I know this chocie would be a no brainer but if i get the Gigabyte DS3R P35 and pair it with the E8400 would i have to flash the BIOS therefore also needing to buy a celeron 800mhz FSB but if i get the E6750 i wont need to flash the BIOS which save me money in the long-run and i could overclock it to the E8400's Clock speed.
Any suggestions???

The E6750 and E8400 both run at a 1333MHz quad-pumped FSB (the actual FSB speed is 333MHz). If you can run the E6750 off the Gigabyte DS3R -- and let me put it this way: I was able to run the E6850 (same specs as the E6750, but only 233MHz faster) off of my GA-G33M-DS2R right out of the box -- then you should have no problem running the E8400, regardless of the BIOS version.

but i am still worried that the BIOS revision is not up to scratch then the E8400 wont boot and make the board apear to be dead so should i check gigabytes website to check this before purchasing this

If you want to flash the BIOS before using the E8400, go the the Gigabyte USA site and follow the instructions there. Make sure that you have a floppy drive and a floppy that's bootable upon start-up, because you'll need both.
