Ok, I recently had a PNY 6800 GT die on me after less than a year of use and sent away for an RMA, the RMA just got back, its all nice and pretty and I tested it and it worked great. Now, I plan to sell it but dont want to have missleading statement on it that later someone can call fraud on, so do you call RMA things used, even though you just tested it but got directly from company, or new because they are fresh out of RMA ? ... still got the box and all the stuff that came new with it.

new, just not NIB. Also, tell that it was tested. Better be safe than sorry.
That isn't necessarily true, since some company (like Sony) would ship out repaired (not necessarily the one you RMA'ed) as replacement units.
My opinion is to just be truthful. Say it is a replacement unit from manufacturer for a dead one you RMA'ed. And do mention that you've tested it yourself.

Yeah just say it came form RMA

Just out of curiosity, did they send you back another 6800GT for yours? I would've almost expected them to be out of these, since they list them as discontinued.

Rather than saying New or Used.. I'd be honest, and specific.

"Recently received as rma replacement for a failed card"

recently received as rma.
it seems more and more companies (dfi, abit, leadtek) are sending refurbs. it just might not be unused.
