox360 from gamestop in time for 1st shipment delivery
A) I ordered locally and got shafted on 11/22
B) I ordered online and received my order 11/22

Would make a nice addition to the hardocp main page.

This is really funny, I have been laughing my ass off for a couple of days now. People get so worked up about a game system, you would think it was god himself they were buying.

If god himself had preordered at his local gamestop store, hell would be filling up really fast about now   :D

The 360 was already sold out for release day from all the pre-orders back in May/June. There were tons of articles online about it. If you weren't one of the first to pre-order you did'nt get one. And there is also a low supply of them. This isn't just gamestop but all stores. I don't think a single store in the nation got all the consoles they ordered.

Sorry, Gamestop runs THEIR business the way THEY want. Trust me, you get NOWHERE if you try to return an online order to your local Gamestop. Don't believe me? Go ahead and try. :D Finally, the cut off date for in store pre-order was May 25th. Anyone who put their reservation after that was being told their units would arrive on the second shippment.

A.....

and getting more disgusted by the moment
Let me get this straight.....you preordered an XBOX360, and you're still on the list to get your XBOX360? So where's the part about you putting down a preorder and Gamestop taking your money and telling you to fuck off? Oh ya, that didn't happen.

Unfortunately, shit happens in life, and you have to shrug it off and deal with it. You sound like you want to kill yourself just because you didn't get a 360. If you feel you've been wronged by Gamestop, here's what you do. Listen closely, this is the easy part.....don't shop there again.

Here is a story I like to share. A customer did a in store pre-order in September. For some reason, she said the store manager called her to pick up her Xbox360. The store manager didn't know this customer or whatsoever. Now, there were probably over 80 people who reserved before her. For what logic and reasoning the store manager would call her up for the 360 pickup was beyond me. :) Obviously, the customer made up the story so that she could "skip the line." She even had the nerve to call out "bullshit." There was this guy who claimed one of the staff called him to pickup the system now when in fact he reserved the 360 "late" in September. He couldn't name the person he spoke to. He then quickly changed the subject about wanting to pay the system in full so that he would be gurrantted a unit before Christmas. Of course, he could only get one in the order of date he reserved. Mostly after Christmas.

That's the first thing you do. Then you do the rest of the things he's doing. Take the complaint to the highest ranking guy you can, and then tell everyone about what happened. Shove it right up Gamestops pooper.
