Fry's thinks a E6550 = Q6600

If I was the store owner of the store you work at, you would be fired from work at day one if I noticed you giving away free items, what a waste of Employer.

I'm all for being honest, I am very honest in fact, but you just fail to realize what some of these people are telling you.

I would have kept it. I guess the karma police will hunt me down like the dog that I am.

As far as the employee getting fired or having her pay docked, that's just not going to happen. She rang it up as a e6550, and I have a feeling she wasn't the only cashier. They'll never figure it out--more importantly they don't care enough to waste resources on a fruitless endeavor. Those of us who have worked retail know this to be true.

2. The OP could absolutely NOT be prosecuted for shoplifting. He bought an item. It is not his fault that it was not what they rang it up as, and he in no way tried to deceive them.

There are four requirements to have a shoplifting case:

1) The "customer" leaves the store.

2) The "customer" left without paying.

3) The store monitored (video or shadow) the "customer" from the time they laid hands on the product to the time they exited the store.

4) The "customer" was in the know (mens rea).

So, if we look at the OP's first post, we have #1, #2, and #4. Mens rea can be proven with this thread. In fact, if someone were so inclined, they could send this thread and the pictures of the invoice (which will let the Fry's corporate machine know exactly when and where this happened)...and depending on how long they keep their store video...they could easily have #3.

I've walked out of stores before without paying for something...stuff sometimes gets missed. In all cases, I've gone back into the store (even if it means turning the car around) to pay. I've had people charge me the wrong amount (shorting themselves) anywhere from $0.05 to a few hundred dollars on various products. Man, I'd really like to save the money, but every time I've politely said: "You didn't charge me enough."

Integrity: just a thought...

P.S. -- EVERY ONE of us pays for losses like this when we shop at B&M stores. B&M store prices are adjusted to cover the expected shoplifting losses. So, for everyone who is congratulating the OP for his "score," just realize that if you have ever bought anything from Fry's you are paying for some small part of his "good fortune."

Correct. He did not know of the difference, and did not purposely deceive. He cannot be prosecuted. Rather, if they did bring charges, they would lose quite quickly. He did not leave w/o paying - he just got more than he paid for. It's very difficult to charge someone with a crime for a mistake, whether or not it happened to be in their favor.

The customer has paid, it was not his fault it was the cashiers fault. He was in the know? You mean he knew that it was a Q6600 instead of a E6550 at the time of purchase? If so I suggest you read the OP.

Of course the liberal douchebags have to come invade the thread with "political correctness" and shit like "oh that isn't right." It's a sweet score, who gives a shit.

Rock on OP, nice score @ Fry's :cool:

Hi,

To the OP, excellent score. The fact is there was a mistake on the end of the retailer. If anyone else was in the purchaser's shoes they would have bragged about the same thing. I feel that several people on here are just bent it didn't happen to them.

Look at this way. If you bought a car in which you wanted 4 cyl model because it was the only one you could afford. The dealer winds up giving you a 6 cyl version instead but charged you the 4 cyl model price, you too would be happy.

As for shoplifting is a totally different. Shoplifting is when you do not pay for any of it. He paid for the MB/CPU combo but got the wrong part. However that part was in favor of the purchaser not the seller. It also seemed like when he was going back to the store, they knew there was a problem and wanted to make sure with verification by customer, and seller that everything was in agreement.

Most important of it all is the fact retail anything is multiplier for mistakes. More sales, more potential for mistakes. All we know is the guy in the cage issuing out the items that day had a grudge against the boss, the company, the employee who handled the transaction, or whatever. Maybe the person was computer illiterate and didn't know the difference. Core 2 is Core 2 right? Not everyone in the world knows the exact specs of every PC part ever made like the back of your hand.

I have been on both sides of the counter. I have been the one who handled the transaction to the one purchasing. Trust me it is way to easy to make a mistake especially in a technical application. CCUABIDExORxDIE said it best. The people he works around would be in the negatives. It is amazing it doesn't happen more often in technical settings. Unfortunately, they[the company] sometimes do not train people in those settings to be competent enough to know what they are doing. Others are just lucky cause they can pick up things quickly. When I was in the HVAC trades many moons ago, I was just a helper and was able to run rings around a HVAC supply house's counter CSR. It was just the fact the CSR didn't know what he was doing.

However, I have been the customer and I know I was getting screwed. I did not fault the sales register operator. Instead when i spoke to someone with some kind of knowledge and got blown off, that's when I got ticked. When the manage out and out lied to me that was where I had the problem. Eventually, another higher up knew they were wrong and settled the problem. I got some additional percentage off the product. This was a Circuit City. Would they be considered the thief?

Webb, dude clam down. Otherwise please step away from the PC and go outside and breathe. The OP is not a thief due to someone's poor judgment or lack of technical knowledge. Also it would not be good for a company to have the workers be expected to pay out of pocket for any losses. You would never been able to keep anyone. That is a fact.

Once again to the OP congrats on your luck. May your C2Q bring you lots of joy to your computer. Sometimes the best thing in life is the ability to play dumb. :) Likes others said here, Karma does go both ways. Just never my way :)

good luck,
shaggy

I've read all the responses in this thread, clearly from the get-go you were on the Thread-Starter's side which is fine, but he's still a dishonest bastard.

Especially for bragging about it on a webbforum.

Well like I said before, the OP gets a better product but in the end he loses the warranty. The truth is, this is business, there are risks, wins and loses involved/
